DECLARATION OF BOUNDARY LINE ADJUSTMENT
THIS DECLARATION OF BOUNDARY LINE ADJUSTMENT (this "Declaration"), is
made this �' day of 1awmt� , 2020, by MALLOY PROPERTIES III. LLC, a
Virginia limited liability company (the "Declarant"), to be indexed as Grantor and Grantee,
RECITALS:
A. Declarant is the owner of those two parcels of real property located in Albemarle County,
Virginia (the "County"), being (i) a parcel of land containing 1.30 acres, more or less, identified on the
current tax maps of the County as tax map parcel 04500-00-00-112B1 ("Parcel 112B I") being a portion
of the same property acquired by Declarant by virtue of that certain Deed recorded in the Clerk's Office
of the Circuit Court of the County in Deed Book 4863, page 471; and (ii) a parcel of land containing 2.06
acres, more or less, identified on the current tax maps of the County as tax map parcel 04500-00-00-
068A0 ("Parcel 68A"), being the same property acquired by Declarant by virtue of that certain Deed
recorded in the aforesaid Clerk's Office in Deed Book 4863, page 467. Parcel 112B1 and Parcel 68A are
collectively referred to herein as the "Property."
B. Declarant desires to adjust the boundary line between Parcel 112B1 and Parcel 68A as
shown on that certain plat prepared by Roger W. Ray & Associates, Inc., dated June 22, 2020, entitled
"BOUNDARY LINE ADJUSTMENT PLAT, REVISED T.M. 45-68A AND REVISED T.M. 45-112B1,
THE PROPERTIES OF MALLOY PROPERTIES III, LLC, LOCATED ON U.S. ROUTE 29
(SEMINOLE TRAIL) (SOUTHBOUND LANE), RIO MAGISTERIAL DISTRICT, ALBEMARLE
COUNTY, VIRGINIA" (the "Plat"), which Plat is attached hereto, recorded herewith, and made a part
hereof.

DECLARATION:
NOW, THEREFORE, Declarant does hereby adjust the common boundary lines between Parcel
112B1 and Parcel 68A as shown on the Plat, and hereby vacates the existing property lines in the
locations labeled on the Plat as "Existing Boundary Lines Hereby Extinguished." Declarant hereby
declares that by recordation of the Plat, that the boundary line between Parcel 112B1 and Parcel 68AO
shall be as shown on the Plat, and any future conveyance of the Property shall be as shown on the Plat.
The Property shall remain subject to any easements, conditions, restrictions and reservations
contained in duly recorded deeds, plats, and other instruments, if any, constituting constructive notice in
the chain of title to the property, which have not expired by a limitation of time contained therein or have
not otherwise become ineffective, there being no intent by this Declaration to re -impose any such
easement, condition, restriction or reservation. The provisions of this Declaration shall be binding upon
and shall ensure to the benefit of Declarant and its respective successors and assigns.
This Declaration is made with the free consent and in accordance with the desire of the
Declarant, and in accordance with the statutes of the Commonwealth of Virginia governing the
platting of the land; the Plat having been duly approved by the proper authorities of the County as
evidenced by their endorsement thereon.
