I am going through my files and I realized that this site plan was never resubmitted for final signatures and approval. I
know that you and the folks with UVA worked with Michael Dellinger and Amelia McCulley to work out the CO issue
back in March, but I wasn't CC'd on all of the correspondence. My understanding is that they granted a CO and the
building is open, correct?
The easement plat, SUB202000029, was approved back on April 23, 2020. Getting those easements recorded and
adding the information to the site plan as the last remaining comment. Are you planning to submit hard copies for
signature and approval?

After Lisa and Cameron met and reviewed the status of the project, it appears that the major amendments to your site
plan have not been approved therefore I am unable to issue a temporary certificate of occupancy today. I have
conveyed this information onto our Deputy Director Amelia McCulley as well.
Please refer back to the document dated January 24, 2020 for details on what needs to be completed. Also, your
compliance officer Ashlee is awaiting the final physical survey as well.

We received print copies of WPO201700014, Amendment 1, weeks ago, and I felt all that was needed was to stamp the plans
approved, but just noticed text on the title sheet, and in the margin of every plan sheet, that cannot display on a VSMP /WPO
plan. Please revise title sheet and every sheet of the VSMP Amendment. Please remove reference to SDP2016-00051 in the
WPO plan title. Please delete entire line `Major Site Plan Amendment to SDP2016-00051'. Similarly, please revise margin
text (every plan sheet) to read VSMP /WPO Plan Amendment, rather than Major Site Plan Amendment. Engineering is
prepared to approve WPO201700014, Amendment 1, but title sheet /plan sheet references to Major Site Plan Amendment are
impermissible. A related Major Site Plan Amendment corresponding with WPO201700014 is under review. Planning Division
most recent comment on SDP201900028 (CV comment) reads, `See comment letter uploaded to Laserfiche dated 2-18-2020 for
Planning Division third review comments.' Most recent Engineering review comment on SDP201900028: `No
objection.' Please revise all sheets, then re -submit four (4) full-size copies of the VSMP plan (please ensure PE -seal is signed

After Lisa and Cameron met and reviewed the status of the project, it appears that the major amendments to your site
plan have not been approved therefore I am unable to issue a temporary certificate of occupancy today. I have
conveyed this information onto our Deputy Director Amelia McCulley as well.
Please refer back to the document dated January 24, 2020 for details on what needs to be completed. Also, your
compliance officer Ashlee is awaiting the final physical survey as well.

Construction, asked that we contact you about the plans for the dumpster pad with screening wall and

Eric,
Thank you for the email.
I was onsite once again today with a coworker checking on the status of the project. It looks good and close to being
done, however, I need the Physical Survey (as -built) before I can approve Final Zoning. I never meant to give the
impression that I could approve without it.
I did say that I would inspect the site using the site plan submitted under review. This is the site plan that you are
building to, making it the only one I would use. This was not a problem with me and is what I have been doing every
time I inspected.
As for a TCO, this is not something Zoning can issue. This is issued by the Building Department ONLY. I tried to make that
clear on January 23, 2020 requesting that questions about CO's should be directed to Michael Dellinger (Building
Official). I can approve everything in Zoning, but I have no authorization to override or approve a Building Inspection. I
am the LAST inspection once all other inspections are final. There will be not be an issuance of a TCO if all Building
Permits are not approved. Scott has spent many hours onsite trying to remedy these issues with you all, but there are
several outstanding issues onsite leading to rejections of several inspections. I am in no way a person of any kind of
authority on this. I am only the Zoning Inspector.
The Building Department and Zoning will do whatever we can to help finalize this project, but I cannot approve Final
Zoning until the other issues are resolved. I apologize for any inconvenience this causes. We are all aware that you all
have a deadline and are spending a lot of time on this project to reach completion.
Unfortunately, I am out of the office tomorrow (3/6/20) for an appointment that was scheduled for a Workers
Compensation claim. I will address all emails, phone calls, questions, etc. upon my return on Monday (3/9/20).

