I have not reviewed the notes, that will come once its under review. For the most part if the notes are the same as the last approved plat we should be good with the addition of the private street notes in Section 14 of the subdivision ordinance. As mentioned in the email below this is only one aspect of the plan to facilitate the approval of the private street (see email for all items that need to be submitted). Also, if you would like to withdraw the plat of correction that was previously submitted just let me know in an email, or if no activity takes place on it for 6 months it will be withdrawn automatically. PI vacates the entire R/W width and adds it to TMP 31-21A, TMP 31-21A2, and TMP 31-21A3, P2 creates a new 40' private street easement for Drilers Lane. P3 shows the existing and corrected SWM easement so a plat of correction will no longer be necessary. If this looks like it will work I will submit the application, fee, and other documents. Principal 434-882-0121 www.meridianwbe.com Meridian Planning Group From: Christopher Perez <cperez@albemarle.org> Sent: Thursday, January 28, 20214:59 PM To: dffosterwell@email.com; Tim Miller <tmiller@meridianwbe.com> Cc: Frank Pohl <fpohl@albemarle.org> Subject: Drillers Lane - from public to private Mr. Foster and Mr. Miller, In order to facilitate your proposal to turn Drillers Lane into a private road you will need to submit a partial vacation plat of the previously approved plat, which vacates the public right-of-way, adds the land to surrounding parcels, and plats the new private street easement. This will be submitted under Section 14-212.2 (LINK to the application and $258 fee (per section 14-203(Hx6)). The vacation of the public right of way in this fashion will require the consent of all the lot owners associated with lots sold by the division. Thus the owners of TMP 31-21A and TMP 31-21B (417 LLC) and TMP 31-21A2 and TMP 31-21A3 (Foster Well & Pump Co Inc) shall sign the plat agreeing to the vacation. Ifthe proposed vacation does not have the consent of all the lot owners then Board of Supervisors review and action is required. Modifying Drillers Lane to a private road is permissible under Section 14-232(A)2 as this road serves a nonresidential and nonagricultural use and is designed to County Standards for a private street serving nonresidential uses pursuant to Section 14-412(B), which are VDOT standards. You will also need to submit a private street request (LINK to application and $720 fee). The Planning Commission shall review and act on this private street request prior to the plat being approved. This item may be able to go on the consent agenda if staff is recommending approval. Below is a comprehensive list of all applications and fees required with steps in chronological order. I offer the following steps: 1) Applicant shall submit the following: a) The private street request letter seeking authorization of a private street. The letter shall contain all required information of 14-234(C) and 14-232(A). Application and application fee of $720 application fee [Section 14-203(E)(3)]). b) Submit a digital copy of the previously approved road plan (SUB2017-197). No changes to the plan shall take place at this time. c) Submit a partial vacation plat, which vacates the public right of way, adds the land to adjacent lots, and plats the new private street easement, application, and review fee of $258 (per section 14-203(H)(6). d) Private street maintenance agreement (template attached). 2) Planning, Engineering, Fire Rescue, VDOT, and County Attorney shall review all the above required documents for the proposal. 2a) Revisions shall take place as required by the reviewers until the items are approvable. 2b) Once approvable please have all owners sign and notarize the plat and private street maintenance agreement. 3) This item shall be scheduled and go to the PC for the authorization of the private street. If they approve the request, see step 4. 4) The agent approves the plat and the applicant records it and the private maintenance agreement in the Clerk's Office. 5) LOR submittals will be required for all site plans that depict Drillers Lane as a public road. They shall be updated to label the private road. LINK application, $108 fee per LOR. 6) The road plan as built will relabel the road as Private Street and provide the recordation information for the recorded private street easement.
