HomeMy WebLinkAboutSUB200600271 Action Letter 2006-09-21From: Bill Fritz Sent: Thursday, September 21, 2006 9:26 AM To: bob.IIsurveys @earthlink.net Subject: SUB200600271 Virgie M. Morris Estate Property - Family Division I have reviewed the plat submitted for the Virgie Morris Estate. Before I can complete my review of this plat I need to clarify some information. The owner listed in our records is MORRIS, COLEMAN RANDOLPH OR ELSON CHARLES MORRIS. The owner shown on the plat is Virgie M. Morris Estate. I have assumed that your information is correct and that ours is out of date. The plat you have submitted is both a boundary line adjustment and a family division. If the Property is in an estate a family division cannot be performed. The grantee and owner must be members of the immediate family. Estates, corporations and the like are not individuals and do not have any family members. Please let me know the following_ 1. Is the ownership in an estate (if so this cannot be done as a family division. However, I do not see why it needs to be done as a family division. It appears it could be done as a straight two lot division. 2. Is the ownership in an individuals name and do you still want to pursue a family division. Regardless of the ownership, I do not see where this proposal needs to utilize the family division exemptions. It appears to be a two lot division served by an internal street. As such it could be approved administratively. That being said I have not done a complete review because I am waiting on the answers to 1 and 2 above so that I know the correct review procedures. I do know that regardless of the procedure to be followed you will need to contact VDOT for approval of the entrance location and you will need to submit soils work to the County for us to send to the Health Department for their approval. The plat cannot be approved without both VDOT and Health Department approval. Also, a plat has been submitted on adjacent property SUB 2006 -213 Morris, Coleman - Family Division. This plat changes the acreage of TMP 112 -32. The recordation of the two Dlats will need to be coordinated so that the acreaaes are correct on both plats at the time they are submitted. William D.
