The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302 (A)(3)] Update the label for the existing portion of Fowler Street on Sheet V2 that states the
instrument number for the plat that dedicated the ROW. Rev. 1: Comment addressed.
2. [14-302 (A)(4)] See Engineering comments below. Please show the private access easements for
retaining walls.
a. [14-302 (A)(14)] Per Engineering comments, retaining wall easements will be private. Add a
note stating the size and acreage of the easements, and who will own and maintain them to
Sheet V 1. Rev. 1: Comment stands. see Engineering comments below. Rev. 2: Comment may
be addressed pending confirmation from Engineering Division.
b. [14-317] Provide HOA documents indicating ownership and maintenance responsibilities for
the retaining walls. Rev. 1: Per applicant comment response letter, applicant's attomey is
working on drafting the documents and these will be provided on a future submittal. Rev. 2:
Comment stands. Please update the draft HOA so that all sections are completed and
accurate. For example, on page 1 under "Recitals," please ensure that accurate date is
stated (2021 and not 2020). Also, some easement names stated in the covenants are
inconsistent with the naming of actual easements on plat.
3. [14-302 (A)(4), 14-302 (A)(5)] See Engineering comments below. Show and label all temporary
construction and grading easements and indicate whether they are public or private in the callouts on
Sheet V2. Rev. 1: Comment stands_ see Engineerine comments below. Rev. 2: Comment may be
addressed pending confirmation from Engineering Division.
a. Public easements should include the words "hereby dedicated to public use" in the easement
labels. Rev. 1: Comment addressed.
4. [14-302 (A)(4), 14-302 (A)(5)] Please show the proposed 40' access easement and indicate whether it
will be public or private in the callout on Sheet V2. Rev. 1: Comment addressed.
5. [14-302 (A)(5)] Please indicate whether the new variable width SWM easement is public or private on
Sheet V2.
a. Public easements will require submittal and review of a deed of easement. Please contact
Engineering Division reviewer to confirm that the SWM easement will be public. If so,
Engineering will provide a deed of easement template that should be completed and sent in with
the next plat submittal. Rev. 1: Comment stands. see Engineering comments below. Rev. 2:
Comment may be addressed Pendina confirmation from Enaineerina Division.
b. Public easements should include the words "hereby dedicated to public use" in the easement
labels. Rev. 1: Comment addressed.
c. [14-302 (A)(14)] State the total acreage of the public easement in a note on Sheet VI. Rev. 1:
Comment addressed.
6. [14-302 (A)(11)] Please state the instrument numbers that created the existing Lots 196-201 outside of
Phase 5A which are visible on Sheet V2. Rev. 1: Comment addressed.
7. [14-302 (A)(15)] Per recorded instrument in DB 5088, pages 605-608, TMP 62-16D is subject to a 50'
and 70' wide ingress and egress easement. Show this easement on the plat and add a note stating the
names and addresses of the easement holder. State the recorded instrument number in the easement
label on Sheet V2. Rev. 1: Comment not fully addressed. The plat in DB 875. page 345 identifies TMP
62-16D as "Parcel I." Per the note on that plat, the owners of "Parcels 1-6- will maintain the road in
accordance with other recorded maintenance agreements. Some form of note needs to be added to this
plat stating that TMP 62-16D is subject to the easements recorded in DB 875. page 345. Rev. 2:
Comment addressed.
8. [14-302 (B)(5)] Revise note 7 on Sheet VI as follows:
a. Clearly state that TMP 62G-7-C is zoned NMD Neighborhood Model District and is subject to
the proffers and Code of Development of ZMA200400007. Rev. 1: Comment addressed.
9. [14-302 (B)(5)] Revise note 8 on Sheet VI as follows:
a. State that the portion of TMP 62A3-1 that is zoned NMD Neighborhood Model District is
subject to the proffers and Code of Development of ZMA200400007. Rev. 1: Comment
addressed.
10. [14-302 (B)(5)] Please revise Note 9 on Sheet V 1 as follows:
a. Remove reference to the DBIZ. DBIZ is not an official overlay zoning district and should not
be included in the note. Rev. 1: Comment addressed.
b. TMP 62-16D is not subject to ZMA200400007. Please remove reference to the ZMA in the
note. Rev. 1: Comment addressed.
11. [14-302 (B)(10)] No stream buffers are visible on the plat. Please verify why Note 6 is included on
Sheet VI. Remove if necessary. Rev. 1: Comment addressed.
12. [14-302 (B)(5)] Revise the zoning note on Sheet 1 as follows:
a. Clearly state that TMP 78-20M6 is subject to the proffers and Application Plan of
ZMA200100015. Rev. 1: Comment made in error.
b. State that the property is within the EC Entrance Corridor Overlay District. Rev. 1: Comment
made in error.
13. [14-302 (B)(1)] Please add a date of last revision. Rev. 1: Comment stands. Rev. 2: Comment may be
addressed. pending confirmation from En¢ineerin¢ Division that no further revisions are needed
on the plat.
14. [14-303 (A)] Please revise the statement of consent to division for TMP 62A3-1 on Sheet VI. The TMP
number is wrong, it should be TMP 062A3-00-00-00100. Rev. 1: Comment addressed.
15. [14-303 (E)] See Engineering Division comments below. Public drainage easements need to be re -
sized. The dimensions in the table on Sheet VI will need to be updated to comply with the revised
easement size. Rev. 1: Comment addressed, see Engineerina comments.
16. 114-303 (F )] In the labels for Lots 196-201 to the west of Phase 5A, please state the sectioniblock
number for those lots in the labels on Sheet V2. Rev. 1: Comment addressed.
