I have received review comments from all requested parties except VDH. The attached review comments necessitate a
change in your proposal, in both entrance location, critical slope disturbance, and accessway design. The proposal shall be
revised to address all required changes in entrance design, access design and layout, and slope disturbance. Once revised
please resubmit and I'll the revised documents to the various reviewers (VDOT, Engineering, Fire and Rescue, and
Planning) for final review. Once we have everyone's tentative approvals on the new design, I suggest then we schedule
this item for the Planning Commission and subsequently the Board of Supervisors.
At this time it is appropriate for you to defer the project while you revise the plan. Please send me an email requesting a
deferral and to pull the item from the March 23, 2021 PC meeting and the tentatively schedule April 211 BOS meeting.

Dear Mr. Perez:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Shimp Engineering, dated 26
October 2020, and offers the following comments:
1. The proposed entrance should be spaced from the railroad gravel access road according
to Table 2-2 of Appendix F of the Road Design Manual.
2. The proposed entrance should be aligned with the entrance to Ivy Nursery, Inc. (across
Broomley Rd.) as described in Section 4 and shown in Figure 4-6, both of Appendix F of
the Road Design Manual.
3. Note that the final plan must show conformance with the VDOT Road Design Manual
Appendices 13(1) and F, as well as any other applicable standards, regulations or other
requirements.
Please provide a digital copy in PDF format of the revised plan along with a comment response
letter. If further information is desired, please contact Doug McAvoy Jr. at (540) 718-6113.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.

1. A waiver is required for access aisles greater than 10%. It appears the road can be relocated where it enters the existing
improvements to provide a 10% or less maximum grade. Additional exhibits will be needed if the waiver is requested.

2. The entrance will need to meet VDOT standards. It appears to be too far offset from the existing Ivy Nursery entrance.

Review
The critical slope waiver request has been reviewed. The applicant provided field -certified topographic
data, which is more accurate than County GIS data. The engineering analysis of the request follows:
Description of critical slope area and proposed disturbance:
The critical slopes proposed to be impacted were created during the construction of Broomley Road, the
construction of the railroad, the construction of an access road through the parcel for stormwater facilities,
and some that are naturally occurring. The land cover is currently grass and scrub, with some woods. The
applicant proposes critical slope impacts for a secondary access road to the existing improvements.

Exemptions to critical slopes waivers for driveways, roads and utilities without reasonable
alternative locations: The proposed disturbance is not exempt as defined in Section 4.2.6.
Compliance with Zoning Ordinance 18-4.2:
"movement of soil and rock"
The existing slope is stabilized. Proper slope grading, control of drainage, ESC measures, and
vegetative stabilization will minimize movement of soil. However, the area of land disturbance for
option 1 is approximately half the area of option 2. Therefore, option 1 is preferred because less land
disturbance typically results in a lower risk for movement of soil and rock.
"excessive stormwater runoff'
The proposed engineered ditch and swale will control and direct stormwater and stormwater
management will be needed for either option, so no excessive post -development runoff is expected.
"siltation"
The disturbed area is subject to the County's Water Protection Ordinance and erosion and sediment
control measures will be provided in a plan to be used throughout construction. Permanent

stabilization and maintenance will ensure long term stability. For either option, the closest water body
is approximately 600 ft from this project. The area of land disturbance for option 1 is approximately
half the area of disturbance for option 2. Therefore, option 1 is preferred because less land
disturbance typically results in a lower risk for sediment release.
"loss of aesthetic resource"
This area has been previously cleared and graded during the construction of the Broomley Road
Bridge and the construction of a ditch along Broomley Road.
"septic effluent"
There are no septic systems proposed with this project.
Based on the review above, there are no engineering concerns which prohibit the disturbance of the
critical slopes as proposed with either entrance location. However, Engineering's preferred option is
option 1 because of reduced impacts to critical slopes and less land disturbance when compared to option
2. The longitudinal slope of the entranced for option 1 exceeds the maximum allowed (10%) but
lengthening the accessway and averaging the slope throughout its length should address this issue. If the
slope cannot be reduced to 10% maximum for the entire length, engineering would support a waiver to
allow for a slightly steeper accessway in this case in support of reduced critical slope impacts and land
disturbance.

1) Emergency vehicle access requires 25 radius on turns. The plans indicate the entrance from Broomley Road provides this.
but the other end of the access, as it enters/exits the existing property, plan indicates the radius is 10 feet. This must be 25
feet.
2) Emeregncy appartus access requires no greater than a 16 % grade (16% or above, appartus bottoms out). The current plan
complies with this with grades in the submittal ranging from 7.5% to 13% along the route of teh proposed entrance. Any plan
modifications and the "as -built" conditions need to keep this in mind.
