This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final site plan for all or a portion of the site within one (1) year after the date of this letter as provided in section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final site plan. In accordance with Chapter 18 Section 32.4.2.8 Early or Mass Grading may be permitted after the following approvals are received: 1. Engineering approval of a V SMP plan meeting the requirements of Chapter 17 of the Code of the County of Albemarle. 2. Approval of all easements for facilities for stormwater management and drainage control. The final site plan will not be considered to have been officially submitted until the following items are received: 1. A final site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code. 2. Applicable fee. See Sec. 35.1. Please submit digital copies of the final plans as well as two (2) paper copies to the Community Development Department. The assigned Lead Reviewer will then distribute the plans to all reviewing agencies. Once you receive the first set of comments on the final site plan, please work with each reviewer individually to satisfy their requirements. [Comment] Development in stream buffers. Staff recommends reducing the encroachment of proposed residential lots into stream buffer areas wherever possible. 2. [Comment] Spacing. Staff recommends providing as much space as possible between the walkways/front porches of Lots 12, 13, and the eight (8) foot access easement to avoid undesirable conflicts between residents and trail users. 3. [32.5.2(n)] Retaining walls. a. Since the proposed retaining wall between Lots 19-22 and the recreation area crosses a property line - to lie on a portion Lot 26 - a retaining wall easement will be needed for this feature. b. Is a retaining wall proposed at the entrance to the tot lot? Please label this feature and provide all relevant information. "Note: The tot lot will need to be ADA accessible. 4. [32.5.2(a)] Zoning notes. Include in the zoning notes that a sidewalk modification for Indigo Road was approved by the Planning Commission on June 16, 2020 with conditions. The Action Letter is attached with the condition of approval also provided below. "The locations of sidewalks for the Foothill Crossing Phase V development must be in general accord with the sidewalk locations as shown on the plans entitled "Foothill Crossing Phase V - Road Plans, SUB2020-00021," which were prepared by Collins Engineering and are last dated March 30, 2020." 5. [32.5.2(b)] Proposed density. Update the "Proposed Density" calculation to reference 35 units instead of the previous 31 units. 6. [32.5.2(n)] Unit type/layout. Staff acknowledges that the proposed unit type for this development has changed. Please update the inset unit type layout provided on the Site Plan accordingly and provide a typical building footprint measurement. 7. [32.5.2(n)] Driveways. Some driveways appear to cross property boundaries, for example Lots 26 and 31. Revise the plan so these aspects are restricted to the lots they serve. 8. [32.5.2(m), 32.5.2(i)] Emergency access road/easement. Consider making this emergency access easement public to allow bike and pedestrian access. 9. [32.5.2(i)] Future greemvay easement. The Existing Conditions sheet indicates that a portion of the northwest comer of this property will be within a future greenway easement area. Please provide an easement for this area with the plans/plats currently in review OR revise/remove this area from the plans. 10. [32.5.2(i)] Typical road cross-section. Provide a typical cross-section and measurement for areas where on -street parking is proposed, for both Indigo Rd and Crimson St. 11. [32.5.2(a)] Abutting property information. On the Existing Conditions sheet, label the tax map and parcel number, name of the owner, zoning district, and present uses of abutting parcel TMP 56-57132. 12. [32.5.2(d)] Wooded areas. Identify whether existing and preserved tree areas are composed of evergreen, deciduous, or a mix of type. This comment applies to both the Existing Conditions and Landscape Plan sheets. 13. [32.5.2(a)] Sheet labels. Revise the sheet index list provided on the Cover Sheet to reflect individual sheet names. Not all of the sheet names currently align with the index list. 14. [Comment] Labels. a. The "Proposed Retaining Wall" label on Lot 29 of the Site Plan Sheet notes that the retaining wall design is provided on Sheet 5. However, no design specification was provided on Sheet 5. Please update this reference accordingly. b. There appears to be a disconnected ten (10) foot building separation label on Lot 22 (5' S'). Please review and revise accordingly c. Ensure there are no overlapping labels, particularly on the Grading and Drainage Plan sheet. For example, it is difficult to clearly read several of the proposed contour labels on this sheet. 15. [32.5.2(i)] Easements. Easements needed to facilitate this development must be recorded and noted on the final site plan prior to final site plan approval. It appears many placeholders have already been included in the plan sets. Staff anticipates this information will be provided once it is known. 16. [32.7.9] Landscape plan. For the final site plan: a. It seems the Botanical and Common Names for trees may have been switched for some of the prescribed tree species. Please review and revise accordingly. b. The landscape plan map shows 55 Quercus Palustris (Pin Oak) street trees. Providing potential plan changes due to Comment 17, below, please update the proposed street trees for the development as well as individual street frontages. c. Similarly, update the planting schedule as well as the plan map label for the Pin Oaks accordingly. d. Please revise the tree canopy calculations such that the required canopy is based on 5.842 acres. e. There appears to be some issues concerning the tree canopy calculation. Specifically, in regards to the "Stream Buffer Area". Since this has been an issue in previous plan submittals (SDP202000013), please work with staff on how this requirement is met. Staff may have some options. 17. [32.5.2(i)] Landscape easements. For the final site plan, expand the six (6) foot landscaping easement to capture all required street trees, or remove the trees that fall outside the easement area due to conflicts with proposed utilities. 18. [4.16] Recreation area. Will mulch from the tot lot extend past the proposed chain fence and retaining wall?
