To Whom it May Concern:
In response to a request for a Letter of Zoning Compliance for the above -referenced Property,
please be advised of the following:
• The Property is zoned R-6, Residential. The permitted uses of the Property are provided
in Section 16 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The
Property is located in the Entrance Corridor Overlay District (EC) and Airport Impact
Area (AIA), and the Steep Slopes Overlay Districts as described in Section 30 of the
Zoning Ordinance.
An assisted living facility or skilled nursing facility is allowed in the R-6 zoning district by
Special Use Permit. SP1985-004 was approved with conditions on March 20, 1985, to
allow a 120-bed nursing home facility. This use is the same as what is now identified in
the Zoning Ordinance as an assisted living facility or skilled nursing facility. A copy of
the approval letter with conditions is linked. The Property complies with zoning
district regulations.
• According to the County's property records, the building was constructed in 1987. The
site was developed under SDP1986-00028, which was approved for 120 beds served by
116 spaces. A minor amendment, SDP1995-00056, was approved for a dining hall
addition. The Property was built per the approved site plans.
• The off -site sign is subject to a Special Use Permit, SP2009-00005, which was heard
and granted by the Board of Zoning Appeals on April 7, 2009. The Property complies
with the sign ordinance.
• There are no applications for a special use permit, zoning map amendment, special
exception, or variance pending approval on the Property.
• In the event of a casualty, in whole or in part, the structure located on the Property may
be built in its current form subject to the approval of a building permit and applicable site
plans and building code.

• This office has no record of any open building or zoning violations for the Property. This
office does not keep track of Fire Code violations. You can reach the Fire and Rescue

• There is no evidence in the County's electronic records of a Certificate of Occupancy for
the Property. The absence of a Certificate of Occupancy for the Property will not give
rise to any enforcement action. Further questions regarding Certificate of Occupancy
may be addressed to the County Building Official, Michael Dellinger,
mdellinger(a)albemarle.org. There may be older records available; please contact the
Records Manager for any relevant records not provided with the provided links.
• Copies of any relevant records may be obtained via the noted links or by using the
Community Development Department Records Public Access link below. If unable to
find the records then a request through the department's Records Manager, Paul
Bjornsen, at pbiornsen(a)albemarle.org may be made. If the request is not based in
Virginia, it will take longer to fulfill.
