My understanding is that they granted a CO and the building is open, correct? The easement plat, SUB202000029, was approved back on April 23, 2020. Getting those easements recorded and adding the information to the site plan as the last remaining comment. Are you planning to submit hard copies for signature and approval? I was onsite once again today with a coworker checking on the status of the project. It looks good and close to being done, however, I need the Physical Survey (as -built) before I can approve Final Zoning. I never meant to give the impression that I could approve without it. I did say that I would inspect the site using the site plan submitted under review. This is the site plan that you are building to, making it the only one I would use. This was not a problem with me and is what I have been doing every time I inspected. As for a TCO, this is not something Zoning can issue. This is issued by the Building Department ONLY. I tried to make that clear on January 23, 2020 requesting that questions about CO's should be directed to Michael Dellinger (Building Official). I can approve everything in Zoning, but I have no authorization to override or approve a Building Inspection. I am the LAST inspection once all other inspections are final. There will be not be an issuance of a TCO if all Building Permits are not approved. Scott has spent many hours onsite trying to remedy these issues with you all, but there are several outstanding issues onsite leading to rejections of several inspections. I am in no way a person of any kind of authority on this. I am only the Zoning Inspector. The Building Department and Zoning will do whatever we can to help finalize this project, but I cannot approve Final Zoning until the other issues are resolved. I apologize for any inconvenience this causes. We are all aware that you all have a deadline and are spending a lot of time on this project to reach completion. Unfortunately, I am out of the office tomorrow (3/6/20) for an appointment that was scheduled for a Workers Compensation claim. The recordation of the site easement plat. 2. The completion of a site as -built survey. These meeting minutes were distributed and approved by each person that was in attendance. Please direct your attention to items 46, #7, #9 and 412. Today we were discussing the zoning inspection that will be coming up in a few weeks. Jeff guesstimated that you would probably be the zoning inspector for this project. This project is a little bit unique because we have an approved site plan; however, we've made some changes to the site design so we're also in the middle of an amendment review. Our hope is that the revised site plan will be approved before the GC "catches up to us" with construction. Our County planner is Cameron Langille. We would like to schedule a meeting with you, at your convenience, to walk you through both sets of plans. Our hope is that we can assist you with the differences in the plans, in order to help with your inspections. The GC is working very hard to deliver the building to the UVA Foundation on time, so we're trying to help facilitate their certificate of occupancy. Town Center 3 has been built and Town Center 4 has not yet been constructed. We would like to confirm a couple of things: 1. Would you please confirm that this site plan (SDP 2006-113) is still valid? The plan was approved May 4, 2007. Preserved slopes. The uses permitted by right and by special use permit on preserved slopes are as follows, subject to the applicable requirements of this chapter: 1. By right. The uses permitted by right on preserved slopes are the following: g. Legislative zoning actions related to the underlying district. Any use or structure approved by the board of supervisors in a zoning map amendment whose location is expressly authorized in an approved application plan, code of development, or an accepted proffer, in a special use permit authorized in the underlying district regulations, or in a special exception authorizing a waiver or modification of the requirements of section 4.2.3; provided that the legislative action is still valid and that the use or structure complies with all requirements and conditions approved or imposed in conjunction with the legislative zoning action. I have taken photos and did a count on Tuesday 3/5 around 9:30am and plan to do another round of photos/count today at 3pm. * Writing a narrative describing the shuttle route/usage, the connection to multiuse trails (Berkmar, etc.), and the uses in the TC4 building (i.e. first floor is all common spaces for park tenants and guests - fitness, conference space, large lobby, coffee bar, etc. so less spots required than would be suggested by the square footage on Floor 1). * Providing a "ghosted" or shaded areas on the new parking lot exhibit where future expansion of the parking lot could be done to build more parking spaces should we find they are needed once the building is up and running Additionally, we have decided to leave the leased areas/easements for the town centers as is. Eric can provide more information, but I believe that the changes to curbing, etc. that we were trying to achieve between TC3 and TC4 will not be happening, so the frontage will remain the same and easements will be left as is. Bart will take a look and let you know if we can allow it. • For the parking reduction —you will need to submit a written justification with the major amendment explaining how utilization of the future transit can justify approval of the reduction. Zoning cannot give a definitive yes or no at this point without seeing a proposed site drawing with the amount of proposed parking visible across each affected parcel. This is just something that will have to be evaluated during the plan review process. I have some good news about the question related to whether the TO parcel needs frontage on a public street in order to be a conforming lot according to the PDIP zoning district standards. I previously sent an email stating that the TO parcel needs to have some sort of parcel boundary frontage along either a public or private street. This was partially incorrect, and I have verified the following with my colleagues in the Zoning Division: • There is no minimum frontage requirement for any parcel in the PDIP Zoning District. The existing private street easement that goes over the segment of Research Park BLVD between the TO and TC4 parcels can be vacated and is not needed to provide frontage to TO as originally thought. This means that the street can be converted from a vehicular street to a pedestrian plaza as desired. o The only caveat is that the existing private street easement must still touch the northwest corner of the TO parcel. This will ensure that the TO parcel touches a street right of way and the lot will still be a conforming parcel of record under the Zoning ordinance. The existing cul- de-sac turnaround at the end of Research Park BLVD can be removed. But a similar cul-de-sac 133 must be installed at the intersection of Research Park BLVD where the property corners of all four TC parcels currently meet. We were awaiting a response about the question of if we could remove the access easement on the boulevard or if it must stay for road frontage. Alternatively, we asked if the length of the easement could be shortened to a minimal length. We asked for 134 confirmation about the building appurtenant height and also about our strategy for reducing parking requirements based on the launch of the full-time shuttle bus. We assumed that a Major amendment would likely be required, but I don't think we received the official determination about that. Did you meet with Frank Pohl two weeks ago about this? He mentioned that you had a follow-up meeting scheduled with him specifically. I'd have to defer to Frank on what kinds of surface materials are appropriate and whether the converted street meets the County's design standards manual. From a Zoning and Planning standpoint, the last question was whether the Town Center 3 parcel would still meet road frontage requirements and be a legal/conforming parcel under our Zoning Ordinance if the street between buildings 3 and 4 gets converted to the proposed pedestrian street. Bart Svoboda will be the ones to answer that question. The plan would generally conform to the current approved plan, but the locations of the proposed water piping would shift to accommodate the internal road network changes. 2. Will the driveway entrance onto Lewis and Clark Drive be moved (in which case we need VDOT)? [Eric Woolley] No, the entrance itself onto the public right-of-way would not change. We may be shifting the centerline of that private road internal to the parcel. We are considering the addition of new trees/landscape inside the right-of- way of Lewis and Clark Drive. We are not anticipating any change to existing curbing, but we may potentially add trees/landscape, signage and enhanced cross walk definition. 3. How significant will the changes to the parking circulation and travel ways and internal private street network be affected? Fire & Rescue may want to weigh in on those itmes for emergency access purposes. The UVA Foundation is currently considering making a few changes to the site layout for that approved site plan. They are studying the potential to amend some of the internal private streetscapes of the Town Center to allow for enhanced pedestrian connectivity. As part of this amendment, they are also looking at the potential to add more parking lot landscape and less parking spaces. A key component of their justification for reduced parking would be due to the successful launch and implementation of their daily shuttle that runs to/from the University throughout the day. 137 We would like to request a meeting with County staff to outline the goals of this amendment proposal and to discuss impacts and considerations to a site plan amendment. We realize that the parking revision will require consideration from the zoning department, so we would like to request their attendance as well.
