Shortly thereafter we met to discuss the construction. It was the County's understanding from that meeting, that the construction would be completed by the end of 2006. However, to -date no construction has occurred to connect White Gables to the Kenridge project located to the west. It was stated during our meeting last year that the construction of the connector road on the White Gables property needed to be coordinated with the Kenridge development. The Kenridge development has been approved and they have begun construction of the road that will connect to White Gables. Therefore, coordination is now possible. You are hereby on notice that the County is now requiring [in accord with condition 4 of SP 2002 -23 (see language below)] you to construct the road connecting to Kenridge property, known as Tax Map 67, Parcel 27. You have submitted a site plan that shows this connection. (This plan is referred to as SDP 2007 -006 White Gables (Phase 4) — Major Amendment.) We expect construction of the connector road within the following timeline: The Major Amendment will likely be approved on March 20, 2007 if all necessary submittals and revisions are made. No later than 14 days following approval of SDP 2007 -006, submit as site plan phase 1 the construction of the connector road to Tax Map 67, Parcel 27 and the modification of the entrance to a right - in/right -out design (this will be discussed in more detail below). We expect you to diligently pursue approval of the phase 1 plan. Approval of the phase 1 plan should occur within 30 days of its submittal if it is complete. Within 90 days of the approval of the phase 1 plan, construction shall begin on the connector road and modified entrance with completion. Based on this schedule, construction of the connector road and modified entrance should be completed no later than August 1, 2007. The County is now also requiring in accord with condition 6 of SP 2002 -23 (see language below) and in accord with the resolution approved by the Board of Supervisors on January 10, 2007 (copy attached) that the entrance to White Gables be converted a right in/right out only entrance and exit. This entrance modification shall also be constructed no later than August 1, 2007. The County will not allow bonding of these improvements as a condition of occupancy of the improvements shown on SDP 2007 -006 White Gables (Phase 4) — Major Amendment. It is our expectation that these improvements (the connector road and the entrance modification) begin and be completed as quickly as can be practically achieved. If this does not occur, we will turn this over to the County Attorney's office for legal proceedings. All roads on the property connecting to adjacent properties as shown on the Conceptual Plan shall be constructed by the applicant to an urban section standard, with a minimum width of twenty (20) feet, final width to be determined at the time of final site plan approval by the Director of Engineering and Public Works. All roads connecting to adjacent properties shall include a sidewalk or other appropriate pedestrian path along one side, constructed to a standard acceptable to the Departments of Planning and Engineering and Public Works, providing a connection to the public sidewalk at Ivy Road. 6. Should a consolidated entrance be located at a point west of the White Gables property in the future, an access easement shall be provided on the property for traffic from the National Legal Research Group property (Tax Map 60, Parcel 25) across the White Gables property, and this access shall be reserved on the final subdivision plat/site plan. This access shall be constructed by the applicant to the same standard as required in Condition 4. In the event that such consolidated entrance is provided, either the Virginia Department of Transportation ( "VDOT ") or the County's Director of Engineering may require the applicant to close the existing entrance shown on the Conceptual Plan, convert it to a right in/right out only entrance /exit, or require that other modifications be made to the entrance. RESOLUTION REQUESTING THAT THE VIRGINIA DEPARTMENT OF TRANSPORTATION APPROVE AN ENTRANCE PERMIT FOR A RIGHT -IN /RIGHT -OUT ONLY ENTRANCE AND EXIT DESIGN FOR THE EXISTING ENTRANCE TO THE WHITE GABLES DEVELOPMENT WHEREAS, the White Gables development (Tax Map 60, Parcels 26 and 27A) is located on Route 250 West and it has an existing entrance (hereinafter, the "Existing Entrance ") that preceded the approval of the White Gables development; and WHEREAS, one of the conditions of approval of the special use permit for the White Gables development provides that if a consolidated entrance is established that will provide an entrance from Route 250 West to both the White Gables development and the development to the west (now known as the Kenridge development), either the Virginia Department of Transportation or the County Engineer could require the White Gables developer to close the Existing Entrance, convert it to a right -in /right -out only entrance and exit, or require that other modifications be made to the Existing Entrance; and WHEREAS, a consolidated entrance as described herein has been constructed in conjunction with the Kenridge development; and WHEREAS, the County Engineer recommends that the Existing Entrance be converted to a rightin /right -out only entrance and exit. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors requests the Virginia Department of Transportation approve an entrance permit for a right -in /right -out only entrance and exit design for the Existing Entrance to the White Gables development.
