The County of Albemarle Planning Division will grant or recommend approval of the
easement plat referenced above once the following comments have been addressed:

a. REV 1: Not addressed. The following DB/PG must also be listed on
Sheet 1, especially as these were recorded after the plat/HOA
declaration:
• Private Improvement Maintenance Agreement, Deed Book 5382,
Pages 644-648.
• Public Drainage Easement, Deed Book 5382, Pages 674-680.
• Public Stormwater Management Maintenance and Access Easement,
Deed Book 5382, Pages 654-659.
• Rt 20 ROW, Deed Book 5388, Page 742

14-302(A)(5) Public easements. On Sheet 1 include a note that the public access
easement is `dedicated to public use'.

14-302(A)(5) Public easements. County Attorney Office review is required for the
declaration of maintenance and public access. Planning staff will pass along any
comments/revisions from the County Attorneys Office.

a. REV 1: Not addressed. A revised declaration per Planning's comments
has not been submitted. Once a revised declaration addressing these
comments has been submitted, the declaration will be sent to the County
Attorneys Office for review.
b. REV 2: County Attorney Office comments: change 'the SMC' to 'SMC'
(Page 2). Otherwise no objection.

easements, based on a comparison review of the 10-12-20 resubmittal of
SDP201900068 final site plan:
Lots 42 and 45: On the cover sheet of the landscape plan these are on individual
lots, but on the plan sheets they are off of lots.
Lots 52, 53, 54, and 55: There is landscaping shown on these lots but no
landscape easements.
Lots 84-100: On the rear of these lots there are now trees shown, with no
landscape easements.
Note that the cover sheet of the landscape plan resubmitted with SDP2019-68
does not match the detail sheets. The cover sheet appears to have had layers
shifted (e.g. trees shown on driveways/sidewalks).
The landscape plan is attached for reference. Lots with landscaping not covered
by easements have been highlighted.
REV 1: Addressed, assuming that the landscape plan with SDP201900068
is being updated to:
1. Not show trees on Lots 42 and 45 and
2. Not s1 trees on rear of Lots 84-100.
REV 2: Addressed. Trees are on the rear of Lots 84-100 on the landscape
plan with SDP201900068, and new landscape easements are shown on
these lots.

maintenance agreement (HOA declaration) and plat were recorded together.
Where were the public drainage deed, SWM deed, and private street
maintenance agreement recorded? DB/PG needs to be on the plat for all existing
easements.
a. REV 1: Not fully addressed. See Comment #2. This information needs
to be listed on Sheet 1.
b. REV 2: Addressed.
7. 14-302(A)(11)(15) and 14-302(B)(6) and 14-303(D) Parcel information. Since the
property has been subdivided, all TMP's that have new easements with this plat
need to be included on the cover sheet. TMP 90-28 no longer exists. Include
information for the following TMP's: 90H-15, 90H-16, 90H-83, 90H-80, 90H-79,
9OH-76, 90H-75, 90H-101, and 90H-F. Assuming landscaping continues to
remain on TMP's 90H-52, 53, 54, 55, and 84-100, those lots must be included as
well. These TMP's can be included in one section (see example below) since
they have the same ownership information. The acreage information for each lot
must be provided as well.

8. 14-302(B)(1) Date of revision. Include revision dates with future submittals.
a. REV 1: Addressed with this revision, ensure is also addressed with
future submittals.
9. 14-302(B)(5) Zoning. Update the rezoning application number and proffer
reference to `ZMA202000006 with proffers' as this is the current ZMA number
(approved 09-16-20). This information is under Site Data and Note 6.
a. REV 1: Not addressed.
b. REV 2: Addressed.
10. 14-303(I) Bearing and distance ties. Include ties for the public access easement

a. REV 1: Addressed.
11. 14-317 Maintenance documents. Ensure that the private maintenance agreement
amendment has an updated `last revised date' once the plat has been finalized.
b. REV 2: Please send a maintenance agreement with an updated `last
revised' date (10-28-20) and ensure the correctly dated maintenance
agreement is brought in with the final plat once the plat is dropped
off for signature. Planning will scan and copy the signed
maintenance agreement and return the original document.
