Subject: SUB2020-165 Sleep Number Charlottesville - Right of way dedication plat and easements
Responses in red are by David E. Nichols of Roudabush, Gale & Assoc. on 10/30/2020.
The County of Albemarle Planning Division will grant or recommend approval of the Easement Plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable
reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-303(E)] Provide the easement holder(s) on the plat. Rev 1. Please fill in the recordation
information for these easements once recorded.
The references will be added once the off -site easement plats have been recorded.
2. [14-302(A)14, 14-428] Land to be dedicated in fee. On the plat provide the following note for the right-
of-way dedication: "_' Wide Public Right-of-way Area Hereby Dedicated to the County of Albemarle
for Public Use. " Rev 1. Per VDOT review this comment is no longer applicable. they have stated it
needs to be dedicated to the State. Please work with VDOT to get the correct language for the
dedication.
3. [ZMA2019-14, SDP2020-54] During recent conversations with VDOT about SDP2020-54 and the
shared use path along the frontage of the property they stated the applicant will need the following in the
right-of-way: the face of curb, 8 ft. buffer strip, 14 ft. shared use path, 3 ft. clear zone, right of way line.
VDOT full review comments forthcoming; however, this modification to the site plan will require
additional right-of-way to be dedicated. Please work with Scott Collins on this item prior to revising and
resubmitting the plat. Rev 1. Comment addressed.
4. [14-302(A)14, 14-428] Prior to final plat approval VDOT shall approve the plat. The plat has
been sent to VDOT. Comments to be forwarded once received. Rev 1. VDOT has provided
additional review comments. see attached.
The language for the right-of-way dedication has been changed and the quit claim
document has been forwarded to the developers to fill out and return.
5. [Comment] Prior to final plat approval Engineering and ACSA shall approve the plat. The plat
has been sent to the various reviewers. Comments to be forwarded once received. Rev 1. See
comments. ACSA has no objections.
The S WM Deed of Dedication and Easement document has been forwarded to the developers
to fill out and return.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which
may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14-
229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the
requirements within six (6) months after the date of this letter the application shall be deemed to have been
voluntarily withdrawn by the developer. Please contact Christopher Perez in the Planning Division by using

Dear Mr. Perez:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Roudabush Gale & Assoc., Inc.
dated, 03 September 2020, and offer the following comment:
I. Seminole trail U.S. Route 29 is a primary State Road. Variable width Right of Way
Dedication needs to be hereby dedicated to the commonwealth of Virginia.
2. The existing Virginia Telegraph Company easement will need to be quit claimed. The
dedication of right of way to commonwealth cannot be conveyed until the quit claim has
been released. Please refer to the land use link for the quit claim deed form 49;-

Please provide two copies of the revised plan along with a comment response letter. If further
information is desired, please contact Willis Bedsaul at 434-422-9866.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.
