Subject: SUB202000220 TMP 109-45 & 47E — Boundary Line Adjustment (BLA)
The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County Code.]
1. [ 14-302(A)(9), 4.2] Building site. Per our phone conversation earlier today, it is not clear whether TNT 109-45, either the
original or revised parcel, meets the building site requirements described in Sec. 18-4.2. If, after your review, it is found that
this parcel does not meet the building site requirements — due to setbacks, critical slope areas etc. — please revise Note 10
and include the following statement concerning TNT 109-45: "Existing and revised Tax Map Parcel 109-45 do not contain a
building site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance."
2. [14-309, 14416] Soils reports. As these lots are less than five (5) acres in size, please provide percolation tests or other
methods of soil evaluation for review/approval by the Virginia Department of Health (VDH). Feel free to contact VDH
regarding specific materials that would be acceptable for their review/approval.
3. [14-400, 10.4] Setbacks. In Sec. 18-10.4, Albemarle County Code requires a 75ft front setback for Rural Area properties
fronting existing public roads while Rural Area properties fronting an internal or private road is 25ft. Thus, the front setback
from the gravel road depicted on the plat would be 25ft for TNT 109-45 and for TNT 109-47E, the front setback would
depend on the termination point of the prescriptive easement for Murrays Lane. Review and revise Sheet 2 and Note 6 on
Sheet 1 accordingly.
4. [14-302(B)(7)] Watershed. The subject properties do not lie in the Upper Mechums River water supply watershed. Instead,
the parcels lie in the South Fork Hardware River watershed which is not a water supply watershed. Revise Note 7 to identify
the watershed and state that this is not a water supply watershed.
5. [14-302(A)(3)] Prescriptive easement. Provide a recording instrument for the prescriptive easement for Murrays Lane.
6. [14-421] Monuments. Install an additional IS/IF at the new, eastern rear property comer.
7. [Comment] Bearing distance. Per our phone conversation earlier today, please include on the plat map a total length for the
revised rear boundary line for TNT 109-47E. It is currently unclear as to whether the 6ft length for L5 is included in the
larger 174.73' length of the rear property line or not.
8. [14-302(B)(6)] Tax map and parcel. Include in at least one place on the plat, the full, unabbreviated tax map and parcel
numbers for the subject properties. Staff recommends including this information on Sheet 1.
9. [14-302(A)(2), 14-301(D)] Vicinity map.
a. The property identified on the vicinity map on Sheet 1 is a neighboring parcel. Revise the map to label or
highlight the subject parcels for this BLA.
b. Provide a north arrow for the vicinity map.
10. [14-303(0)] Signature panel. There are currently two signature panels for the owner of TMP 109-47E. Please remove one.
11. [14-302(B)(1)] Resubmission. Reminder that revised plats must include the original date of drawing and the revision date(s)
of each subsequent version of the plat.
In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to address all
of the requirements within six (6) months after the date of this letter, the application shall be deemed to have been voluntarily
withdrawn by the applicant.
