Subject: SUB202000217 Ronald Gilbert - Family Division
The County of Albemarle Division of Current Development will grant or recommend approval of the Family
Subdivision plat referenced above once the following comments have been addressed: [Each comment is preceded
by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
[County Policy] For parcels that do not contain a development right in Albemarle County and are below 21
acres in Albemarle provide the following note on the plat: "That portion ofany such lot lying within Albemarle
County, is subject to Albemarle County Zoning and Subdivision laws, and if any effort is later made to divide
the property along the county line, then the lot which would lie within Albemarle County will have to meet all
Albemarle County Zoning and Subdivision regulations, and if it does not do so, it will not be eligible for any
development or buildingpermits. "
2. 114-212(C), 14-3161 Approval ofentrance onto public streets. Prior to final plat approval submit documentation
from VDOT that the entrance along State Rte. 622 complies with their standards for the number of lots served
by the entrance. Please provide this documentation.
3. [14-212(B)(2)] Conditions ofapproval. The affidavit currently only lists TMP 131-25. Please revise this
document to also list TMP 131-25E.
4. [14-212(B)] Conditions of approval. The subdivider shall place a restrictive covenant on the lots created by the
family subdivision. A template for this covenant is attached. Please utilize the template and submit the
completed affidavit. County Attorney approval is required prior to final plat approval.
5. [Recommendation] Instrument evidencing maintenance ofcertain improvements. It is recommended a private
street maintenance agreement be provided for the proposed private street. A template for this agreement is
attached. Please utilize the template and submit the completed agreement.
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and
may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14,
if the subdivider fails to submit a revised plat to address all of the requirements within six (6) months after the date
of this letter, then the application shall be deemed voluntarily withdrawn. Please contact Christopher Perez at the
