Mr. Collins:
The Agent for the Board of Supervisors hereby grants administrative approval with conditions to the above
referenced preliminary subdivision plat.
This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer
submits a final plat for all or a portion of the site within one (I) year after the date of this letter as provided in the
Section 14-226 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final plat.
The final plat will not be considered to have been officially submitted until the following items are received:
1. A final plat that satisfies all of the requirements of section 14-303 and sections 14-304 through 14-318 the
Code, and the conditions attached to this letter.
2. Applicable fee outlined in the application.
Please submit 12 copies of the final plat to the Community Development Department. The assigned Lead Reviewer
will then distribute the plat to all reviewing agencies. Once you receive the first set of comments on the final plat,
please work with each reviewer individually to satisfy their requirements.
The Department of Community Development shall not accept submittal of the final plat for signature until tentative
approvals for the attached conditions from the following agencies/reviewers have been obtained:

Subject: SUB202000191 Jarmans Gap Development - Preliminary Subdivision Plat
The County of Albemarle Planning Division will recommend approval of the plan & plat referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been identified at this
time. Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded
by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
Comments to be addressed with the Final Subdivision Plat submission:
1. 114-3031 Contents offrnal plat. Revise the plat to include and meet all requirements of a final plat.
2. 114-302 (A)(4) and 14-3171 Address the following:
a) Please clarify who will own and maintain the 10' private sanitary sewer easement mentioned in Lots 2, 3, 5, TMP
55-3--21, TMP 55-3--20 & TMP 55-3--19 on Sheet 3. A deed of dedication and/or a maintenance agreement may
need to be reviewed, approved, and recorded prior to final plat approval.
b) Show the deed book and page number for the deeds of any existing temporary construction easements for the
construction of the sanitary sewer laterals in the TMP 55-E-3--21, TMP 55-E-3--21 and TMP 55-E-3--19 or show
proposed easements for the construction.
c) Show proposed private easement for the laterals that will be outside of the existing sewer easement in parcels TMP
55-E-3--21, TMP 55-E-3--21 and TMP 55-E-3--19.
d) Revise the note on the coversheet that states that "All proposed easements shall be dedicated to public use." It
appears that some private easements will be required and therefore this note is not correct.
[14-402(A)(5)] Ensure all existing and proposed public easements are specified on the plat, including their deed book
and page number.
a) There is an existing residence, but not electrical easement has been listed.
b) Show and dimension the proposed sight distance easements.
c) See engineering comments in reference to the SWM Facility easement.
d) Provide the location of any existing or proposed utilities and utility easements including telephone, cable, electric
and gas.
4. 114-302(A)14)] Areas to be dedicated or reserved. Add a note on the plat stating that "All new public street right-of-
way shown hereon are hereby dedicated to the County for public use."
5. 114-3171 Provide documentation on which HOA will take ownership and provide existing or proposed instruments that
guarantee perpetual maintenance of the following:
a) All trees and sidewalks that will be within the public ROW for Jarmans Gap Development must be submitted,
b) Please note that all of instruments must be submitted, reviewed and approved prior to final subdivision plat
approval. They must also be recorded with the plat.
6. 114-302 (13)(7)] Revise the not on the water supply protection to state "This property is within the Lickinghole Creek
Water Supply Protection Area."
7. 114-302 (A)(4) & 14-302 (A)(5)] Show the existing prescriptive right of way easement along Jarmans Gap Road.
Also provide an instrument (deed book and page number) and width for the prescriptive ROW easement.
8. 114-302(A), 14-303 (C) & (E)] Proposed Lots; Boundary Lines; Dimension standards and information on all lots,
streets, alleys, easements, and shared driveways. Address the following:
a) Ensure all portions of the proposed boundary lines are fully dimensioned.
b) Revise the dimension on the eastern lot line of Lot 5. It does not appear to be correct.
9. [14-303(E)] Dimension standards and information on all lots, streets, alleys, easements, and shared driveways. Ensure
that the typical street section and the plan view of the proposed street match. The section specifies a " 549Var. Width"
but the dimensions in the plan view show a width of 62' through the straight section of the proposed street. No portion
of the street appears to be 54'.
10. 114-303(G) & 14-3171 An instrument assuring the perpetual maintenance of the improvements that are to be
maintained by the HOA in perpetuity require County Attorney approval prior to final site plan approval.
11. [14-303(L)] Public utility, drainage and sight distance easements. Provide sight distance easement and linework,
across TNT 55-76 & TNT 55-77A, for the entrance onto Jarmans Gap Road. Submit the deed for each of these for
review and approval.
12. [14-303(11)] Street Names easements. Provide a street name. See E911 comments.
13. [14-312] Location of existing buildings. Only the primary structure appears to be shown on the plat. Show all existing
building. There appear to be two other structures within the parcel.
14. [14-316] VDOT approval of all entrances onto public streets is required prior to approval of the site plan or subdivision
plat.
15. 114-410 & 14-4221 Ensure that the sidewalks meet minimum standards. Revise the width of the sidewalk along
Jarman's Gap Road to meet standards.
16. [Comment] Revise the "Allowable Density:" of the coversheet to specify the number of units as 5.16 and not 5.2.
17. [Comment] A safety railing is required for the proposed 4' high retaining wall.
18. [Comment] Address the following in reference to Off -site easements:
a) Provide a copy of all exiting off -site easements from off -site property owners or include in the plat the proposed
off -site easements. Any proposed required easements must be included in the plat, and their legal documents,
must be submitted for review and approval. Those documents must also be recorded with the final plat.
b) Revise the note on the coversheet that states there is no off -site disturbance and then goes on to state except for the
sewer connections. There is off -site disturbance for sewer connections that is proposed outside of the existing
sewer easements. Therefore, off -site easements for that disturbance will be required.
19. [Comment] Any required deeds of easement, except where specifically mentioned in other comments, must be
submitted for review, approved, and signed and notarized before the final plat is approved. These deeds and legal
documents must be recorded with the plat and proof of recordation provide to the County for their records.
20. [Comment] See the other SRC reviewer comments attached. All SRC reviewer comments must be sufficiently
address prior to final plat approval.
21. [Comment] The final plat cannot be approved until the road plan & WPO plan are approved.
22. [Comment] All improvements (Road Plan, WPO Plan) must be built or bonded before the final plat can be approved.

