Subject: SUB202100001 Avon Park II - Final Subdivision Plat
The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments have been satisfactorily addressed (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.):
1. 114-4031 Frontage. In order for Lot 29 to be created without frontage, Lot 29 and Lot 30 shall each contain an
existing home that was built prior to October 14, 2009. If this is the case provide the following note on the plat:
"Lot 29 is created without frontage pursuant to Section 14-403, as each lot (Lot 29 and Lot 30) contains an
existing home that was built prior to October 14, 2009 and one existing dwelling would be located on each lot
created. " If this is not the case, Lot 29 shall be provided frontage on a public or private street.
2. [ZMA2014-6, 33.44, 8.5.5.3(a), SE2020-51 Special Exception for a Variation to the Application Plan. The final
site plan and final subdivision plat shall conform to SE2020-5, which was approved with conditions by the Board
of Supervisors on November 4, 2020. Final. Comment not fully addressed. See additional comments below.
3. [ZMA2014-61 Proffer 3(a). The owner shall obtain a variable width landscape easement behind what was depicted
on the application plan as lots 1-7 on TMP 9017-Al, owned by the Avon Park Community Association. The current
plan depicts these easements as "Proposed 10' landscape easement" and "Proposed 5' landscape easement" behind
Lots 23-28. These easements shall be platted prior to final site plan approval/ prior to or with the final subdivision
plat approval. Final. IZMA2014-6, 14-303(0),14-303(P)l The required easements on the adjacent parcel are
depicted: however, in order to plat them on this final plat the owners of the adjacent property need to sign
the plat. Provide ownership information and a signature block for the property owner of TMP 090F0-00-00-
000AI. If these easements are to be platted on a separate plat, approval of these easements shall be required
prior to final plat approval. Provide recordation information of these easements on the plat.
4. [ZMA2014-6, 8.5.5.3(a)21 Waterline Access forAdjacent Lots. Provide a 20' waterline easement to the northern
property line shared with TMP 90-32A, owned by Robert Spauls. These easements shall be platted prior to final
site plan approval/ prior to or with the final subdivision plat approval. Final. Comment addressed.
5. [ZMA2014-6, 8.5.5.3(a)4, SE202020-51 Landscape Easement. A landscape plan consistent with the rezoning and
SE2020-5 shall be required with the final site plan. Final. Comment still relevant but only applicable to the
submittal of the final site plan.
6. [ZMA2014-61 Proffer 6. The final site plan shall identify the location of trees at the rear of TMP 90E-A2, TMP
9017-17-42, TMP 9017-17-43, and TMP 9017-17-44. If trees are located within 5' or less of the property line, the owner
will remove the trees on the adjacent properties. Tree removal will be subject to the existing property owner's
written approval. Final. Comment still relevant but only applicable to the submittal of the final site plan.
7. [ZMA2014-61 Proffer 8. The final site plan shall include TMP 9017-Al. Improvements required by proffer 8 shall
be depicted, label, and dimensioned as part of the final site plan. Final. Comment still relevant but only
applicable to the submittal of the final site plan.
8. [ZMA2014-61 On the final site plan distinguish the exact location of where the double -sided vertical fencing and
the 3-board farm fencing begins and ends. The locations should correlate to the application plan. Also, provide
cutsheets for each fence type. Final. Comment still relevant but only applicable to the submittal of the final
site plan.
9. [ZMA2014-61 The roadside ditch along the parcel frontage of Avon Street shall be improved to VDOT standards
(see sheet 6 of the application plan). Final. This item will be reviewed with the recent submittal of the
revised road plan. Pending VDOT's review and approval of this required improvement.
10. [32.8.2, 14-3111 Infrastructure improvementplans. Road Plan and WPO application must be approved, all
required improvements must be built or bonded, and all required Deeds and Declarations must be reviewed and approved
prior to final site plan/ final subdivision plat approval. Final. Comment still relevant. Road Plans under review.
11. [32.5.2(e)] Existing landscape features. Depict the existing landscape features as described in Section 32.7.9.4(c).-
Final. Comment still relevant but only applicable to the submittal of the final site Plan.
12. IZMA2014-61 Proffers. All proffers shall be adhered to as dictated in the proffers. Final. Comment not fully addressed.

