The property, described as Tax Map 66,Parcels 77 &78, CONSENT AGENDA: Yes is located in the Rivanna Magisterial District on St. John Road[Route ACTION:Yes INFORMATION: #640] approximately 1 mile north from its intersection with Louisa Road ATTACHMENTS: Yes [Route#22]. The Comprehensive Plan designates this property as Rural REVIEWED BY: VWC Area in Rural Area 2. STAFF CONTACT(S): Yadira Amarante BACKGROUND: The applicant proposes to expand the existing church by constructing an addition to house classrooms and a sanctuary in accordance with conditions of a recently approved Special Use Permit Amendment(SP 03-041). This expansion is accompanied by the construction of 58 parking spaces and the consolidation of two existing entrances into one. The new parking will be located on parcel 77,the site of an existing, abandoned schoolhouse. The existing church and proposed expansion will be within the bounds of parcel 78. The two parcels will be combined by plat as a condition of approval of this waiver request. The existing entrances,which will be closed, are being consolidated into one entrance along the same road. This consolidation is supported by the Engineering Department and VDOT with the condition that a fence within the right of way of St. John Road be removed, (see Attachments A and B). This proposal warrants the need for a site plan. In accord with Section 32.2.2 of the Zoning Ordinance,the applicant is requesting that the Planning Commission waive the drawing of certain aspects of the required site plan. DISCUSSION: Section 32.2.2 of the Zoning Ordinance states: "The forgoing notwithstanding, after notice in accordance with Section 32.4.2.5, the Commission may waive the drawing of a site development plan in a particular case upon finding that the requirement of such plan would not forward the purposes of this ordinance or otherwise serve the public interest;provided that such waiver shall be made until the Commission has considered the recommendation of the agent." In this particular case requirement of a site plan would not forward the purposes of the ordinance or otherwise serve the public interest. That being said,the applicant has submitted a plan, (see Attachment B),which shows the portion of the property slated for improvements. The plan meets most of the site plan contents requirement and has allowed staff to adequately review and comment on the details of the improvement proposal. The submitted plan also meets most of those conditions imposed by SP 03-041, (Attachment C). The plan shows the required 50' building setback and 20' parking setback along the southern property line. There is now parking shown behind the schoolhouse,not just along the frontage of the property. Evergreen screening is shown along the parking lot frontage to the road and along the southern property line. Those conditions imposed by SP 03-041 not shown on the plan are still being worked on by staff and the applicant and appear below as conditions of approval of this waiver. They include protection measures for certain trees through a tree conservation plan subject to Agent review and approval and a plat combining the two parcels, also subject to Agent review and approval. The Site Review Committee has reviewed this request and has not identified any unfavorable conditions that would arise from the approval of the site plan waiver therefore staff recommends approval of the site plan waiver request with all conditions specified below. RECOMMENDATION AND CONDITIONS OF APPROVAL: Approval of the request for a site plan waiver with the following conditions: 1. The applicant has suggested a 6" 21A Material for the surface of the travelway and parking lots without providing any data to support this design. An analysis of the site was performed using the "Trip Generation, 6th Edition"by the Institute of Transportation of Engineers. A gravel surface of 6" 21A Material is not adequate for the amount of average daily vehicle trips produced by the site. A base of 6" 21A Material along with a surface of prime and double seal will provide an acceptable pavement design of the entire site. The engineering department recommends a compromise. The applicant will provide a pavement design of 6" 21A Material base along with a prime and double seal for the travelway from the VDOT 1 right-of-way at the entrance to State Ro,.�., .,40 for approximately 190' at a width of ,The parking lot surface can be 6" 21A Material. 2. Submit a completed application and fee for erosion control and stormwater management. [17-203, 17-303] 3. A drainage easement plat needs to be submitted by the applicant and reviewed. 