The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1. [14-400, 10.4, 6.4] Minimum lot requirements. Parcels zoned "Rural Areas" are required to have a minimum lot size of 2.0 acres. As the subject parcels are currently both less than 2.0 acres, they are considered "existing nonconforming". Per 18- 6.4(E), the County cannot approve a boundary line adjustment that would further increase the nonconforming lot sizes of either parcel. Therefore, the plat must be revised such that the resulting lot size of each parcel does not decrease. This can be done through an even exchange of land area between parcels. Please see 18-6.4(E) for more information regarding boundary line adjustments between nonconforming lots. 2. [14-309, 14416] Soils reports. As these lots are less than five (5) acres in size, please provide percolation tests or other methods of soil evaluation. These soil reports will be forwarded to the Virginia Department of Health (VDH) for their review/approval. 3. [14-302(B)(5)] Zoning overlay. Include with Note 3A, that the both TMP 59B-OB-9 and TMP 59B-OB-10 lie within the Entrance Corridor Overlay District. 4. [ 14-302(A)(10)] Development rights. The plat must identify the number of development rights assigned to each parcel. The plat must also contain the following note for each parcel: "Parcel [letter or number] is assigned [number] development rights and may not be further divided." Please separate these notes from the Zoning notes. (Note: Each of the subject parcels has 1 development right.) 5. [14-302(A)(9), 4.2] Buildingsite. Based on the criteria for a building site contained in Sec. 18-4.2, it does not appear that the original nor revised parcels for TMP 59B-OB-9 and TNT 59B-OB-10 contain a building site. As such, please include a note on the plat stating: "Existing and revised tax map parcels TMP 59B-OB-9 and TNT 59B-OB-10 do not contain a building site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance." 6. [Comment] Watershed. Please revise Note 3B to more clearly state the following: "The Parcels lie within the Ivy Creek Water Supply Watershed... ". 7. [Comment] Streets. Since no streets are being created by this plat, please remove Note 3C. 8. [14-302(B)(7)] Tax map parcel numbers. Provide the unabbreviated tax map parcel numbers for the subject properties in at least one place on the plat. 9. [ 14-302(A)(3)] Private street access. Provide the deed book and page for the instrument that recorded Kearsarge Circle. 10. [Comment] Subdivision application number. Subdivision application numbers are not required to be noted on plats, however, if you wish to include this information on the plat, the project number is SUB202000221. 11. [14-302(B)(1)] Resubmission. Reminder that revised plats must include the original date of drawing and the revision date(s) of each subsequent version of the plat. In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have been voluntarily withdrawn by the applicant.
