From: Paty Saternye - Senior Planner Division: Planning Services Date: April 6, 2020 Rev. 1: December 3, 2020 Subject: SUB-2020-34 Joan C Meredith — Family Subdivision The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] Note: 2nd submission of the plat changed it from a Family Subdivision to a Boundary Line Adjustment (BLA). The comments below are the first round of comments for the BLA. Also, comments have been revised based upon LOD2020-8 (June 9, 2020). Therefore, comments numbers 1, 2, 3, 4,12, 13 & 14 have been removed since they are no longer necessary. 5. [14-302(A)(6) & 14-303(E)] General Information; Dimension standards and information on all lots, streets, alleys, easements, and shared driveways. Label the 50' ingress egress easement as a "shared driveway easement". Rev. 1: Comment not vet addressed. Address the comment. 6. [14-302(A)(10)] Right of further division of proposed lots. Address the following: a. Revise note 7 to state "may" and not "my" in the "Parcel 1 is assigned 1 development right and my not be further divided." b. The documentation provided by the applicant shows that TMP 91-24 was historically two lots (DB 139-33). Although the Development Rights (DR) specified in note 7 are correct based on the 1980 parcel boundaries, because it was historically two parcels the applicant could request an official letter of Determination of Parcels and Development Rights to determine whether additional DR are available. Rev. 1: Comment not vet fully addressed. LOD2020-8 determined that Lot 1 (Residue) (Now "TMP 93-24C1") has 5 Development Rights (DR) and Lot 2 (Now LOD202000008 — Official Determination of Parcel of Record and Development Rights dated June 9, 2020. b) Divide the second sentence into two sentences and revise the development rights statements to specify that: i. "TMP 93-24CI is retaining 5 development rights and may be further divided, and when divided it shall not consist of more than 8.88 acres." ii. "TMP 93-24C2 is retaining 4 development rights and may be further divided, and when divided it shall not consist of more than 6.06 acres." c) Add an additional sentence that states, "No development rights are being transferred with Parcel A". If for any reason that area designation changes on the plat, ensure to also change it in this note. d) If there are any questions about these values, please discuss them with the planning reviewer prior to resubmittal. 7. [14-302(B)(1)] General Information. Address the following: a) Revise the plat to include a revision date prior to the next submission. Rev. 1: Comment not vet fully addressed. Address the comment on the next submission. 8. [14-302(B)(6)] Tax Map and parcel number. Revise the parcel number for TMP 93-24B. It is shown as TMP93A-24B on the plat. Rev. 1: Comment not vet addressed. Address the comment. 9. [14-302(B)(8)] Yards. Address the following: a) Label the Rear Setback line for Parcel 1. b) Show and label the setback lines for the subject parcel. a) Revise the Front Setback (Yard) for TMP 93-24C2 (previously Lot 2) to show a 75' Front Setback since that parcel has frontage (although quite J] 24A, to state "25"' and not "35"'. 35' should only be shown on rear setback lines. 10. [14-303(A) & (D)] Statement of consent to division; Acreage of lots. Revise the statement of consent to division to specify the proposed lots as they are labeled on the plat. The statement currently refers to "Lots A & B". Rev. 1: Comment not vet fullv addressed. Address the following: a) See comments about using the Tax Map Parcel numbers currently shorn under the owner's name show the current TMP #s and not "Lots 1 & 2". b) Revise the acreage of "Parcel A" from 0.98 Ac. To 0.94 Ac. In order to match the values shown in the area summary and on Sheet 2. 11. [14-302(A)(5) & 14-303(L)] Public Easements; Public utility, drainage and sight distance easements. Revise plat to include all references to existing utility, drainage and sight distance easements. If they cannot be shown on the plat, then list the Deed Book Page number and owner of the easement in the notes on the coversheet. Rev. 1: Comment not vet addressed. Address the comment. 15. [Comment] In order to address comment #3 from engineering a letter from the owner will be required to be written, signed, and forwarded to the lead reviewer with the resubmission. Rev. 1: Comment #3 from engineering was withdrawn. 2 16. [Comment] Attached please find the comments from the other reviewers. Zoning and the County Attorney's office comments have been integrated into the planning comments. Rev. 1: Comment addressed. Other reviewers have "no objection" 17. Rev. 1: New Comment [14-302(B)(6), 14-303(B) & (F)l Tax Map and Parcel 18. a) See the attached GIS exhibit showing the parcels after the recent update to incorporate the parcels specified for LOD2020-8. Label all of the existing parcels with the Tax Map Parcels shown in the exhibit. This includes: i. TMP 93-24B (currently labeled as TMP 93A-23B) ii. TMP 93-24C1 (currently labeled as Lot 1) iii. TMP 93-24C2 (currently labeled as Lot 2) b) Revise the Lot labels to be appropriate for a BLA and correct. Address the following: i. Remove "RESIDUE" from the Lot 1 label. ii. "Lot 1" and "Lot 2" designations are no longer needed since they are existing parcels and have their own TMP numbers. So, these labels should be removed and replaced with the TMP#s specified in the main parcel labels as well as all of the other text, labels, and "Title Source" area on the plat (ex. along the existing dashed to the TMP#s in all notes, data, and owner approvals on the cover sheet. parcel lines be represented to show that the street frontage for any of the parcel a) Revise all references on both sheets to DB 138 PG 33, this appears to be a typo.