I wanted to touch base today to provide an update on the status of the Town Center 4 site plan and how that may
impact the Contractor's pursuit of their TCO. To date, we have received tentative approval of the revised site plan for
the project. This was confirmed via email with Cameron on 2/14/2020. At this point we are awaiting approval and
recordation of the revised easement plats before the site plan can be officially approved.
Our understanding is that the easement plats were submitted by the surveyor a couple of weeks ago for
review/approval and review comments are due 3/20/2020. Cameron, can you please confirm if this in correct?
Today we received a forwarded email chain from the GC and originating from Jonney Otto, suggesting that the TCO may
be held up due to two outstanding tasks.
1. The recordation of the site easement plat.
2. The completion of a site as -built survey.
I would like to bring everyone onto the same page and share our meeting minutes with County staff on
1/23/2020. These meeting minutes were distributed and approved by each person that was in attendance. Please
direct your attention to items 46, #7, #9 and 412. These talking points are directly related to the two tasks cited
above. Our understanding is that the timing of the completion of these tasks would not impact the pursuit of the
building TCO.
If there are any questions or comments about the timing of the remaining tasks outstanding for the project, please let us
know as soon as you can. Thank you all for your efforts in shepherding this project forward.

We've been working with Jeff Baker to assist the GC on the Town Center 4 project for building permits. Today we were
discussing the zoning inspection that will be coming up in a few weeks. Jeff guesstimated that you would probably be
the zoning inspector for this project. This project is a little bit unique because we have an approved site plan; however,
we've made some changes to the site design so we're also in the middle of an amendment review. Our hope is that the
revised site plan will be approved before the GC "catches up to us" with construction. Our County planner is Cameron
Langille.
We would like to schedule a meeting with you, at your convenience, to walk you through both sets of plans. Our hope is
that we can assist you with the differences in the plans, in order to help with your inspections. The GC is working very
hard to deliver the building to the UVA Foundation on time, so we're trying to help facilitate their certificate of
occupancy. If you have a couple of time periods when you can meet, please let me know and we'll set a time. Thank

I met this morning and have good news.
The site plan may be reviewed under the last zoning approval for the property. That means that the previous
approval to disturb slopes remains valid. The disturbance of slopes over 25% that were created as a result of
grading activity may occur with no additional discretionary review.
The long and short of this is — The grading you are proposed may be approved once all the WPO and site plan
issues are resolved. There is no critical slope or steep slope issue.

As a follow-up to the conversation we had a week ago, I have attached the cover sheet and critical slope exhibit from a
site plan that was approved in 2007 for the UVA Foundation. The plan was for Town Centers 3 and 4 at the UVA
Research Park. A minor amendment was also approved for a phasing plan that separated Town Centers 3 and 4. Town
Center 3 has been built and Town Center 4 has not yet been constructed. We would like to confirm a couple of things:
1. Would you please confirm that this site plan (SDP 2006-113) is still valid?
The plan was approved May 4, 2007. Therefore, it was valid on January 1, 2Oo9 and on January 1, 2011
due to the language in the attached links. http://lis.virginia.gov/cgi-

httn://law.lis.yiryinia.goy/vacode/titlel..ri.2/chal)ter22/sectionlri.2-2209.1/ and it will remain valid
until July 1, 2017.
2. Would you also confirm if the critical slope waiver that is associated with the site plan is still valid?
The critical slope waiver is a component of the site plan that remains valid as long as the site plan is
valid.
3. If the critical slopes waiver is still valid, would you also confirm that an amendment to this site plan could
disturb the "preserved" slopes in a similar fashion as the previously approved plan?

It may not be disturbed in a "similar fashion". The language of the ordinance 30.7.4 states:
30.7.4 PERMITTED USES The following uses and structures are permitted by right or by special use permit on
managed or preserved slopes, provided that the land disturbing activity to establish the use or structure
complies with design standards in section 30.7.5 and all other applicable requirements of the Code:
b. Preserved slopes. The uses permitted by right and by special use permit on preserved slopes are as follows,
subject to the applicable requirements of this chapter:
1. By right. The uses permitted by right on preserved slopes are the following:
g. Legislative zoning actions related to the underlying district. Any use or structure approved by the
board of supervisors in a zoning map amendment whose location is expressly authorized in an
approved application plan, code of development, or an accepted proffer, in a special use permit
authorized in the underlying district regulations, or in a special exception authorizing a waiver or
modification of the requirements of section 4.2.3; provided that the legislative action is still valid
and that the use or structure complies with all requirements and conditions approved or imposed in
conjunction with the legislative zoning action.
The disturbance will have to meet the design standards in section 30.7.5 and any conditions imposed
with the original approval (I do not know if any were imposed.) The area of disturbance cannot be
expanded beyond the area shown to be disturbed when the waiver was granted.

reductions we have approved with the determination letters and the submittals. The first,
Commonwealth Senior Living, is a great example of what I think is a sufficient number of site data points
(174 data point at various times of the day) that are the basis for approved reduction. The second, The
Vistas, uses transportation alternatives such as transit, inclusion of bike facilities, bike/ped
infrastructure, etc. as the basis of their argument. Ultimately, for a parking reduction to be approved
there needs to be clear evidence either through data or other site characteristics, like in these examples,
that prove your site will still have adequate parking given the reduction. Section 4.12.2(c) of the code
further addresses reduction requests, and 4.12.8-4.12.12 provides alternatives that could be used to
justify the reduction.

