Dear Mr. Jody Lahendro:
Staff has reviewed your initial submittal for a Special Use Permit for a community center
use in the Rural Area on St. John Road.
We have some questions and comments which we believe should be resolved or
included as conditions of approval before your proposal goes to public hearing. We
would be glad to meet with you to discuss these issues. Our comments are provided
below.
Comments are organized as follows:

A. Special Use Permit
1. The plan should be revised such that a concept plan for the site is provided on a
dedicated sheet that includes a title, author, and date. This sheet will likely be
used as a reference when conditioning major elements of the proposal. (See
condition one in the "SP Conditions" section below. This is a standard condition
that is typically applied to special use permits.)
2. The Family Life Center is served by an existing sewage disposal system and will
offer a variety of uses to the public. As such, a Capacity Assessment is needed
from a licensed PE in order to verify that the existing sewage disposal system
can accommodate the proposed use. (Note: The wastewater treatment and
disposal system was installed in 2018 and it appears that the Family Life Center
uses may have been factored into the design. This is important because the
"system" may already be "set up" and the applicant may not need to
update/expand the system. The applicant should consult with a licensed PE for
this determination.)
3. Based on the numbers provided in terms of people served, the facility may fall
under the Office of Drinking Water classification in terms of the water
supply. Given that the facility will be open 6 days a week and will serve 20-40
people with a maximum of 75, the Health Department reviewer advises that this
issue be addressed as part of the Capacity Assessment. Please note that the
Office of Drinking Water Guidelines specify that the system would be considered
a waterworks if it serves 25 persons at least sixty (60) days of the year.
4. Please provide plans for the current entrance to verify conformance with existing
requirements.
5. Please provide the expected vehicle trip generation resulting from this
renovation.
6. Please check the sight distance to the left when exiting the main parking lot and
verify it conforms with Table 2-5 of Appendix F of the VDOT Roadway Design
Manual.
B. Comprehensive Plan
Initial comments on how your proposal generally relates to the Comprehensive Plan are
provided below. Comments on conformity with the Comprehensive Plan are provided to
the Planning Commission and Board of Supervisors as part of the staff report.
The Rural Area Chapter (Chapter 7) of the Comprehensive Plan designates this parcel,
TMP 66-78, for Rural Area land uses. The intent of the Rural Area designation is to
allow uses that preserve and protect agricultural, forestal, open space, and natural,
historic, and scenic resources; and also to allow residential uses at a density of up to
0.5 acres per dwelling unit. Staff found the proposed community center use to be
consistent with the intent of Rural Areas in that it will: support historic preservation and
tourism, not remove land from the agricultural and forestal economy, be compatible with
surrounding uses, and provide services and support to rural area citizens and local
community.
The proposed community center use was also analyzed against the Historic, Cultural,
and Scenic Resources Chapter (Chapter 5) of the Comprehensive Plan due to the
integral nature of the use's proposed adaptive reuse of a historic building, a former
Rosenwald School. In comparing this aspect of the proposal against the
Comprehensive Plan, staff found that the proposal is consistent with the goals of this
chapter. Specifically, the proposal contributes to the respectful restoration and
preservation of a culturally significant resource in Albemarle County. In addition,
renovations and proposed activities will also allow the culturally and architecturally
historic building to be publicly accessible and an educational resource for the greater
community with implications for promoting tourism.
C. Additional Comments from Reviewers
Planning Comments
The following comments related to planning matters have been provided by Mariah
Gleason:
1. Please revise the application materials to include the assigned project number
"SP202100002".
2. Should the special use permit be approved, changes to the site and building
cannot commence without an approved site plan amendment and appropriate
building permits, respectively.
Zoning
The Deputy Zoning Administrator, Francis MacCall fmaccall(a)albemarle.org, has no
objections to this proposal.
Engineering
The County Engineer, Frank Pohl, fpohl(a)albemarle.org, has provided the following
comments:
1. Please confirm that the existing parking spaces and travel aisle width meets the
minimum requirements [18-4.12.16].
2. If exterior improvements result in disturbing more than 10,000 sf of land, a VSMP
permit will be required [17-302].
Building Inspections
The Building Inspections reviewer, Betty Slough, bslough(a)-albemarle.org, has no
objections to the special use permit but has provided the following comments that will
need to be addressed during the plan review process:
There are concerns with the change of use to an "Assembly" in an historic
building: questions about means of egress, design with an architect, fire
suppression system requirements, potential issue with the building loads, etc.
These can be determined at design and plan review process.
Historic Preservation
The following comments related to the Historic Preservation have been provided by
Khristopher Taggart, ktaggart(cDalbemarle.org:
Staff has received and reviewed the comment letters from VDHR that state the
proposed project would have no adverse effect on the historic St. Johns School,
and we concur with these findings. Regarding the overall site plan, the applicant
should provide additional clarification on the potential conflict, noted in the VDHR
letter dated February 12, 2021, between the cemetery and the proposed drain
field.
Fire/Rescue
The Fire/Rescue reviewer, Howard Lagomarsino, hlagomarsino(a)-albemarle.org has no
objections to the special use permit but has provided the following comments that will
need to be addressed during the site plan review process:
1. Knox Box will be required. Please place a note indicating this on plans. The
location of this can be coordinated with the Fire Marshal's Office.
2. Please provide ISO needed fire flow calculation for the structure's intended use.
3. Provide note of nearest water sources on plans.
4. Clarify unobstructed access widths for parking lot. Emergency apparatus access
requirements are 20 ft unobstructed so as to provide access to all sides of the
grade level of the structure within 150 of the emergency apparatus.
Virginia Department of Health (VDH)
The VDH reviewer, Josh Kirtley, ioshua.kirtley(a)vdh.virginia.gov, offers the following
information/comments:
After reviewing the plan, it is unclear the level of potential ground disturbance
with this proposal. It appears that there is an existing "vacant" structure that will
be revived in some way. I only mention this comment to make the applicant
aware that they should be cognizant of the location of any and all components of
the septic system and to maintain the necessary setbacks. I also note that there
is a well in close proximity to the existing "vacant" building that the applicant
should protect.
Virginia Department of Transportation (VDOT)
Please see comments attached in the official VDOT comment letter provided by, Adam
Moore, adam.moore(a)vdot.virginia.gov.
Planning - Transportation
The Transportation Planning reviewer, Daniel Butch, dbutch(a)-albemarle.org, has no
objections to this proposal.
Natural Resources
The Natural Resources Manager, Kimberly Biasiolli, kbiasiolli(a)-albemarle.org, has no
objections to this proposal.
Additional Information
SP Conditions
Staff has not fully drafted conditions to date for this special use permit, due to the
potential changes and additional information requested. Once conditions are drafted,
staff will send them to you.
Summary of potential proposed conditions:
1. Development of the community center use must be in general accord (as
determined by the Director of Planning and the Zoning Administrator) with the
Conceptual Plan titled "INSERT," prepared by INSERT, dated INSERT. To be in
general accord with the Conceptual Plan, development must reflect the following
essential major elements:
• Location of building and structures
Minor modifications to the plan which do not conflict with the elements above
may be made to ensure compliance with the Zoning Ordinance.
2. Changes to the building associated with the community center use must not
result in the delisting from the National Register of Historic Places or the Virginia
State Register.
Days of operation for the community center use are restricted to Monday through
Saturday.
Action after Receipt of Comments
This application has been tentatively scheduled for Planning Commission public hearing
for May 4, 2021, which is within 90 days after submittal. However, staff recommends
that you resubmit your application, which would require deferral. Staff will work with you
to choose a Planning Commission date for public hearing.

