The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once
the following comments have been addressed: [Each comment is preceded by the applicable reference, which is
to the Subdivision/Zoning Ordinances unless otherwise specified.]
[General Comment] Per the Code of Development and Application Plan ofZMA201500007, the greenway
dedication throughout Brookhill measures approximately 53.6 acres and is spread across multiple blocks.
This plat appears to be dedicating the greenway areas identified on the Application Plan in most blocks.
However, the Application Plan identifies greenway areas within Block 8 on TMP 46-19A2, and an area
along the eastern property boundary of TMP 46-19138. The plat does not propose to dedicate those two
greenway areas. Please address the following:
a. Please acknowledge that the applicant/developer/owners are aware that those two greenway areas
are required to be dedicated to the County.
b. Please verify the timinglintent for dedicating those greenway areas.
2. [14-302 (A)(14)] Per the proffers of ZNIA201800011, and the Code of Development and Application Plan
of ZMA201500007, the area shown as "New Open Space Parcel' coincides with the area identified as
Greenway. The greenway within Brookhill is required to be dedicated to the County for public use (see
page 18 of the COD and proffer #2A of ZMA201800011). Notes 12 and 13 state that the new open space
parcel is going to be owned by the HOA. Please address the following:
a. Please confirm that the open space/greenway parcel encompasses the land within the 100 foot
stream buffer along the perennial streams and wetlands and all land located within the floodplain,
per page 18 of the COD. Any land not within the floodplain, perennial stream buffer, or wetlands
are not required to be dedicated to public use/greenway.
b. Revise the label fef the epen spaee pafeel se that it is identified as a new gfeenway and state

Developer will be granting an easement over greenway through a separate plat application
once the greenway lot is created.

3. [14-426 and ZMA201500007] Please add the note from Page 18 in the Code of Development that says,
"Exclusive of primitive trails, pedestrian bridges, and sanitary sewer utility connections, no other impacts
are proposed to the stream buffer corridor, and all Stormwater Management Facilities and Erosion &
Sediment Control Facilities shall be located outside of the stream buffer corridor."
4. [14-302 (A)(1)] Please revise the pint title so that- it statt-as that this is a plat ereating a new publie greepway
parcel UPDATE: Comment no longer applies.
5. [14-303 (A)] Please revise the statements of consent to division for TMP 46-19136 and 46-19B8. The text
currently states TMP 46-19B6 twice and does not mention TMP 46-19138.
6. [14-303 (H) and 14-4211 Per note 15 on Sheet VI, all new property corners are to be monumented with
iron pins unless otherwise noted on the plat. On Sheets V2-V4, please identify all new property comers
with symbology or labels identifying new iron pins to be installed, iron pins found, etc.

The plat for BROOKHILL OPEN SPACE SPECIAL LOT has been reviewed by Engineering. The
following comments will need to be addressed before approval:
1. This plat does not appear to include all areas of the greenway on the ZMA map.
2. There is a note on the cover sheet saying there are no known graves, however, there is the
Dunn cemetery.
3. Please add the note from Page 18 in the Code of Development that says, "Exclusive of
primitive trails, pedestrian bridges, and sanitary sewer utility connections, no other
impacts are proposed to the stream buffer corridor, and all Stormwater Management
Facilities and Erosion & Sediment Control Facilities shall be located outside of the
stream buffer corridor".

Hey Cameron,
I want to chime in real quick. We originally built some mountain bike trails this summer and with the Covid shutdown,
they got a ton of use from the public, but we quickly realized that our insurance wasn't correct and that we need to
combine all the greenway area where the trails are located under one fee simple owner in order to get the insurance
policy tight. When we heard Cutaway Bike camp was taking groups of kids out there, we suddenly realized that if
something were to happen, we'd have a legal mess on our hands. The goal of this plat submission is to plat the main
greenway so we can purchase it, properly insure it, and open it back up to the public to use our Mtn biking/hiking
trails. We weren't thinking about the proffer requirement, just trying to purchase the land where the trails are located
so we could get the insurance right and re -open the trails as soon as possible. To keep things streamlined, our intent is
not to dedicate an easement over the greenway with this plat at this time, but rather to focus on the subdivision of the
main greenway area so we can purchase it. We'll likely dedicated the easement according to the proffer schedule after
the 500th CO after the County requests it. Having that approach would likely eliminate many of your
dedication/greenway comments at this time. Let me know if this makes sense.

Yes, you are correct. You're only required to dedicate a public easement over the greenway areas. In my
comment letter to Roudabush for the greenway plat (SUB202000189), I had several comments about
the greenway. The plat stated that it was going to be privately owned/maintained by the Brookhill HOA,
which isn't what the proffer calls for. It needs to be a public easement. To be clear, it does not need to
be dedicated in fee simple to the County, just a public easement needs to be created.

I hope you are well. I understand that we received a comment from the County regarding
dedication of the greenways. Per the proffer below, it is our plan to dedicate an easement for
public use over the greenway. Let me know if there is anything else we should be aware of on
this. Thanks so much!
2. Trails, Parks and Civic Spaces. The Owner shall provide the following improvements within the
property:
A. Trail Network. A primitive trail network (the "Trail Network"), consistent with the County's
design standards for a Class B- type 1 primitive nature trail, shall be established within the
Greenway as described within the Code of Development. The general location of the Trail Network
is shown on the Application Plan; however enact trail locations shall be determined by the Owner
based on site conditions and in coordination with the County. Installation of the Trail Network
shall commence concurrently with the site work for the first Block developed within the Project
and the entire trail network shall be substantially completed prior to issuance of the five hundredth
(500th) Permit for a dwelling (other than a Multi -family dwelling, Assisted Living, nursing home,
rest home or convalescent facility) within the Project. The Trail Network shall be determined to
be substantially completed by the Albemarle County Engineer, or its designee.
Upon written request by the County, but not prior to the issuance of the five hundredth (500th)
Permit for a dwelling within the Project, the Owner shall dedicate to the County an easement for
public use over the Greenway area, as shown on the Application Plan. Prior to the County's request
to dedicate such easement, the Owner may dedicate portions of the Greenway by easement
concurrently with one or more subdivision plats for areas lying adjacent to the Greenway; provided
however, that Owner may reserve in such easements, rights of access for grading, utilities and
maintenance. Each subdivision plat shall depict the Greenway area to be dedicated and shall bear
a notation that the Greenway area is dedicated for public use. If, at the time the County requests
dedication of the Greenway, any part of the Greenway that has not been dedicated by subdivision
plat, shall be (within six (6) months of such request) at Owner's cost, surveyed, platted and recorded
with one or more deeds of easement dedication.
Pursuant to signage plan approval by the Rivanna Water and Sewer Authority (the "RWSA"), the
Owner shall install signage along the Trail Network within the Dam Break Inundation Zone
designating evacuation routes. Signage shall be installed as the Trail Network is established.
