Anthony Andres 795 Elk Mtn. Road Afton VA 22920 RE: SP 2004-029 Holy Cross Episcopal Church (Sign #28) Tax Map 84 Parcel 61 Dear Rev. Andres: On December 6, 2006, the Albemarle County Board of Supervisors took action on SP 2004-029 Holy Cross Episcopal Church to allow expansion of an existing, non -conforming church to expand the existing fellowship hall by approximately 800 square feet on Tax Map 84 Parcel 61 in the Samuel Miller Magisterial District. This special use permit was approved based on the following conditions: 1. The church's improvements and the scale and location of the improvements shall be developed in general accord with the conceptual plan entitled "Application Plan SP 2004- 29" ," prepared by Lum's Land Surveys, Inc., and dated 11/15/06 (copy on file); 2. There shall be no day care center or private school on site without approval of a separate special use permit; 3. Construction of the proposed addition shall commence within five (5) years of the date of approval of this special use permit or the permit shall expire; and 4. Any new outdoor building and site lighting shall be provided by full cutoff fixtures. The note regarding the current lighting provisions shall be removed from the conceptual plan. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: compliance with conditions of the SPECIAL USE PERMIT; compliance with a SITE PLAN WAIVER: and approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within sixty (60) months from the date of Board approval, it shall be deemed abandoned and the permit SP 2004-029 Holy Cross Episcopal Church Page 2 of 2 December 22, 2006 terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