If you choose to resubmit, please use the attached form. There is no fee for the first

Notification and Advertisement Fees
Additional notification fees will not be required unless a deferral takes place and
adjoining owners need to be notified of a new date.
Community Meeting
Prior to requesting a public hearing with the Planning Commission and Board, a
community meeting must be held in accordance with Zoning Ordinance Section 18-
33.37.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by St. John Baptist Church, dated
21 January 2021, and offers the following comments:
1. Please provide plans for the current entrance to verify conformance with existing
requirements.
2. Please provide the expected vehicle trip generation resulting from this renovation.
3. Please check the sight distance to the left when exiting the main parking lot and verify it
conforms with Table 2-5 of Appendix F of the VDOT Roadway Design Manual.
4. Note that the final plan must show conformance with the VDOT Road Design Manual
Appendices B(1) and F, as well as any other applicable standards, regulations or other
requirements.

ACTION AFTER RECEIPT OF COMMENT LETTER
FIRST SET OF COMMENTS
Your project has been scheduled for a public hearing by the Planning Commission for May 4, 2021,
which is 90 days from the date your application was accepted for review. State Code requires a 90-day
review by the Planning Commission unless the applicant requests deferral. As you will read in this
comment letter, staff recommends changes to your project to help you achieve approval. Without
these changes, staff cannot recommend approval to the Planning Commission.
If you need more time to make these changes, and if you prefer to move forward to the Planning
Commission with a recommendation for approval, you must request deferral. If you choose not to
request deferral, staff will take your project to the Commission as originally submitted, but without a
recommendation of approval. Instructions for requesting a deferral are outlined below.
Within one week please do one of the following:
1) Request deferral, as required by Section 33.52(A)1, if you will resubmit, but would like to
receive comments on the revised submittal, and understand the Planning Commission
date will be later than May 4, 2021
2) Proceed to Planning Commission public hearing on May 4, 2021
3) Withdraw your application
(1) Deferral requested
To request deferral, you must submit a request in writing to defer action by the Planning Commission
and Board of Supervisors. The request may be made by email. You may request a deferral for up to 36
months from the date your application was accepted for review, which is February 3, 2024. (This is
based on the Board of Supervisors' September 5, 2018 action.) However, all outstanding information
necessary for Commission action must be submitted by October 6, 2023, according to the published
schedule. (See Section 18-33.52 of the Albemarle County Code.)
(2) Proceed to Planning Commission Public Hearing on May 4, 2021
At this time, you may request that your application proceed to public hearing with the Planning
Commission on May 4, 2021. With this option no additional documents will be accepted, and staff will
take your project to the Commission as originally submitted, but without a recommendation of
approval.

(3) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant
to subsection 33.52(A) and fails to provide within 90 days before the end of the deferral period all of
the information required to allow the Board to act on the application, or fails to request a deferral as
provided in subsection 33.52(B) or (C).

Fees paid in cash or by check must be paid at the Community Development Intake Counter. Make
checks payable to the County of Albemarle. Do not send checks directly to the Review Coordinator.
