1989, by and between JINKS A. MCDANIEL and OLGF.NE S. MCDAN.IEL, his wife,
parties of the first part and DEBORAH SUSAN MUNDIE and CURTIS DANIEL MUNDIE,
her husband, parties of the second part, whose mailing address is Ratite 4, liox
300, Charlottesville, Virginia 22901
W I T N E S S E T H:
That for and in consideration of the natural love and affection of
the parties of the first part for the parties of the second part, Jinks A.
McDaniel and Olgene S. McDaniel, his wife, hereby GIVE, GRANT, BARGAIN and
CONVEY with GENERAL WARRANTY AND ENGLISH COVENANTS OF TITLE unto Deborah Susan
Mundie and Curtis Daniel Mundie, her husband, as tenants by the entirety with
full rights of survivorship as at common law, and not as tenants in common,
all that certain tract or parcel of land in Albemarle County, Va., lying south
of State Route 641, but not adjacent thereto, containing 4.69 acres, more
particularly described as parcel X on a plat of Roger W. Ray, C.L.S., dated
March 15, 1989, attached hereto and made a part hereof. This is a portion of
the property conveyed to Jinks A. McDaniel (erroneously called Jinks S.
McDaniel) and Olgene S. McDaniel, his wife, by deed of J. Randolph Parker,
Special Commissioner, dated January 27, 1988, of record in the Clerk's Office
of the Circuit Court of said County in Deed Book 977, page 512.
Said tract is subject to a 75 foot building set -back line and to
other matters shown on said plat.
There is conveyed herewith a non-exclusive easement of ingress and
egress for the benefit of Parcel X over the thirty foot right of way to State
Route 641, located within the area described as "New 30' R/W" on said plat.
The following restrictions and obligations with respect to the
maintenance of the said thirty foot easement are hereby imposed on all of the
tracts shown on said plat which elect to use said easement.
1. The owners of the tracts using said easement shall pay all costs
of repairs and maintenance to the road which is .located within the limits of.
,raid 30 foot right of way in equal shares, whenever a majority thereof deem
such repairs and maintenance to be necessary. The standard to which the
aforesaid road Is to be maintained is that such road shall be passable by
ordinary passenger vehicles in all. but severe weather and as required by
Section 18-36 of the Albemarle County Code. The owners of the tracts using
said easement shall be liable for the cost of repairs and maintenance of said
road and shall pay to the person or corporation performing such repairs or
maintenance said proportionate share of the costs thereof within thirty (30)
days after a bill for such charges is submitted by the person or corporation
performing such repairs or maintenance.
2. The said easement is not a public road and will not be
maintained by the County of Albemarle, the Commonwealth of Virginia, or any
other public agency.
3. Tax Map 21-30 is subject to the said thirty foot easement for
the benefit of the other parcels, as shown on said attached plat.
This conveyance is subject to all easements, reservations,
restrictions and conditions contained in duly recorded deeds, plats and other
instruments constituting constructive notice in the chain of title to the
above -described property which have not expired by a time limitation contained
therein or otherwise have become ineffective.
Reference is made to the aforesaid deed and plat for a more
particular description of the property conveyed herein and for matters
affecting same.
This deed of gift is exempt from taxation pursuant to Section
58.1-811D of the Code of Virginia.
