HomeMy WebLinkAboutSUB202000165 Review Comments Final Plat 2020-12-02z County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 434-296-5832 Memorandum To: David Nichols From: Christopher Perez, Senior Planner Division: Planning Date: December 2, 2020 Subject: SUB2020-165 Sleep Number Charlottesville - Right of way dedication plat and easements The County of Albemarle Planning Division will grant or recommend approval of the Easement Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-303(E)] Provide the easement holder(s) on the plat. Rev 2. Please fill in the recordation information for these easements once recorded. Based on vour email from 12-1-20 if the order of approval and recordation is chancinc and certain easements will be existinc, revise the plat to provide recordation information on the Dlat for these easements. I do not need to re -review if these are the only chances. 2. [14-302(A)14, 14-4281 Land to be dedicated in fee. On the plat provide the following note for the right- of-way dedication: " ' Wide Public Right-of-way Area Hereby Dedicated to the County of Albemarle for Public Use. " Rev 1. Per VDOT review this comment is no longer applicable, they have stated it needs to be dedicated to the State. Please work with VDOT to get the correct languace for the dedication. 3. [ZMA2019-14, SDP2020-541 During recent conversations with VDOT about SDP2020-54 and the shared use path along the frontage of the property they stated the applicant will need the following in the right-of-way: the face of curb, 8 ft. buffer strip, 14 ft. shared use path, 3 ft. clear zone, right of way line. VDOT full review comments forthcoming; however, this modification to the site plan will require additional right-of-way to be dedicated. Please work with Scott Collins on this item prior to revising and resubmitting the plat. Rev 1. Comment addressed. 4. [14-302(A)14, 14-428] Prior to final plat approval VDOT shall approve the plat. The plat has been sent to VDOT. Comments to be forwarded once received. Rev 2. VDOT and the applicant have been working back and forth through email to move closer to a VDOT approval. See attached emails from Adam and Willis. An approval from VDOT has not been received yet. 5. [Comment] Prior to final plat approval Engineering and ACSA shall approve the plat. The plat has been sent to the various reviewers. Comments to be forwarded once received. Rev 2. See attached SWM Deed of Dedication and Easement which needs to be completed and sinned and sent back to staff with the final Dlat. VDOT aDDroval has not been granted. ACSA has no objections. Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer. Someone there should be able to give you guidance on who is the current owner. I'll reach out to our District right of way manager and discuss this matter, on how to proceed if you can't find current ownership. Our client's attorney, Ben Gordon (see email below), and the title company are having trouble locating the owner of this easement. Do you have any experience with these types of easements and/or do you know who could sign -off on the quit claim? If we cannot find the owner, how can we proceed with resolving this issue? I am following up with them on that since I agree with you that they would be the likeliest to know who that party is. At the same time, can you (or whoever is interfacing with VDOT) at least ask VDOT or the county if they have any information?
