Dear Property Owner:
This letter is to notify you as an adjoining property owner to property owned by Mark Slezak and Kirsten
Gelsdorf that a special exception application has been submitted for a homestay. The application is as
follows:
PROJECT: SE202000025 Break Heart Studio
PROPOSED: Request to reduce the required 125-foot setback from side and rear property lines for a
proposed homestay use.
ZONING CATEGORY/GENERAL USAGE: RA Rural Areas
SECTION: 18-5.1.480)(1)(v)
COMPREHENSIVE PLAN LAND USE/DENSITY: RA Rural Areas — agricultural, forestal, and fishery
uses; residential uses at a density of 0.5 dwelling units/acre in development lots.
LOCATION: 5525 Break Heart Road
TAX MAP/PARCEL: 02600-00-00-020BO
MAGISTERIAL DISTRICT: White Hall
This petition will be reviewed at the ALBEMARLE COUNTY BOARD OF SUPERVISORS
MEETING ON WEDNESDAY, MARCH 17, 2021. Please be advised that due to the Covid-19
pandemic and efforts to maintain recommended social distancing, this will be a virtual meeting of the
Board of Supervisors.
Special exceptions must be acted on by the Board of Supervisors, and may be granted after notice to
abutting property owners and upon consideration of the following:
i. There is no detriment to any abutting lot
ii. There is no harm to public health, safety, or welfare
If you have comments or concerns regarding this application, please provide them to Rebecca Ragsdale
by MONDAY, FEBRUARY 15, 2021 so that they can be included in the Board's information packet and
so the item can be scheduled appropriately for the Board's consideration. Homestay special exceptions
may be scheduled on the Board's agenda in one of two ways:
1. If no neighbor concerns are received, the item will be placed on the Consent Agenda for approval.
There is no staff presentation or Board discussion prior to Board approval for Consent Agenda
Items.
2. If neighbor concerns are received, the item will be listed as an Action item on the agenda. There
is a staff presentation and Board discussion prior to Board approval or denial for Action Items.
You may also provide comments on the item during the meeting under Other Matters From the Public.
