Kirk Hughes and Associates (rob(a)khals.net) From: Andrew Reitelbach, Senior Planner Division: Planning Date: December 31, 2020 Subject: SUB2020-00197 Old Trail Block 32 Phase 2 Lots 1-7 — BLA Fax 434-972-4126 The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [ZMA2015-00001] Provide revised Old Trail block tables as apart of this plat that have been updated to reflect the proposed new circumstances of the lots and the pocket park. The tables to be revised can be found on sheet 8 of 8 of the plat recorded at DB 5386, page 251, 255 (plat). 2. [14-302(A)14] As a portion of the Old Trail open space is proposed to be incorporated into private residential lots with this plat, the Declaration of Covenants and Restrictions that was recorded for this block will need to be revised in order to reference this plat and the altered boundaries of Pocket Park B. This revised declaration will need to be submitted to the County for review before this plat can be approved. Once approved, the revised declaration must be recorded with the revised plat. 3. [14-302(B)1] Provide the date of last revision of the plat on future submittals of this plat. 4. [14-303(G)] Ownership of Common Areas. Identify the intended ownership of Pocket Park B, which appears to be intended as a common area for the development. 5. [SUB2018-00164] Block 32 Road Plans. The approved road plans for Old Trail Block 32 (application number 2018-00164) show that a sidewalk is required within Pocket Park B along the property lines of Lots 1-7. With this proposed boundary line adjustment, that sidewalk will be located within the private residential lots instead of in the common area parcel of Pocket Park B. Either: 1) Amend the Old Trail Block 32 road plans to relocate this sidewalk outside of the proposed new residential lots lines, so that it stays fully within the pocket park parcel; or 2) provide an access easement within revised Lots 1-7 over the area where the sidewalk is shown in the road plans so that access along the sidewalk continues to be permitted and would not be impeded by the individual private residential lots.
