Below, please find our response to the comments dated August 22, 2019 on the Initial Site Plan. Community Development Department — Planning — Tim Padalino 1. [Z.O. 32.3.1.(c), 32.4.2.5.(a), 33.40.C, and SP2018-07 and SP2018-08 Conceptual Plan and Conditions of Approval]: CDD staff has reviewed this Initial Site Plan and has made the following findings regarding compliance with the applicable Special Use Permit (SP) Conditions of Approval: The proposed Site Plan shown on Sheet 4 appears to be in general accord with the Conceptual Plan in regards to SP Conditions of Approval #1.a, 1.c, 1.d, and 1.e. OK b. The proposed Site Plan shown on Sheet 4 is potentially in general accord with the Conceptual Plan in regards to SP Condition of Approval #1.b ("Screening comprised of a screen fence (sliding gate), screening fence, and landscaping"). CDD-Planning staff is coordinating with CDD-Zoning staff to determine if the proposed location of the "opaque wooden gate" as shown on Sheet 4 (at the rear corner of the proposed building addition) is in general accord with the "proposed sliding gate" shown on the Conceptual Plan (near the front corner of the existing building). 8-22-18 Update: Planning Comment #i.b has been updated to reflect staff's determination that the screen fence/sliding gate shown on the Initial Site Plan opaque wooden gate") is not in general accord with the Special Use Permit Conceptual Plan. RESPONSE to #lb: A sliding gate has been added to the Final Site Plan in the location as shown on the Application Plan. During the final design stages, it wa determined that a 30'-wide solid gate was not practical for the geometric constraints of the site. A heavy-duty vinyl -coated mesh fabric that could easily be slid across the entrance to provide adequate screening is proposed. A detail for the gate has been added to the Grading Plan (Sheet 5). 1 1 P a g e 30 Scale, LLC 871 Justin Drive, Palmyra, VA 22963 Ph. 434.242.2866 mike@30scale.com 30 SCALE The proposed Site Plan shown on Sheet 4 is in general accord with SP Condition of Approval 2; however, please see VDOT review comments regarding required modifications to the design and location of the proposed sidewalk. RESPONSE to #Ic: The sidewalk has been revised to address VDOT review comments. d. The proposed Site Plan shown on Sheet 4 is potentially in general accord with SP Condition of Approval #3; this condition does not have to be addressed and resolved until the time of Building Permit review. RESPONSE to #1d: Please note that the applicant has decided to complete the project in Two Phases. The site improvements will be completed in Phase 1, but the building addition will not be constructed until Phase 2. Phasing notes have been added to the Layout Plan (Sheet 4). e. The proposed Site Plan shown on Sheet 4 is potentially in general accord with SP Condition of Approval #2; this condition does not have to be addressed and resolved until the time of Landscape Plan review (during the Final Site Plan review process). OK 2. [SP2018-07 and SP2018-08 Special Exceptions Conditions of Approval]: CDD staff has reviewed this Initial Site Plan and has made the following findings regarding compliance with the applicable Special Exception (SE) Conditions of Approval: a. The proposed Site Plan shown on Sheet 4 appears to be in general accord with all SE Conditions of Approval. OK b. Staff requests, but does not require, that the following note be added to Sheet 4 and also added to the Landscape Plan (during the Final Site Plan review process): "The existing canopy trees within the side yard setback area that currently provide screening shall be protected during construction, and shall be maintained to increase and preserve the health of the trees - including but not limited to cutting and/or removing the vines growing up the tree trunks - as requested by the Albemarle County Planning Commission during the public hearing to discuss Special Exception requests to modify the side yard setback and disturbance buffer zone on September 25, 2018. " RESPONSE to #2b: The note has been added to the Layout Plan (Sheet 4) and the Landscape Plan (Sheet 6) 2 1 P a g e 30 Scale, LLC 871 Justin Drive, Palmyra, VA 22963 Ph. 434.242.2866 mike@30scalexom 30 SCALE Z.O. 32.5.2(a)]: Please revise the Zoning information as follows: a. In the "Project Narrative" on Sheet 1, revise the second paragraph to reference "two special exceptions" instead of "a special exception," and add the date of approval of those special exceptions (11/14/2018) for reference. RESPONSE to 3a: The Project Narrative on Sheet 1 has been revised as requested. b. In the "Ordinance Tabulations" table on Sheet 2, revise the "Side and Rear - Minimum" information in the "Yards" section to reference the two Special Exceptions approved on 11/14/2018 (involving modifications to the side yard setback and disturbance buffer zone). RESPONSE to #3b: The Ordinance Tabulations on Sheet 2 have been revised to reference the two Special Exceptions approved on 1111412018. 4. [Z.O. 32.5.2.