The proposed 2 lot subdivision shown on this final plat (SUB202000196, dated September 21, 2020) is not permissible because this property is located in the Hatton Agricultural Forestal District. Subdivisions creating lots of less than 21 acres are not permitted in Agricultural Forestal Districts, except as family subdivisions. See the district's prohibition on development to a more intensive use in §3-202(A), and the list of exceptions to that prohibition in §3-202(A)(3). If in the future the property is removed from the Agricultural Forestal District the division may be eligible to move forward but must address the following required revisions. 1. 114-207, 14-232(B)2, 14-2061 The plat was incorrectly submi , Noes not meet the minimum requirements for atwo-lot subdivision as described in Section 14-232(B)2 o d all lots front on an existing public street. Because of the required private street request described bel4Wliftubdivision shall be submitted as a preliminary subdivision plat under Section 14-206. The plat shall elNuirements of Section 14-206 and 14-302, and shall be reviewed by the site review committee submit a new application, review fees, and revised plat. 2. 114-232, 14-234(C), 14-233,14-234, 14- n private streets in rural areas may be authorized. The proposed private street will serve 5 Ices p -6B, TMP 136-9D, TMP 136-9D1, TMP 136-9E, and Lot A). This requires Planning Commission a ❑ of the private street. Please submit a private street request as provided in Section 14-234 and Se olk 14W32. Additionally, when you revise the plat ensure the ownership information and signature autho ' f each of the above referenced parcels are added to the plat for approval as they must each sign the plat to pe it the placement of the private street on their property. 3. 114-412(A)2, 14-4121 Streets serving three to five lots. The private street is required to meet the standards of Section 14-412(A)2 and Section 14-410. Prior to final plat approval a road plan is required to be approved by the County to ensure the road meets these standards. The road plan shall be submitted with the private street request for staff to review to ensure the requirements are met. 4. 114-305, 14-311, 14-417, 17-300 and 17-3021 If the construction and upgrades of the private street requires 10,000 SF of land disturbance or more then a WPO plan will be required. Revise the plat to list the required disturbance to construct or upgrade the private street. 5. 114-303(R)l Parentparcel access. Provide the following note: "All subsequent divisions of the residue shall enter only onto such street(s) shown on the approved final plat and shall have no immediate access onto to arty public street. " 6. 114-308.11 Groundwater Assessment Prior to final subdivision plat approval a Tier II groundwater study is required. Please submit the $355 review fee and staff will conduct the groundwater study. 7. 114-302(B)101 Stream Buffers. Depict and label the stream buffer around the pond. 8. 114-302(A)121 Topography. On the preliminary plat provide the existing topography at the time of plat submittal at up to twenty [20] percent slope, with a contour interval that is not greater than the interval on aerial topography available from the county. Provide the source of topography, including survey date and name of the licensed professional; or a statement that topography data provided by the county was used Proposed grading, with a contour interval equal to the intervals of the existing topography, supplemented where necessary by spot elevations, areas of the site where existing slopes are steep slopes. Provide existing topography for the entire site with sufficient offsite topography to describe prominent and pertinent offsite features and physical characteristics, but in no case less than fifty (50) feet outside of the site unless otherwise approved by the agent. For property in the rural areas zoning district, the proposed grading shall show all grading on each proposed lot, including access, clearing and all other lot improvements. 9. [14-303(S)] Control Points. Provide at least 4 control points, evenly distributed across the property and located at survey property comers. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than the original signed/notarized version for recordation. 10. [14-303(N)] Provide the following note related to the private street: "The streets in this subdivision may not meet the standards for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of Transportation or the County of Albemarle. " 11. 114-3161 Approval of entrance onto public streets. Submit evidence that the entrance of the principal means of access for each lot onto the existing public street complies with Virginia Department of Transportation standards. 12. 114-309 & 14-3101 Soil evaluations; Health Director Approval ofwells and septic systems. Each lot shall be provided a primary and reserve drainfreld location approved by Department is required before the plat can be approved. Please to the Health Department for their review. A. 13. 114-235, 14-3171 Instrument evidencing nu agreement for County Attorney review and Department. Approval by the Health soil work for each lot and I'll forward it tents. Provide a private street maintenance subdivision plat approval. 14. [14-235(C)] Surety. Prior to final subdivifnri�oval the subdivider shall provide surety for the completion of the private street as required by serjio� the private street will not be completed prior to approval of the final plat. 15. [14-302(B)1] General Informatio6j4 the plat is revised provide the date of the last revision on the plat. Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, then the application shall be deemed voluntarily withdrawn.
