Subject: SUB202000045 Foothill Crossing Ph V — Final Plat
Responses below in red are from David E. Nichols of Roudabush, Gale & Assoc. on 12/8/2020.
The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County Code.]
1. [14-302(B)(6)] Tax Map Parcel. Provide the unabbreviated tax map and parcel number in at least one place on the plat. Staff
suggests providing this information on the Cover Sheet, Rev. 1: Comment addressed.
2. [14-302(A)(3), 14-303(E), 14-306] Proposed Roads
a. Are proposed roads intended to be public or private? Note 6 on the Cover Sheet indicates these roads will be
private but road labels on this plat and other materials, including the site plan (SDP202000013) and road plans,
allude to these roads being public. Please clarify. (Note: Per 14-412(F), any street that is not constructed to
meet the to meet the standards necessary for inclusion in the system of state highways shall be privately
maintained and shall not be eligible for acceptance into the system of state highways unless improved to
current Virginia Department of Transportation standards with funds other than those appropriated by the
General Assembly and allocated by the Commonwealth Transportation Board.)
i. If public, remove Note 6 and include a note that instead dedicates the roads for public use.
ii. If private, label the roadways as "private" on all sheets, a private street request will need to be
submitted, reviewed, and approved (see 14-306, 14-234, 14-410, and 14-412 for more information),
and submit maintenance agreements for review/approval.
Rev. 1: Comment not fully satisfied. The County uses subdivision plats to formalize rights -of -way dedications.
Include a note on the Cover Sheet to "hereby" dedicate the roads to public use.
Note 14 on the cover sheet has been added to address this comment.
3. [14-302(A)(8), 14-303(E)] Proposed Lots
a. List the number of lots being created on the Cover Sheet, Rev. 1: Comment addressed.
b. On Sheet 3, provide bearing and distances (including totals) for front property boundaries on Lots 5-7, Lots
17-19, and Open Space D. Rev. 1: Comment addressed.
c. Please be aware the Open Space acreage provided here does not align with the acreage provided by the site
plan for this development (SDP202000013). Rev. 1: Comment remains. Calculations provided on the plat
and site plan will need to match exactly. Coordinate with Collins Engineering.
The plat is correct. The final site plan will match the final plat.
4. [14-302(A)(5)] Trail easements. Per the preliminary plat and initial site plan approval for this development, provide apublic
easement along the proposed trail so residents of adjacent neighborhoods can access the proposed greenway system that was
proffered by ZMA201600005. Rev. 1: Comment addressed.
5. [14-303(0-P)] Owner signatures. Provide a statement of consent, signature line, and notary panel for the property owner of
TMP 56-57B 1 since new easements are proposed on their property. Rev. 1: Comment satisfied. As noted by the applicant
in the comment response letter, offsite easement applications, for sanitary/storm facilities and an emergency access
easement, have been submitted to the County for review. See Comment 13b below.
6. [l4-302(A)(13), 14-302(A)(4-5)] Utility easements.
a. Remove the second sentence from Note 16 on the Cover Sheet accordingly. Site plans do not serve to record
easements. Rev. 1: Comment addressed.
b. On Sheet 5, label all new ACSA easements as "New". Rev. 1: Comment addressed.
c. On Sheet 6, should SWM areas be revised to say "(Stipple)' rather than "(Hatch)'? Rev. 1: Comment not
fully addressed. Thank you for updating the label however it appears the patterning is missing. This is
likely an exporting error. Please revise such that the label and symbolization align.
Stipple pattern has been updated.
7. [14-302(B)(10)] Stream buffers. Rev. 1: Comments addressed.
a. There are areas on the plat where the stream buffer location is depicted as much as 12ft less than the required
10011 buffer distance. Revise the buffer location such that at least 100ft buffer is provided along the entire
length of the stream shown on all sheets.
b. Include this follow required statement on the Cover Sheet: "The stream buffer(s) shown hereon shallbe
managed in accordance with the Albemarle County Water Protection Ordinance."
8. [14-302(B)] Zoning Notes. Rev. 1: Comments addressed.
a. If this is a cluster development, include that information as part of the zoning district.
b. Revise the Overlay District information to only list Steep Slopes (Managed), since that is the only Overlay
District that is regulated by the County, per § 18-30. Move the remainder of the information that is currently
provided to the notes section, as this information is still needed.
c. Show steep slope locations on the Existing Conditions Sheet and Subdivision Sheets.
9. [14-302(B)(8), 4.19] Yards. Revise the setback notes on the Cover Sheet to reflect the following:
a. Front = (current information) and front -loading garage = 18ft minimum
b. Side = 5ft minimum, unless the building shares a common wall as provided in Sec 4.19, No maximum
c. Building Separation = 1 Oft minimum
d. Rear = 20ft minimum, No maximum
Rev. 1: Comments addressed.
10. [14-303(G)] Open Spaces. Identify the ownership and maintenance of all common areas. Rev. 1: Comment addressed.
11. [14-303(G, I)] Monuments. At least two permanent monument locations need to be demonstrated on the plat with material
and location. Indicate the monument material and location for at least one other monument. Rev. 1: Commentaddressed.
12. [14-303(S)] Control points. Provide at least four (4) control points, evenly distributed acrossthe property and located at
survey property comers. Rev. 1: Comment addressed.
13. [Comment] Process. Please be aware that:
a. A final site plan and road plan for this development are also under review by the County at this time.
Regarding process of approvals, the road plan and VSMP plan for this development will need to be approved
and bonded before either the final plat or site plan can be approved. Depending on if the final plat or site plan
is approved first, the unapproved document will need to conform to the approved document or, if that is not
possible, the approved will need to be amended. Rev. 1: Comment remains. The road plans and VSMP
plans need to be approved before the final plat or site plan - both of which are currently under review -
can be approved.

