Tax Map 100, Parcel 24A OFFICIAL DETERMINATION Dear Mr. Hornaday, This letter is to confirm in writing, that which we have discussed by telephone. After consultation with the County Attorney, and review of the files and your submittal of work completed to -date, it is my opinion that this special permit and site plan have been used, and are valid. They remain valid and without any necessity of extension, now or in the future. This fact has been confirmed with the County Attorney. Once all conditions of each approval are met, you may request a zoning clearance to occupy the site and begin the use operation. You note that delays in this business start-up were market -driven. It clearly is not a case of attempting to circumvent the regulations and/or approvals of the County. The special permit was approved, subject to 7 conditions. Of these, several are passive, such as hours of operation, and require no action on the part of the applicant. By your letter of January 27th, all conditions have been met. The condition relating to turn lane construction, #3, is a required site plan improvement. Based on the site plan, the office trailer and handicapped ramp have been located on the property. Several improvements, such as the entrance and the turn lane, are required to be constructed prior to occupancy of the site. Please contact this office, once you are ready to proceed with the plan.
