To Whom it May Concern:
In response to a request for a Letter of Zoning Compliance for the above -referenced Property,
please be advised of the following:
The Property is zoned Planned Development -Mixed Commercial per Zoning Map
Amendment (ZMA) ZMA200100020, approved August 6, 2003 with proffers. The
permitted uses of the Property are provided in the Code of Development, last revised
December 18, 2019, which was approved alongside ZMA201700005 on January 15,
2020 with proffers. The Property is subject to the Airport Impact Area and Entrance
Corridor Overlay Districts as described in Section 30 of the Zoning Ordinance.
There is an approved Initial Site Plan associated with the Property, SDP202000034.
These plans were approved on June 5, 2020. A Final Site Plan for the Property,
SDP202000063, is currently under review.
• The applicable proffers that apply to the Property can be viewed in the documents,
linked below, for ZMA201700005. It appears proffers 2(F.) and 6 are not fully satisfied.
The Property is located within Block II of the approved Application Plan and Code of
Development, most recently revised and approved alongside ZMA201700005. "Table A
— Uses Table" of the Code of Development outlines a minimum of 0 dwelling units, a
maximum of 130 dwelling units, a minimum of 0 non-residential square footage, a
maximum of 58,000 non-residential square footage (not including the 95,000 permitted
for a hotel), and a maximum of 50,000 retail square footage in Block II.
• The Code of Development describes that 15% of the total residential dwelling units in
Block II shall be affordable dwelling units.
• This office has no record of any open building or zoning violations for the Property.
• Copies of any relevant records may be obtained via the noted links or by using the
Community Development Department Records Public Access link below. If unable to
find the records then a request through the department's Records Manager, Paul