b. [New] Per Comment 5, offsite easement plats will need to be approved, recorded, and have the recording
instrument (deed book and page) noted on the plat before final approval of the plat can be granted.
The deed book and page references for the off -site storm and sanitary sewer and emergency access easements
have been added.
14. [14-317] Maintenance instruments. Provide legal instruments evidencing maintenance of improvements included on the
plat. Rev. 1: Comment remains. Instrument(s) evidencing maintenance will need to address open spaces, trailways,
roads, the emergency accessway, and any other required improvements not listed here.
Maintenance Agreement will be provided by others.

15. [Comment] Proposed retaining wall. As discussed previously via phone, please revise the plat to include an easement
for the retaining wall that is currently proposed and shown on the site plan by Collins Engineering that is currently
under review for this development.
Wall Maintenance Easement has been added.
16. [Comment] Overlay Districts. On the Cover Sheet, information regarding regulated overlay districts seems to be
duplicated and referred to incorrectly in some places. Foundationally, the County only regulates six (6) districts as
"overlay districts": Airport Impact Area (AIA), Flood Hazard (FH), Natural Resource Extraction (NR), Scenic
Streams (SS), Entrance Corridor (EC), and Steep Slopes (Managed and Preserved). This information is correctly
provided under SITE DATA, however some numbered notes now appear to label other, additional areas as "overlay
districts". As such, please revise the following:
a. Revise Note 17 to:
i. State "The property shown hereon lies within the following and may be subject to additional
regulations:..." Now Note 20.
ii. Remove "Steep Slopes (Managed)" and "Water Supply Watershed" from the current
statement. This information is duplicative and may lead to confusion. Removed.
b. Revise Note 18 to state "The property shown hereon does not lie within an Agricultural/ForestalDistrict
or Dam Break Inundation Zone". Additional information provided in the current statement is
duplicative and should be removed. Now Note 19.
c. Under SITE DATA, revise the "Drainage District" heading to instead state "Watershed" to conform
more readily with County ordinances.
All notes and site data have been updated accordingly.
17. [Comment] Public Use. Related to Comment 15 above, the applicant may desire to reword Note 16 if a retaining wall
easement(s) is added to the plat as these easements, to staff's knowledge, are not typically dedicated to public use.
The note has been modified (see new Note 17).

4. The storm drain easement on the front of Lot 23 does not match what is shown on the road plans dated 6/18/20.
This storm drain easement will match the final plat.
5. A deed will also be required for the public drainage easements.