Engineering has reviewed the preliminary plat, and offers the following( for Final plat approval):
1. Proposed 4' segmented retaining wall requires:
a. A building permit,
b. PE -sealed design, and
c. A recorded wall maintenance easement agreement between owners of Lot 4 and Lot 5. Deed bk.-
pg. reference to recorded agreement is required prior to or with Final plat. Agreement may be
recorded with the Final plat.
2. An approved WPO plan is required prior to final plat approval. Please submit WPO plan application at
earliest convenience.
a. Note: With WPO plan, extend discharge from proposed SWM facility to a natural or man-made
storm conveyance system. It may not be discharge to ungraded non -defined general slope
contours. Please see 9VAC25-870-66.B., Channel protection, first sentence: `Concentrated
stormwater flow shall be released into a stormwater conveyance system...' This statement applies
to discharge at any point, to any point.
b. Recommend extend swale riprap outfall cross -contour further south along eastern edge of Lot 4 to
the point it intersects an apparent defined natural channel on Lot 4. Else, it appears a permanent
off -site public drainage easement across TNT 55E-03-B is required. See image below: solid blue
line =possible location of riprap extension across Lot 4 (manmade conveyance) to apparent point
of intersection with natural conveyance (indicated by existing contours, which then lead to stream
on TNT 55E-03-B). Dash blue line = point of intersection of riprap (extension) with natural
conveyance on Lot 4, with no off -site easement required. Off -site erosion /inadequate conveyance
may pose recurrent or difficult -to -resolve post -construction issues. Design must convey post -
developed runoff to a natural or manmade stormwater conveyance system at each point upslope of
eventual, final off -site natural or manmade conveyance system.
c. Provide VaRRM.x1s.

