Dear Mr. Strickland:
The Board of Supervisors approved your rezoning application on February 14, 2007. Your rezoning of 69
acres from R2 to NMD (Neighborhood Model District) was approved in accordance with the Code of
Development (for NMD) dated February 5, 2007 and the attached proffers, also dated February 5, 2007.
An application plan/plan of development dated September 4, 2006, revised January 23, 2007 was
approved as part of the rezoning. Please refer to these documents for any future applications and requests
on this property.
Please be advised that although the Albemarle County Board of Supervisors took action on the
project noted above, no uses on the property as approved above may lawfully begin until all
applicable approvals have been received and conditions have been met. This includes:
compliance with applicable PROFFERS;
compliance with requirements of the CODE OF DEVELOPMENT;
approval of and compliance with a SITE PLAN; and
approval of a ZONING COMPLIANCE CLEARANCE.

RESOLUTION TO APPROVE SPECIAL EXCEPTION
FOR ZMA 2005-007, HADEN PLACE
WHEREAS, Haden Place, LLC (the "Owner") is the owner of Tax Map and Parcel Numbers
055FO-14-OB-02900, 055FO-14-OB-03000, 055FO-14-OB-03100, 055FO-14-OB-03200, 055FO-14-OB-03300,
and 055FO-14-OB-03400; and
WHEREAS, the Owner filed a request for a special exception to vary the Application Plan and Code
of Development approved in conjunction with ZMA 2005-007, Haden Place, to permit decks and porches on
Lots 29 tluough 34 in Block B of the development to encroach ten (10) feet into the rear setback.
. NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the foregoing, the executive
summary prepared in conjunction with the special exception request, staff's supporting analysis included in
the executive summary and the attachments thereto, and all of the factors relevant to the special exceptions in
Albemarle County Code §§ 18-8.5.5.3(c) and 18-33.9, the Albemarle County Board of Supervisors hereby
approves the special exception to vary the Application Plan and Code of Development approved in
conjunction with ZMA 2005-007, Haden Place, as described hereinabove.
I, Ella W. Jordan, do hereby certify that the foregoing writing is a true, correct copy of a Resolution duly
adopted by the Board of Supervisors of Albemarle County, Virginia, by a vote of six to zero, as recorded
below, at a regular meeting held on July 8, 2015.
