To Whom it May Concern:
In response to a request for a Letter of Zoning Compliance for the above -referenced Property,
please be advised of the following:
• The Property is zoned Light Industrial, LI, per ZMA1986-00009 approved 12/17/1986
with proffers. The Property's permitted uses are provided in Section 26 of Chapter 18 of
the Albemarle County Code ("Zoning Ordinance"), with some uses excluded per the
accepted proffers. The Property is subject to the Entrance Corridor Overlay District (EC)
and the Steep Slopes Overlay Districts described in Section 30 of the Zoning Ordinance.
The Property was initially developed per SDP1990-00106, approved 02/13/1992. The
only approved improvement on the Property is the access road to Tax Map 78 Parcel
49C.
The site plan approved 05/19/2007, SDP2007-00116 Hunters Hall Final is on Parcel 49D
and is no longer a valid site plan. Parcel 49D was never developed within the initial five
years after the final approval date nor within the Commonwealth of Virginia's approval
extensions up to July 1, 2020. Any proposed development of the Property must be
reviewed through the County's site plan review process before any building permits may
be issued.
This office has no record of any open zoning violations for the Property. That said, there
appears to be development on the Property that has never been approved with a site
plan by Albemarle County. There appears to be a structure, parking, and tree removal
on the Property. This is more than likely a violation of the Zoning regulations and will be
logged into our system and investigated and followed up with the property owner.
• The proposed use described as earth -moving and related heavy equipment rental, sales,
and service may be permitted with a Special Use Permit granted by the Board of
Supervisors as a "Heavy equipment and heavy vehicle parking and storage yard" per the
zoning ordinance regulations provided in Section 26. As noted above, new development
must obtain initial and final site plan approval and applicable water protection and

architectural review board approval before obtaining any building permits. Also, note that
there are many other applicable requirements for uses in the LI zoning district and the
EC.
• Copies of any relevant records may be obtained via the noted links or by using the
Community Development Department Records Public Access link below. If unable to
find the records, then a request through the department's Records Manager, Paul
Bjornsen, at pbiornsen(a)albemarle.org may be made. If the request is not based in
Virginia, it will take longer to fulfill.