earliest convenience. With road plan, please ensure /provide:
a. Runoff to the west edge of the proposed public road from Jarmans Gap Road into the development
is collected and conveyed via storm conveyance, with remnant runoff discharged directly to parcel
to the west as non -concentrated sheet flow.
b. LD-204, LD-229 tables, hydraulic design calculations.
c. Plan /profile of storm collection /conveyance systems.
d. Pavement design, projected ADT.
e. DP, D,, needed to support item 3_d., above.
f. CG-6 wherever runoff concentrates against curbing.

4. With WPO Plan, if SWM facility is designed as a swale, please ref swale design criteria, including
longitudinal slope, etc. At first glance, SWM facility is oblong without clear swale length or width
characteristics. It appears more nearly a simple detention basin. Please ensure proposed design nets
intended water quality credits, by meeting VA DEQ Stormwater Design Criteria.
5. Revise Lot 5 lateral transit of Lot 4 to avoid proposed 4' segmented retaining wall (current design does
this) to then approach Lot 4 lot line, that is, revise lateral location to run parallel with Lot 4 lot line within
landward 50' of stream buffer to avoid dwelling construction conflict/s on Lot 4. Lot 5 private sanitary
lateral should lie as nearly as possible to Lot 4 lot line as practical (5'-10' offset) in a private easement
centered over Lot 5 lateral as it crosses Lot 4. Engineering recommends —8' offset from Lot 4 eastern lot
line. This location is permissible under 17-604.A, with definition of sewage disposal system excluding
lateral pipes from a dwelling unit to a publicly owned sewerage facility. An alternative location near lot
line is required to allow reasonable use of Lot 4 and 5. Engineering does not object to Lot 5 sanitary lateral
location that avoids proposed retaining wall and that lies as close as 5' to Lot 4 eastern lot line.

7. Provide additional existing and proposed contour labels (with WPO /Road plans) west of proposed
(development access) public road, near Jarmans Crap Road.
8. With 25' radius return ending at adjacent property line, acquire and provide copy of recorded temporary
construction easement needed to construct curb, sidewalk, and proposed grade. Alternatively, furnish right -
of -entry letter (ROE) or similar legally -enforceable written agreement that grants developer right to occupy
adjacent parcel in areas, as needed, for temporary constructive purposes.

Retaining walls greater than 3 feet in height require a separate building permit. Walls exceeding 4 feet in height require a

inspection performed by the building department.

Buildings or structures built before January 1, 1985 must have an asbestos survey performed in order to apply for a demolition
permit. Asbestos removal permits are required if positive for such from Albemarle County and VDOLI. Contact VDOLI for their
additional requirements and permits for demolition projects at 540-562-3580 x131.
Add the following note to the general notes page:
Where the flood level rims of plumbing fixtures are below the elevation of the manhole cover of the next upstream manhole in the
public sewer. the fixtures shall be protected by a backwater valve installed in the building drain, branch of the building drain or
horizontal branch serving such fixtures. Plumbing fixtures having flood level rims above the elevation of the manhole cover of the
next upstream manhole in the public sewer shall not discharge through a backwater valve.
Note to developer:
Due to required distances from lot lines and structures as required by the NFPA, underground propane tanks may be prohibited.

As requested, I've reviewed the subject plat, dated 10/26/20, the Albemarle County GIS
database, as well as VDH records on this parcel. It appears there are no existing onsite
septic systems or wells associated with the existing residence, and all new construction
will be connected to public sewer & water systems. Therefore, I have no concerns or
objections to the preliminary plat.
