Boyd & Sipe, PLC 126 Garrett St., Suite A Charlottesville VA 22901 RE: SP202000002 MonU Park Mr. Sipe -- Thank you for the recent resubmittal for this special use permit amendment. Please find review comments for the application included in this letter. Review Comments Planning (Scott Clark) Further plan resubmittals are not needed at this point. However, two issues remain unresolved: o The previous transportation -planning comment regarding dedication of a pedestrian/trail right-of-way was not addressed in the resubmittal because "... MonU simply leases the property and is not in a position to advocate for any dedication of right-of-way by the property owner." Please note that the special use permit amendment would not be issued for the duration of MonU's lease, but runs with the land permanently and would be available to any future user. Also, the owner is a party to this application. This issue remains and needs to be resolved. We can discuss this further while staff are drafting recommended conditions of approval and scheduling this item for Planning Commission consideration. o The resubmittal did not commit to a condition requiring warning signage for dam -breach and flooding hazards, as recommended by RWSA. Staff will recommend the signage requirement in accord with RWSA's request. The applicants can make their case regarding this signage to the Planning Commission and Board of Supervisors.
