I looked at the state code (see language below) and come up with this interpretation. The plat will be valid until May 18, 2009. If they complete the streets or bond them we can sign the plat up until that time. I have checked with others and they agree. § 15.2 -2260. Localities may provide for submission of preliminary subdivision plats; how long valid. F. Once a preliminary subdivision plat is approved, it shall be valid for a period of five years, provided the subdivider (i) submits a final subdivision plat for all or a portion of the property within one year of such approval or such longer period as may be prescribed by local ordinance, and (ii) thereafter diligently pursues approval of the final subdivision plat. "Diligent pursuit of approval" means that the subdivider has incurred extensive obligations or substantial expenses relating to the submitted final subdivision plat or modifications thereto. However, no sooner than three years following such preliminary subdivision plat approval, and upon ninety days' written notice by certified mail to the subdivider, the commission or other agent may revoke such approval upon a specific finding of facts that the subdivider has not diligently pursued approval of the final subdivision plat. Yadira was the planner on the project. Kirk Hughes prepared the plat. We worked on the providing the Engineering drawings. We received tentative approvals from Engineering pending posting bonds on August 30, 2005. There were some emails back and forth with regards to plat since then. In October, we have all tentative approvals pending posting bonds. This was the last update we were provided. Klugge told us that the bonds haven't been posted yet. I received a phone call from Yadira on Friday for some clarification on the Final Plat of Orchard Estates. All I had to do was change the development rights for TMP 103 -9 (the 2 little parcels noted as P and Q within Lot 10) to 3 development rights. That is because those tracts are a little over 6 acres each and by right they can't be divided into parcels less than 2 acres each. Besides that once the bonds are posted we will have Final Plat approval. Have a great week, Thanks, Rob
