This determination is based on discussion with the County Attorney regarding the above -noted special permit. It is my determination, that rights have vested in this special permit based on substantial good faith efforts. In accordance with Section 31.2.4.4 the use, structure and activity of the special permit commenced; and therefore, the permit shall not be deemed abandoned. Therefore, those improvements proposed by the special permit but not yet constructed, such as an additional pool, may be built. The Board of Supervisors approved SP-138 Greenbrier -Rutledge Swim Club on October 21, 1971. The proposed expansion included a basketball court, one additional pool, and four tennis courts, along with related picnic area and parking facilities. It is my understanding that the basketball and tennis courts have been constructed. Those improvements proposed and approved with the special permit may be built to an equivalent or smaller scale then the Special permit. Minor amendments which substantially comply with the special permit may be administratively approved. This would include relocation of the new pool, provided that it would be no closer to any property line and it would have no additional adverse impact on adjacent properties or public facilities. The plan amendments would be considered by the Zoning Administrator with recommendation by the Planning staff using the guidelines outlined in Section 32.3.8 for administrative site plan amendment.
