Gibson & Steve L. Gibson Route 250 West Ivy, VA 22945 RE: Variance Application, VA-98-04 Tax Map 058A2, Parcel 21 (Sign # 48) Dear Messrs. Roger & Steve Gibson: This letter is to inform you that your variance application, VA-98-04, was heard by the Albemarle County Board of Zoning Appeals on Tuesday, April 7, 1998. The Board ruled (4:1) to grant the variance request subject to the following conditions. 1) This variance is for the canopy requested only. Any further addition or new construction will require a separate variance application. 2) If no site plan is required by the ordinance, then a sketch plan must be reviewed and approved prior to issuance of the building permit. Approval is required from Building Code and Zoning Services and from County Engineering (including referral to Virginia Department of Transportation) to insure safe and convenient internal circulation and sight distance. 3) Prior to issuance of the building permit, a certificate of appropriateness from the Architectural Review Board is required for the canopy design and any proposed lighting of such. This shall include a photometric diagram indicating that all canopy lighting will meet Section 4.12.6.4. 4) The vehicles to be worked on or finished worked on will be parked on the side and not in the front of the building. 5) The variance will expire one (1) year after approval if canopy not constructed. Letter to Roger and Steve Gibson Page 2 April 8, 1998 This approval allows relief from Section 21.7.1 of the Albemarle County Zoning Ordinance for a 30 foot variance to allow a canopy to be constructed over the existing gas pumps and equal with the front property line, a zero variance.
