This letter is in response to the attached Letter of Revision Request, accompanying application received
November 23, 2020. The Department of Community Development hereby grants approval of this LOR
for the following modifications to SDP2007-05, as depicted on the modified site plan and described
below:
1. Removal of various landscaping to the rear of the building as shown on modified site plan
2. Installation of 16' x 40' pergola with on -grade wood patio and associated 4' x 5.5' wood access
ramp
This change is noted in the attached request and plan. This is the second Letter of Revision for this site. A
total of three LORs may be requested after which any further changes to the plan will require submission
in the form of a site plan amendment application.

LOR #2 FOR SHADWELLS RESTARUANT SDP 2007 -00005
(PREVIOUS BUSINESS: TOPEKA STEAKHOUSE)
Due to GOVID restrictions, the restaurant seating capacity has been
reduced from approximately 200 down to 116 seats. This loss of 84 seats
was necessary to meet distancing requirements imposed by current state
mandates.
A grant has been awarded to fund outdoor dining. The grant requires that
improvements be made by 12131120, so this is to request a fast -track review
and approval of this LOR.
Description:
Pergola- composed of treated wood. Seating surface is "quick deck" which
is a sectional composite wood patio laid on solid cinderblocks with gravel
on -grade. Each Section is pre -made and measures 44.5"x44.5".
Pergola size is a 16ft wide x 40 ft long. Patio is 15'9" x 37'5" for outdoor
seating. Access from existing door will be a 4ft wide x 5.5' long wood ramp.
Access will be ADA compliant. The seating area is 591sf. (8% of the 7420sf
bldg.)
Pergola location & FDC: Pergola to be located on the south side which is
behind the building therefore not in view from the EC. The Deputy Fire
Marshall advised that aft clearance to access the FDC connection is
required so pergola post will be located a minimum of aft from FDC. A sign
Lit the corner of the bldg to direct first responders to its location is to be
provided. (Noted on plan)
Landscaping - To accommodate the patio:
Trees: one (1) emerald aborvitae and one (1) crepe myrtle to be removed.
Shrubs: approx. 12 laurel shrubs to be removed.
There is a double row of laurel shrubs. One row will be removed leaving a
single row between the patio and curb. If any are damaged a similar
species will be mixed in such as boxwoods. Since the laurels have become
overgrown - the removal of these shrubs will not have impact on the visual
aspects.
Parking - No change to parking space quantity is proposed. Location of the
pergola between bldg and curb will not impact any existing parking spaces.
Seating area added is 592sf which could require (13/1000 x 592) 8 parking
spaces. The pergola seating will add 32 seats (8 tables x 4 seats) but there
is still an overall 26% reduction in seating (200 seats compared to 116 + 32
= 149 is 74%), so there is no need for additional spaces.
This is to request that the required parking be reduced by 10% so the
requirement for 96 spaces on the approved site plan can be reduced to 96
spaces. The following justification is provided:
I. Zoning is PDMC. This location is part of a planned development with
an integrated pedestrian pathway system that connects Sentara
Hospital to RT250 and numerous large medical offices, a hotel, and
this restaurant.
2. At least 15% of the restaurant customers come from offices and
businesses in the 1/4 mile radius which also includes the bank and
offices at State Farm bldg.
3. Immediately adjacent is the Hotel with no restaurant so this is source
of customers. (currently negotiating for room service delivery to
hotel occupants)
4. This location is served by Gville Transit - Map of the Pantops Route 10
is attached. Bus stops are located within 1/10 mi of the bldg..
S. The retirement facilities in the Pantops area including Westminister
Canterbury deliver their residents via courtesy vans for lunch and
dinner on a routine basis (covid currently limited this activity but it
was well established prior).
The parking spaces provided at this site exceeds what is needed. There is at
least 15% of the customers that do not drive. With a reduction in required
spaces from 96 to 86 - the outdoor seating of 592sf which requires 8 spaces
can be added so the required parking spaces total will be 94 spaces.
