Thank you for your comments dated August 13, 2020 on the above referenced project. The following is a summary of how the
comments have been addressed:
Planning Comments:
1. The supplemental plan sheets have been updated and resubmitted with the final subdivision plat as requested for
approvals.
2. Jackson Lane Special Exception request has been approved by the Board of Supervisors. The approval date is noted on the
supplemental plan sheets, sheet 1.
3. Same Comment response as Comment rig.
4. See comment responses below:
a. The request for the open space to be dedicated to Albemarle County has been submitted with this resubmittal.
b. The deed of dedication will be submitted, as soon as the owners have determined if the development will be
part of the Old Trail HOA or a separate HOA.
5. A special exception request is attached for the double frontage lots for Phase I, Lots 1-3. The landscaping requirements
have been added to the supplemental sheets, and the 20' buffer easement is shown on the subdivision plat.
6. This comment is addressed with Note #14 on the subdivision plat. The responsibility of the private easements will either
be the Old Trail HOA or a separate HOA. The determination has not be made yet.
7. The easement deed book and page reference for these (2) easements have been updated on the subdivision plat, as
requested, and the supplemental sheets.
8. The deed of dedication will be submitted, as soon as the owners have determined if the development will be part of the
Old Trail HOA or a separate HOA for all of these easements.
9. The right of way on the plat and plans have been updated to include the sidewalk within the right-of-way, as requested.
10. See comment responses below:
a. As noted above in previous comment responses, the right of way has been updated to include the sidewalks.
b. The planting strip is fully located within the ROW.
c. The cul-de-sac meets the requirements from Fire/Rescue for a smaller diameter. This has not been changed, as
it meets the design requirements.
d. The street sections have been updated on the supplemental sheets for the changes to the ROW.
e. This is shown and labeled on the supplemental sheets and the plat.
11. The ROW is a variable width right of way, as shown on the plat.
12. See comment responses below:
a. The plat has been updated to include the owner of this property.
b. The supplemental sheets have been updated to match the subdivision plat.
c. The information on the property owner has been added to the subdivision plat and supplemental plan sheets.
d. The dedication of this area to ROW has been added to the summary charts on both the subdivision plat and the
supplemental plan sheets.
13. The deed book and page number has been provided under the site data, as requested.
14. Currently, this 15' strip of land is a prescriptive right of way, which was established by the Byrd Road Act of 1932 by the
Virginia General Assembly. The purpose of this plat is to take a prescriptive right of way and dedicate it as a fee -simple
right of way. This strip of land is currently being used as a road and is unusable otherwise.
15. See comment responses below:
a. An agreement will be provided, as soon as the owners have determined if the development will be part of the
Old Trail HOA or a separate HOA for all of these easements.
b. VDOT approval is part of the road plans.
c. All sidewalks and trees are required to be maintained by the HOA, and this will be part of the agreement.
d. The deed book and page has been updated on the plat and plans.
16. Jackson Lane road name is correct and the plans have been updated.
17. The lot lines have been updated accordingly to ensure the setbacks and minimum areas have been achieved.
18. The setbacks on the plans and plat have been updated, as requested.
19. The property line measurement has been provided and updated on all cul-de-sac lots.
20. The lot requirements have been added to the plat, as requested.
21. As noted in comment #19 response, this has been done.
22. All existing easements have been re -checked and the plans have been updated to match the plat.
23. The engineering comments have been addressed on the easements. These are existing easements.
24. The temporary trail easements have been added to the plat, as requested.
25. The trailway is a primitive trail, and does not require grading and improvements. No offsite construction easements are
necessary for the installation of this trailway on the existing County open space parcels.
26. All agreement will be provided, as soon as the owners have determined if the development will be part of the Old Trail
HOA or a separate HOA for all of these easements.
27. The information on the existing conditions sheet of the Supplemental plan sheets have been updated.
28. The easement labels have been updated and coordinated between the plat and supplemental sheets.
29. The supplemental sheets have been updated to show the vegetation within the buffer area. All agreement will be
provided, as soon as the owners have determined if the development will be part of the Old Trail HOA or a separate HOA
for all of these easements.

31. All drainage easements and SWM easements are existing for this development. No additional easements are required.
The DB/PG has been added to the plat for the existing drainage easements.
32. The older plat has an error in the curve chart and therefore it was impossible to match exactly. Every effort was made to
match the intent of the older plat.
33. These notes have been removed from the plat.
34. This note has been removed from the plat.
35. This note has been added to the plat, see note 20 on the cover sheet.
36. The legend on the plat has been added, and note #4 on the cover sheet has been updated.
37. Note #11 has been updated and note #12 has been added to the plat.
38. As previously noted in the comment responses, the ROW was established by the Byrd Road Act of 1932 by the Virginia
General Assembly.
39. The location of the existing building locations have been shown on the plat and supplemental sheets.
40. This is acknowledged, road plans are under review.
41. This note has been added to the plans and on the plat with note #10.
42. A revision date has been added to the plans and plat.
43. This is acknowledged.

Engineering Comments:
1. It is acknowledged that the road improvements must be approved and built or bonded prior to plat recordation.
2. The ROW has been adjusted for the new proposed right of way, incorporating the sidewalk and planting strips into the
right of way for the roadways.
3. As noted on the supplemental plan sheets, the beginning stationing is labeled on the grading and utility plan and profile
sheet 4.
4. The existing easements have been added to sheets 3 and 4.
5. A deed will be submitted for the easements once the owner has determined if the development will be part of the Old
Trail HOA or will have a separate HOA.
Parks & Recreation Comments:
1. The owner of the open spaces have been updated on the plat, as requested.
RWSA and ACSA Comments:
1. The sewer flow request will be submitted with the road and utility plans.
2. Road and utility plans are under review
VDOT Comments:
1. The road plans are under review for approval.
2. The right of way is labeled to be dedicated to Albemarle County.
Building Comments:
1. The 3 building notes have been added to the supplemental plan sheets, as requested.
