THIRTEENTH SUPPLEMENTAL DECLARATION OF
CONVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS
This Thirteenth Supplemental Declaration is made as of this 3rd day of December, 2020, by
WOODBRIAR ASSOCIATES, hereinafter referred to as the "Developer",
RECITALS: Whereas, the declaration of Covenants, Conditions and Restrictions for
Briarwood, Phase 1A-2, 1B-2 & 8 (hereinafter "Declaration") is recorded in the Clerk's Office of
The Circuit Court of Albemarle County, Virginia, in Deed Book 4111 page 477;
Whereas, the First Supplemental Declaration of Covenants, Conditions, Restrictions and
Easements (hereinafter "First Supplement") is recorded in the aforesaid Clerk's Office in Deed
Book 4132, page 472;
Whereas, the First Amendment to Declaration of Protective Covenants, Conditions and
Restrictions and Reserved Easements is recorded in the aforesaid Clerk's Office in Deed Book
4316, page 157;
Whereas, the Second Supplemental Declaration of Protective Covenants, Condition,
Restrictions and Easements are recorded in the aforementioned Clerk's Office in Deed Book
4416, page 471-477;
Whereas, the Amended and Restated Third Supplemental Declaration of Covenants,
Conditions, Restrictions and Easements are recorded in the aforementioned Clerk's Office in
Deed Book 4513, page 61;
Whereas, the Fourth Supplemental Declaration of Covenants, Condition, Restrictions and
Easements (hereinafter "Fourth Supplement") is recorded in the aforesaid Clerk's Office in Deed
Book 4674, page 748;
Whereas, the Fifth Supplemental Declaration of Covenants, Condition, Restrictions and
Easements (hereinafter "Fourth Supplement") is recorded in the aforesaid Clerk's Office in Deed
Book 4801, page 463-471;
Whereas, the Sixth Supplemental Declaration of Covenants, Condition, Restrictions and
Easements (hereinafter "Sixth Supplement") is recorded in the aforesaid Clerk's Office in Deed
Book 4931, page 701;
Whereas, the Seventh Supplemental Declaration of Covenants, conditions, Restrictions
and Easements (hereinafter "Seventh Supplement) is recorded in the aforesaid Clerk's Office in
Deed Book 4969, pages 395-402;
Whereas, the Eighth Supplemental Declaration of Covenants, conditions, Restrictions and
Easements (hereinafter "Eighth Supplement') is recorded in the aforesaid Clerk's Office in Deed
Book 5091, pages 71-78;
Whereas, the Ninth Supplemental Declaration of Covenants, conditions, Restrictions and
Easements (hereinafter "Ninth Supplement") is recorded in the aforesaid Clerk's Office in Deed
Book 5094, pages 690;
Whereas, the Tenth Supplemental Declaration of Covenants, conditions, Restrictions and
Easements (hereinafter "Tenth Supplement") is recorded in the aforesaid Clerk's Office in Deed
Book 5110, pages 063- 067;
Whereas, the Eleventh Supplemental Declaration of Covenants, conditions, Restrictions
and Easements (hereinafter "Eleventh Supplement") is recorded in the aforesaid Clerk's Office
in Deed Book 5168, pages 0427- 0437;
Whereas, the Twelfth Supplemental Declaration of Covenants, conditions, Restrictions
and Easements (hereinafter "Twelfth Supplement") is recorded in the aforesaid Clerk's Office in
Deed Book 5225, pages 0676- 0684;
Whereas, it is the desire of the Declarant to impose the said Covenants, Conditions and
Restrictions on additional lots which have been approved as follows:
"All that land shown on that certain plat of Lincoln Surveying entitled "Subdivision
Plat Showing Lots 126 Through 138, Phase 6, Briarwood Subdivision Being A Portion of
Tax Map 32G Parcel 1R4, Rio Magisterial District, Albemarle County, Virginia," dated
May 11, 2018, revised February 19, 2020, revised April 24,2020, revised July 30, 2020,
revised September 2,2020 recorded herewith and made a part hereof."
NOW THEREFORE, pursuant to section 7.01 of the declaration of Covenants, Conditions,
Restrictions and Easements of record in the said Clerk's Office Deed Book 4111, page 477,
Supplemented in Deed Book 4132, page 472, the Declarant hereby declares that all of the subject
Property described above is and shall be held, occupied, and conveyed subject to the covenants,
Conditions and restrictions set forth in said Declaration of record in the said Clerk's Office in
Deed Book 4111, page 477 as amended and supplemented.