Hello Cameron,
I wanted to update you on a few items regarding changes to the Town Center 4 site plan.
Last Thursday (2/28), we had our regular recurring monthly meeting with ACDD. Tim Padalino
coordinates these with me. My apologies if the invite wasn't shared with you or perhaps you were
unable to attend. We discussed both with Planning (Andrew, Tim) and Zoning (Lea), an approach to
justifying our reduction in number of parking spaces with a revision to the TC4 and TC1 parking lots that
moves the pedestrian path to a preferred alignment and adds more greenspace to the parking lot. The
approach discussed, which would be compiled into the major site plan amendment submission,
includes:
* Doing a parking count of the existing parking lots to show how they are used and how many empty
spaces there are. I have taken photos and did a count on Tuesday 3/5 around 9:30am and plan to do
another round of photos/count today at 3pm.
* Writing a narrative describing the shuttle route/usage, the connection to multiuse trails (Berkmar,
etc.), and the uses in the TC4 building (i.e. first floor is all common spaces for park tenants and guests -
fitness, conference space, large lobby, coffee bar, etc. so less spots required than would be suggested by
the square footage on Floor 1).
* Providing a "ghosted" or shaded areas on the new parking lot exhibit where future expansion of the
parking lot could be done to build more parking spaces should we find they are needed once the
building is up and running
Additionally, we have decided to leave the leased areas/easements for the town centers as is. Eric can
provide more information, but I believe that the changes to curbing, etc. that we were trying to achieve
between TC3 and TC4 will not be happening, so the frontage will remain the same and easements will
be left as is.
Todd and Eric, please chime in if I left out any details. I just wanted to make sure you were brought up to
speed on all of this, Cameron. Please feel to reach out to any of us with further comments or questions.

applicants ever send a parking reduction justification to you for review? I am working on my review comments right
now and they are proposing a reduction as stated in notes on the actual drawings, but there is no written justification
statement or anything provided in the file.
I have copies of the site plan that I can give to both of you to look at and write up any initial thoughts you may have. I
am going to write a placeholder comment stating that they need to provide a written justification for the proposed
reduction, which will be forwarded to the Zoning Division for review.

Just following up after the discussion we had on the phone. I think what you have listed in your previous email will be
sufficient for your parking reduction request. I am attaching a couple examples of parking reductions we have approved
with the determination letters and the submittals. The first, Commonwealth Senior Living, is a great example of what I
think is a sufficient number of site data points (174 data point at various times of the day) that are the basis for
approved reduction. The second, The Vistas, uses transportation alternatives such as transit, inclusion of bike facilities,
bike/ped infrastructure, etc. as the basis of their argument. Ultimately, for a parking reduction to be approved there
needs to be clear evidence either through data or other site characteristics, like in these examples, that prove your site
will still have adequate parking given the reduction. Section 4.12.2(c) of the code further addresses reduction requests,
and 4.12.8-4.12.12 provides alternatives that could be used to justify the reduction.

1. Subdivision containing attached dwelling units or non-residential uses. The proposed private street(s) would be in a
subdivision containing attached dwelling units or non-residential uses where the units, groups of units, or non-
residential uses are to be located on individual lots.
So with that in mind, a private street authorization request needs to be prepared and submitted pursuant to Subdivision
Ordinance Sections 14-233.B.1 ("When private streets in development areas may be authorized.") and 14-234
("Procedure to authorize private street and related matters.").

Bart & I met today to discuss the remaining questions from the TC3/TC4 preapp meeting back in January.
• For the building appurtenance height extending beyond the maximum permitted structure height — can you
send us a profile view sketch that shows the proposed height of the building, and then the height of the feature
that will extend beyond the maximum permitted building height? Bart will take a look and let you know if we
can allow it.
• For the parking reduction —you will need to submit a written justification with the major amendment explaining
how utilization of the future transit can justify approval of the reduction. Zoning cannot give a definitive yes or
no at this point without seeing a proposed site drawing with the amount of proposed parking visible across each
affected parcel. This is just something that will have to be evaluated during the plan review process.
I have some good news about the question related to whether the TO parcel needs frontage on a public street in order
to be a conforming lot according to the PDIP zoning district standards. I previously sent an email stating that the TO
parcel needs to have some sort of parcel boundary frontage along either a public or private street. This was partially
incorrect, and I have verified the following with my colleagues in the Zoning Division:
• There is no minimum frontage requirement for any parcel in the PDIP Zoning District.
The existing private street easement that goes over the segment of Research Park BLVD between the
TO and TC4 parcels can be vacated and is not needed to provide frontage to TO as originally thought.
This means that the street can be converted from a vehicular street to a pedestrian plaza as desired.
o The only caveat is that the existing private street easement must still touch the northwest
corner of the TO parcel. This will ensure that the TO parcel touches a street right of way and
the lot will still be a conforming parcel of record under the Zoning ordinance. The existing cul-
de-sac turnaround at the end of Research Park BLVD can be removed. But a similar cul-de-sac

