Subject: SDP202000004 Berkmar Overlook - Road Plan

The County of Albemarle Planning Division will grant or recommend approval of the road plans referenced above once the
following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. [Comment] Only roads, sidewalks (within the right-of-way), and street trees are being reviewed by planning staff with
this Road Plan. Other information shown on this Road Plan, that is Final Site Plan related, will be reviewed with the
Final Site Plan once it is submitted...
Rev. 1: Comment still applies...
Rev. 2: Comment not yet fully addressed. Please note that changes proposed, since the last submissions, to lots 12, 43,
44, 45 & 46 will be reviewed with the Final Site Plan and Final Subdivision Plat and are not being reviewed with this
Road Plan.
Rev. 3: Comments not vet fully addressed. Please note that changes proposed to lots 12, 43, 44, 45 & 46 will be
reviewed with the Final Site Plan and Final Subdivision Plat and are not being reviewed with this Road Plan.
5. 132.7.9.5, 32.7.9.3 & 32.7.9.41 Provide street trees along Berkmar Drive and Woodburn Road. Street trees are required
along all existing and proposed streets. No trees are shown along Berkmar Drive. Woodburn Road is shown to have
existing trees. However, the majority of the trees along the road are also within an overhead easement. Also, it
appears that most if not all of the trees along Woodburn Road may either be within the easement, may not be healthy,
or may not be correct type of trees for street trees. Provide all required information for existing trees utilized to meet
landscaping requirements including (but not limited to) the location, species, and size of each individual tree along the
Woodburn Road that is meant to meet the street tree requirement.
Rev. 1: Comment not yet fully addressed. Address the following:
a) Revise the street frontage for Berkmar Street. It is listed as 235' and it appears to be closer to 295' (total
length). Only one side of the street intersection appears to have been measured. Ensure the number of
required street trees is provided.
Rev. 2: Comment not yet fully addressed. The number and type of trees along Berkmar Drive does not meet
the minimum street tree requirements. Address the following:
iv. Ensure the caliper of tree is listed in the Plant List and that the caliper meets the minimum required.
Rev. 3: Comments not vet fully addressed. The caliper has been added to the plant list. However,
the size of the caliper does not meet the minimum standard for trees. Revise the caliper of the
"Canopy trees" to be a minimum of 1 %:". As long as the River Birch is not utilized to meet the street
tree requirement then they may remain listed differently as long as it meets the minimum size
requirements for its proposed use (ex. SWM, etc).
V. Rev. 3: [New Comment] Ensure that all proposed trees area minimum of 3' away from any
sidewalk, curb, or asphalt. At least 6 of the trees along Berkmar Drive do not meet this minimum
distance. Revise their location, and any other tree in the road plan not meeting that minimum to have
a clearance of at least 3'.
Rev. 2: [Comment associated with #23 from the Final Site Plan & Subdivision Plat review] There appears to be the need for
off -site easements across TME45-112F. Address the following:
a. There is proposed off -site demolition shown within TW45-112F. However, no offsite construction easement is
shown in the Road Plan. Also, no documentation has been submitted for a temporary construction easement.
Address the following:
i. Show all required off -site easements in the road plan.
ii. Follow Engineering's direction on document required for the off -site easement.
iii. Show this easement on the next submission of both the site plan and the subdivision plat.
Rev. 3: Comments not yet addressed. Address engineering's comment in reference to construction easement on
parcel T IP 45-112F. Ensure that the Right of Entry (ROE) mentioned in comment response letter is shared not
only with Engineering but also planning since it impacts the site plan.
Rev. 3 UPDATE: Comments not yet fully addressed. The existing layout as well as the proposed improvements.
to TMP 45-112F, has been provided in the Final Site Plan. However, in additions to the modifications to the
layout and a dumpster pad not previouslyapa proved by the County. the parking provided no longer meets the
minimum required on the previously approved site plan (SDP2004-10) and its LORs. Either a Zoning Clearance
or a Letter of Revision (LOR) is required before the road plan is approved since improvements are shown within
T IP 45-112F. Follow one of the following sets of steps (a or b) and see the additional information below:
a) Zoning Clearance METHOD (order of steps):
1) Owner of the TMP 45-112F requests and receives a zoning clearance, based on a reduction of
employees and/or students, to reduce the number of parking spaces required in SDP2004-10.
2) Owner of the TMP 45-112F provides official approval for all work within that parcel that is proposed
in SDP2020-42 & SUB2020-4.
3) Road Plan is approved.
4) Subdivision plat (including required easements) is approved.
5) Site plan is approved.
6) A letter will be out in the SDP2004-10 Project Folder, and on County View, that documents the
Zoning Clearance and the changes to the lot layout shown in the approved Berkmar Overlook site
plan.
b) LOR METHOD (order of steps):
1) Submit and get approved a LOR for SDP2004-10 that shows all of the changes proposed to the site
and also meets all parking and dumpster regulation.
2) Owner of the TNIP 45-112F provides official approval for all work within that parcel that is proposed
in SDP2020-42 & SUB2020-4.
3) Road Plan is approved.
4) Subdivision plat (including required easements) is approved.
5) Site plan is approved.
c) Additional revisions to the Berkmar Overlook site plan and road plan are required within T IP 45-112F for
both of the methods above. They include:
1) Show the dumpster.
2) Show a proposed dumpster enclosure, enclosure detail and screening.
3) Ensure all requirements for the dumpster and dumpster pad are met. The dumpster and dumpster pad
have not been approved by the County and therefore must be fully reviewed.
4) If utilizing the "LOR METHOD" revise the layout to provide the required number of parking spaces
previously calculated on SDP2004-10. Also, update the parking provided note on the site plan to be
accurate.
d) The approved site plan (SDP2004-10) and its LORs will be included attached.
