The County of Albemarle Planning Division will grant or recommend approval of the Plat referenced above once the
following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. 114-303(D)1 TMP 126-12A appears to be part of this boundary line vacation plat. Specifically, it appears to be
added to TMP 126-21D4. If this is the case please add it to the descriptions in note #4, note #8, and add an account
of the acreage of this lot. Also, be aware that once this 0.37 acre lot (IMP 126-12A) is added to the largerparcel
it will not be eligible to be subdivided back to its current size and shape.
2. 114-303(D)1 TMP 126-21E4 contains a noncontiguous portion of land that is near Damon Road. Revise the plat to
provide an accounting of the acreage remaining in this lot after the vacation (11.231 acres based on the exhibit).
3. 114-303(E)1 On the plat provide the following note: "The proposed 50' easementfor ingress/egress purposes is
not an approved private street by the County ofAlbemarle ". Also, list the easement holders.
4. 1114-302(A)14, 14-303(D), 14-302(A)14, 14-4281 The plat appears to dedicate public right away along the
frontage of the TMP 126-21 D5. If this is your intent, please revise the plat to account of the acreage of the
dedication and clearly depict the dedicated area. Also, revise note #5 as follows: "15' Wide Public Right-of-way
Area Hereby Dedicated to the County ofAlbemarle for Public Use. "
5. 114-302(A)14, 14-4281 Prior to final plat approval VDOT shall approve the plat. This shall include review of the
dedication and the entrance location of the 50' easement for ingress/egress.
6. 114-302(A)101 On the plat provide a note that references ` LOD2017-8, which documents development rights for
the lots ". Also, revised the development rights notes on the plat as follows (acreages may be slightly different
once you subtract acreage for the public r/w dedication):
A) TMP 126-21D4 (4.863 acres) contains 2 development rights
B) TMP 126-21E4 (5.020 acres) contains 1 development right. The noncontiguous portion of TMP 126-21E4
(11.231 acres) contains 3 development rights
C) TMP 126-12A (0.37 acres) contains 1 development ri¢Jrt
The total development rights contained in the new 10.253 acre parcel is 4 development rights
D) TMP 126-21D5 (23.798 acres) contains 5 development rights
7. 114-302(B)51 Label the zoning of the properties as Rural Areas (RA).
8. 114-302(B)51 Revise the district notation for this property, as it is located in the Samuel Miller District, rather than
the Scottsville District.
9. 114-302(A)91 Revise and provide the following note: `Parcel [letter or number] and the residue of Tax
Map/Parcel [numbers] each contain a building site that complies with section 4.2.1 of the Albemarle County
Zoning Ordinance. ".
10. 114-302(B)71 Provide the following note: "This land is not within an Albemarle County and/or City of
Charlottesville water supply watershed nor is it located in an agricultural forestal district. "
11. 114-302(A)21 The vicinity map shall beat a scale of one (1) inch equal to two thousand (2,000) feet. Revise.
12. 114-303(B)Ol Remove the notation "Preliminary" from the subdivision agent's signature block.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept
up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be
found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14-229(B) of
Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within
six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the