4. The runoff from"the entire land development project area" appears to be over one acre for this site. The applicant has requested a waiver from stormwater detention due to the assumption that the area is less than one acre. The engineering department does not recommend a waiver of the stormwater detention requirement. This needs to be addressed by the applicant. 5. Drainage computations need to be submitted by the applicant and reviewed. 6. Due to the total number of parking spaces,three spaces must be handicapped accessible. [2000 Virginia Uniform Statewide 7. Building Code; 1996 BOCA National Building Code, Section 1105.1] 8. [32.7.9] Submittal of a Landscape Plan per Section 32.7.9 of the Zoning Ordinance, including a tree conservation plan, which meets those conditions of SP 03-041 which relate to landscaping and screening. 9. [32.5.6(a)] Reference SP 2003-41 and note all conditions on the plan. 10. [SP03-41, condition 6] Provide proof of legal recordation of the plat combining the subject parcels. 11. [32.5.6(n)] Show the location of all outdoor lighting on the plan. 12. [32.6.6(j)] Provide a description and photograph or diagram and show the location of each type of outdoor luminaire that emits 3,000 or more initial lumens. Please be aware that installation of such luminaires in the future that are not shown on this plan shall require an amendment to this plan. 13. [32.6.6(j)] Include a photometric plan on the site plan demonstrating that parking area luminaires are in compliance with 4.17.4(b). • 14. [4.17.4(b)1] Please note on the plan, "The spillover of lighting from outdoor luminaires onto public roads and property in residential or rural areas zoning districts shall not exceed one-half('/2)foot candle." 15. [4.17.4(a)][4.17.4(b)(2)] Please note on the plan: "All outdoor lighting,regardless of amount of lumens, shall be arranged or shielded to reflect light away from adjoining residential district and away from adjacent roads. Please note that this approval is subject to the following conditions: 1. On that portion of the addition that connects the Existing Church to the New Sanctuary (identified on the Application Plan for St. John's Baptist Church, dated July 7, 2003 (the "Application Plan") as the area for"New Classrooms"), the roof pitch, roofing material, and the siding material shall be the same as is on the Existing Church. 2. The area of assembly shall be limited to a maximum 175-seat sanctuary. 3. Commercial setback standards, as set forth in Section 21.7.2 of the Albemarle Zoning Ordinance, shall be maintained; except that the setback on the south side of TM 66-77 shall be thirty feet. 4. There shall be no day care center or private school on site without approval of a separate special use permit. 5. Health Department approval of well and septic systems shall be required prior to the issuance of a building permit. 6. The two properties, TM 66-77 and TM 66-78, shall be combined into one parcel prior to the issuance of a building permit. 7. The existing trees on the south property line adjacent to TM 66-76 between the schoolhouse and St. John Road shall be retained. Tree protection measures, subject to the approval of the Planning Department, shall be employed during construction. 8. Construction of the church, as shown on the Application Plan, shall commence within five years of the date of the approval of this special use permit or this special use permit shall expire. 9. The parking area between the Route 640 right-of-way and the Existing Building (Vacant) shown on the Application Plan (the"Existing Building") shall be limited to one aisle containing double rows of parking spaces, with a standard turnout at the end of the travel aisle. This parking area shall be centrally located between the Route 640 right-of-way and the Existing Building. The areas between the parking area and the Route 640 right-of-way, and the parking area and the abutting parcel to the south (TM 66-76) shall be planted in native evergreens such as cedars sufficient to screen the �) parking area from Route 640 and the abutting parcel, as determined by the Director of Planning and 411 nthar rent sired narkina shall be located behind the Existing Building. ATTACHMENT C Page 2 October 21, 2003 In the event that the use, structure or activity for which this special use permit is issued shall not be commenced within sixty (60) months after the issuance of such permit, the same shall be deemed abandoned and the authority granted thereunder shall thereupon terminate. For purposes of this section, the term "commenced" shall be construed to include the commencement of construction of any structure necessary to the use of such permit within five (5) years from the date of the issuance. Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning Department will issue a clearance, you must comply with the conditions in this letter.