must be installed at the intersection of Research Park BLVD where the property corners of all
four TC parcels currently meet.
I hope this information clears up all the remaining questions from the preapp. Please do not hesitate to ask any follow-
up questions you may have!

We did meet with Frank about the road section and we are continuing to work through that issue. We were awaiting a
response about the question of if we could remove the access easement on the boulevard or if it must stay for road
frontage. Alternatively, we asked if the length of the easement could be shortened to a minimal length. We asked for

confirmation about the building appurtenant height and also about our strategy for reducing parking requirements
based on the launch of the full-time shuttle bus. We assumed that a Major amendment would likely be required, but I
don't think we received the official determination about that.

According to my notes, the outcome was that the big remaining question was if our Engineering Division would approve
different construction/surface materials for the converted pedestrian street between buildings 3 and 4. Did you meet
with Frank Pohl two weeks ago about this? He mentioned that you had a follow-up meeting scheduled with him
specifically. I'd have to defer to Frank on what kinds of surface materials are appropriate and whether the converted
street meets the County's design standards manual.
From a Zoning and Planning standpoint, the last question was whether the Town Center 3 parcel would still meet road
frontage requirements and be a legal/conforming parcel under our Zoning Ordinance if the street between buildings 3
and 4 gets converted to the proposed pedestrian street. Bart Svoboda will be the ones to answer that question. I have

I'd be glad to schedule a meeting to discuss the proposed amendment. I have a few questions first:
1. Are you proposing to alter any of the ACSA utilities that were shown on SDP201600051? [Eric Woolley] Yes, the
ACSA plan would change slightly. The plan would generally conform to the current approved plan, but the
locations of the proposed water piping would shift to accommodate the internal road network changes.
2. Will the driveway entrance onto Lewis and Clark Drive be moved (in which case we need VDOT)? [Eric Woolley]
No, the entrance itself onto the public right-of-way would not change. We may be shifting the centerline of that
private road internal to the parcel. We are considering the addition of new trees/landscape inside the right-of-
way of Lewis and Clark Drive. We are not anticipating any change to existing curbing, but we may potentially
add trees/landscape, signage and enhanced cross walk definition.
3. How significant will the changes to the parking circulation and travel ways and internal private street network be
affected? Fire & Rescue may want to weigh in on those itmes for emergency access purposes. If you have a
sketch drawing of the changes to the circulation, please send it to me so I can better determine whether Fire
Rescue needs to attend the meeting.[Eric Woolley] I believe the changes would warrant the feedback of the fire
marshal's office. We are refining a sketch plan for circulation, and we will send that over next week.
Due to all of the holidays this month, there is only one Monday left for preapp meetings in December (December 17tn)
checked with my colleague who manages preapp scheduling and the December 17t' date is already filled with other
meetings. So we have two options:
• Schedule an official preapp on Monday, January 7t'. We will need to do this if Fire Rescue, VDOT, and/or ACSA
need to attend the meeting, per my previous questions.
• Try to find another meeting time during the week of December 17-201h that works for you and staff.

As you may know, we are well into construction of the Town Center 4 project at the UVA Research Park. The UVA
Foundation is currently considering making a few changes to the site layout for that approved site plan. They are
studying the potential to amend some of the internal private streetscapes of the Town Center to allow for enhanced
pedestrian connectivity. As part of this amendment, they are also looking at the potential to add more parking lot
landscape and less parking spaces. A key component of their justification for reduced parking would be due to the
successful launch and implementation of their daily shuttle that runs to/from the University throughout the day.

We would like to request a meeting with County staff to outline the goals of this amendment proposal and to discuss
impacts and considerations to a site plan amendment. We realize that the parking revision will require consideration
from the zoning department, so we would like to request their attendance as well. If you could let us know a couple of