(e)]: Please show and quantify proposed limits of disturbance. (See CDD- Engineering comments.) RESPONSE to #4: The limits of disturbance have been shown, quantified and labeled on the Landscape Plan (Sheet 6) and have been labeled on the Cover Sheet (Sheet 1). Z.O. 32.5.2.(b) and 32.5.2.(k)]: Site Plan Note 8 on Sheet 4 references an existing sewer lateral that will be utilized for service to 1895 Avon Street Extended. Please add a reference to this existing sewer lateral and available sewer service in the "Property Information" section of the Ordinance Tabulations" table on Sheet 2. Currently, the "ACSA Jurisdictional Area Note" portion of that section references water utility service but does not mention wastewater/sewer utility service. RESPONSE to #5: The Ordinance Tabulations on Sheet 2 have been revised to reference the existing sanitary sewer lateral and that the property lies in the ACSA jurisdictional area for water and sewer service. 6. [Z.O. 32.5.2.(p), 32.6.2.(j), and 32.7.9]: (Advisory only; no revision to Initial Site Plan is necessary) - An approved Landscape Plan will be required in conjunction with the Final Site Plan. [Z.O. 32.5.2.(n), 32.6.2.(k), and 4.17]: (Advisory only; no revision to Initial Site Plan is necessary) - An approved Lighting Plan / Photometric Plan will be required in conjunction with the Final Site Plan. Staff acknowledge Site Plan Note #6 on Sheet 4. RESPONSE to #7. Please note that no lighting fixtures are proposed that will emit more than 3,000 lumens and therefore a Lighting Plan/Photometric Plan is not required to be approved with the Final Site Plan. 8. [Z.O. 32.7.4.2 and County Code Chapter 14]: (Advisory only; no revision to Initial Site Plan is necessary) - An easement plat would be required to establish the SWM Forest/Open Space Easement referenced in this Initial Site Plan. Such an easement plat (with corresponding deed) would need to be submitted, reviewed, and approved prior to County approval of the Final Site Plan. RESPONSE to #8: No new easements are proposed with the Final Site Plan. The SWM Forest/Open Space Easement is no longer required since the project is exempt from VSMP water quality requirements as stated in the Project Narrative on Sheet 1. Community Development Department - Enaineerina - Matthew Wetland Please note the total area of disturbance to determine if a VSMP plan is required. If the existing gravel is to be paved and not regraded, it will be considered maintenance. RESPONSE: The limits of disturbance have been shown, quantified and labeled on the Grading Plan (Sheet 5), Landscape Plan (Sheet 6) and have been labeled on the Cover Sheet (Sheet 1). Please note that the area of disturbance is less than 10,000 square feet and therefore the plan is exempt from VSMP requirements. Community Development Department - Inspections - Michael Dellinger Add the following notes to the general notes page. Retaining walls greater than 3 feet in height require a separate building permit. Walls exceeding 4 feet in height require a stamped engineered design also. Walls require inspections as outlined in the USBC. Accessible parking spaces and access isles shall not have a surface slope greater than 1.48. Access isles shall be at the same level as the parking space they serve. ALL water lines, sewer lines, and fire lines from the main to the structure MUST have a visual inspection performed by the building department. All roof drains shall discharge in a manner not to cause a public nuisance and not over sidewalks. Albemarle County Fire and Rescue — Shawn Maddox 1. A Knox Box is required. Please add a note indicating the requirement and that the location can be coordinated with the fire marshal's office. RESPONSE: The Knox Box note has been added to Sheet 4 under "Fire and Rescue Notes. " 2. Confirm the building height will be less than 30' to ensure the travel way is adequate. RESPONSE: The building height will be less than 30', which has been added to Sheet 4 under "Fire and Rescue Notes." 3. The travel lanes in front of and beside the buildings shall be marked no parking fire lane to allow for apparatus turn around on the site as opposed to backing out into Avon Street Extended. RESPONSE: Fire lanes have been indicated on the Layout Plan (Sheet 4). 4. The new building is farther than 250' from the existing hydrant on Avon Street. A hydrant can be added to the site on the property side of Avon Street Extended. RESPONSE: There is an existing hydrant on Avon Street Extended Street that appears to be within 250' of the building. For that reason, a new fire hydrant has not been added. VDOT — Adam Moore 1. The current design of the proposed 4' sidewalk does not meet VDOT's minimum of 5 feet in width. A 4' buffer strip is also required. Please refer to VDOT's Road Design Manual Appendix B(1), pg. 31, for design criteria. RESPONSE: Existing and proposed fixture counts will be provided with the Building Permit Plan submission. Please note the building permit plans will be submitted during Phase 2. During Phase 1, no changes to the existing fixture counts are proposed. .