13. 114-3171 Instrument evidencing maintenance of certain improvements. Submit with the final site plan/ final
subdivision plat an instrument assuring the perpetual maintenance of street trees, private streets, open space and
any other improvements that are to be maintained in perpetuity. Final. Comment not addressed. Provide the
HOA documents for County Attorney review and approval.
14. 114-3031 Contents offenal plat. A plat meeting all the requirements for final subdivision plats per the subdivision
ordinance. Final. Comment not fully addressed. See additional comments below.
15. 132.61 Contents offinal site plan. A final site plan meeting all the requirements of Section 32.6 of Chapter 18 of
the Code. Final. Comment still relevant but only applicable to the submittal of the final site plan.
16. 114-3161 MOT approval. VDOT approval of all entrances onto public streets is required prior to approval of the
final site plan and final subdivision plat. Final. Comment still relevant. Road plans under review.
17. 132.7.2.11 Vehicular Access to Site. Each entrance onto any public street shall be designed and constructed
as required by the standards of the Virginia Department of Transportation. VDOT approval of the
entrance to the site shall be required prior to final site plan approval. Final. Comment still relevant but
only applicable to the submittal of the final site plan.
18. 132.8.21 Infrastructure improvement plans. All infrastructure required to construct the development shall be
reviewed, approved, and built or bonded before the final site plan can be approved. This includes all offsite
improvements required to serve the development, including road plans, WPO plan, water and sewer connections._
Final. Comment still relevant but only applicable to the submittal of the final site plan.
19. [General Comment] It is up to the applicant to coordinate a centralized mail delivery location for the lots in
accordance with USPS requirements. Staff may ask for written verification from the USPS that a mail delivery
location has been approved by the postmaster during review of the final plans. Final. Comment addressed.
20. [Comment] The final site plan/ final subdivision plat shall not be approved until all SRC reviewers have approved
the plan. Their comments attached. Final. Comment still relevant.
21. IZMA2014-61 Provide the density of the development on the cover sheet.
22. IZMA2014-61 Provide the total lot count on the cover sheet.
23. IZMA2014-61 Proffer 1. On the cover sheet provide the following note: "Six (6) affordable housing units are
provided. " Also, on all sheets Iabellmark which units are the affordable housing units.
24. IZMA2014-61 Proffer 8. The Owner shall provide and install the following recreational amenities in the existing
"park" on TMP 090FO-00-00-000AI (owned by the Avon Park Community Association). These amenities are at
the request of the Avon Park Community Association Board and will be installed upon issuance of the 24th
Certificate of Occupancy. a) 40' x 50' fenced dog park area with two small benches. b) Two (2) additional play
structures for older children in the existing tot lot area The final site plan shall depict these required
improvements on the appropriate parcel.
25. IZMA2014-61 Proffer 9. The Owner shall submit an overlot grading plan meeting the requirements ofproffer 9
with the application for each subdivision of the property... Per conversations with the County Engineer WPO2020-
41 contains this information on sheet 15. Pending approval of the WPO prior to plat approval.
26. 114-4121 Revise note # 11 to specify "private streets" in this subdivision.
27. [14-302(B)(8)] Yards. On sheet 1 provide the setbacks or provide a note on sheet 1 that states, "Setbacks are
depicted on Sheet V3 ", and then update sheet V3 to depict all setbacks for all lots. Currently only Lots 5-12 have
setbacks listed.
28. ISE2020-51 Lots 1-4 shall be provided a 5' portion of the 20' landscaping easement on the rear of these lots. See
snip from the approved preliminary plat below.

The plat for Avon Park II has been reviewed by Engineering. The following comments will need to be
addressed before approval:
1. [Cover Sheet] Please update note 11. There is a public right-of-way for Hathaway Street.
2. [Sheet V5] Ensure all easement labels match the road plan. DE9 and on should be public. Also,
the SWM facility easement should be public.
3. Two deeds will be necessary: one for the public drainage easement and one for the public SWM
facility easement. Please let us know if you would like the county to draft these deeds, or if you
would like us to provide you with the templates.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section has reviewed the Avon Park II -final Plat, dated December 23, 2020, as submitted by
Roudabush, Gale and Associates, Inc., and find it to be generally acceptable.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the VDOT Charlottesville Residency Land Use Section at (434)
422-9399 for information pertaining to this process.

inspection performed by the building department.

Where the flood level rims of plumbing fixtures are below the elevation of the manhole cover of the next upstream manhole in the
public sewer, the fixtures shall be protected by a backwater valve installed in the building drain, branch of the building drain or
horizontal branch serving such fixtures. Plumbing fixtures having flood level rims above the elevation of the manhole cover of the
next upstream manhole in the public sewer shall not discharge through a backwater valve.
