AFD Review Criteria for Special Use Permit Within Districts
Section 3-202(A) prohibits "development to a more
intensive use" in the District, and lists several exceptions to
that prohibition.
Subsection (3)(k) includes the following exception:
Special uses and structures allowed in the Rural
Areas zoning district. Any proposed use or structure
allowed by special use permit in the Rural Areas zoning
district, provided that the Board of Supervisors
determines that the use or structure allowed by the
special use permit is consistent with the purposes of
this chapter.
AFD Review Criteria for Land Uses Adiacent to Districts
Section 3-202(D) of the Albemarle County Code reads as follows:
D. Consideration of district in taking certain actions. The
county shall consider the existence of a district and the
purposes of this chapter and Chapter 43 of Title 15.2 of the
Virginia Code in its comprehensive plan, ordinances, land use
planning decisions, administrative decisions and procedures
affecting parcels of land adjacent to the district.

practice
has been
to consult with the Committee on
any
special use permit
requests
located on land adjacent to an
existing District.
AFD Review Criteria - Summary
Sec. 3-100 - Purpose.
The purpose of this chapter is to provide a means by which
agricultural and forestal lands of statewide and local
significance may be protected and enhanced as a viable
segment of the State and local economies, and as important
economic and environmental resources.
The Committee's role is to assist the Board of Supervisors by
commenting on any possible impacts to the Districts from the
proposed uses. The Committee's review should directly
address Agricultural -Forestal District impacts.
Other aspects of the proposed uses, such as traffic, noise,
visibility of the proposed facilities, etc., will be addressed in
staff's reports to the Planning Commission and Board of
Supervisors.
Public Comment Policy
For each item, after staff presentation and initial Committee
questions/discussion:
• Attendees sign up by using "raise hand" in Zoom - staff
will notify them of their turn
• Time limits - 2 minutes per person; 30 minutes overall
• Attendees may not transfer their time to other
attendees

Batesville Agricultural/Forestal District
Request: Special Use Permit Amendment
Existing SP: Permits day camp for up to 10
attendees, up to 30 days per year, on parcel 3A only.
No limits on hours or season.
Proposed Amendment: Up to 50 persons (total of
attendees and staff), operating from 9 a.m. to 4
p.m. Expand use to include parcel 3A1.

A. Production of food and other agricultural and forestal products.
The impacts likely created by a day camp use would include an
increase in traffic and the potential for an increase in unamplified
sound from the additional participants at the camp. However,
unlike industrial and commercial uses that can create chemical or
water -quality impacts, a day camp would not directly impede the
District's ability to produce food or forestal products.
B. Provide essential open spaces.
The proposal would use existing roads and structures on the
property and would not require land -cover changes other than
potential driveway and entrance improvements in order to meet
VDOT and Engineering standards. Open spaces within the District
would not be impacted. Minimal clearing of land is proposed. The
only new construction proposed at this time is for a potential future
pavilion to be located on TMP 85-3A1 for camp activities.

C. Strong agricultural and forestal economy.
Increases in traffic on the narrow roads of the Batesville area could
theoretically impede farm -related traffic near the proposed day
camp property. However, as the day camp use is proposed to
operate for a maximum of 45 days per year, the impacts would be
infrequent. In addition, this increase in traffic would likely occur
only twice a day, in the mornings and late afternoons, as
participants arrive at and depart from the property, based on the
proposed hours of operation from 9am to 4pm.
D. Protect and preserve natural resources and retain continuous and
unfragmented land.
One of the subject parcels is already protected from fragmentation
by a conservation easement, and the proposed use would not
intrude between District properties. No significant construction
activities or vegetation changes are proposed that would have an
impact on landscape connectivity.

RECOMMENDATION:
• Physical impacts of the proposed use will be limited across both
parcels located within the District and are not expected to have
an impact on agricultural or forestal resources on land in the
District
• Traffic impacts could impede farm uses, but they would be
infrequent and likely limited to certain times of the day and
year.
Staff recommends that the Committee advise the Planning
Commission and the Board of Supervisors that the proposed use
does not conflict with the purposes of the District.
POSSIBLE MOTIONS:

A. Production of food and other agricultural and forestal products.
The presence of a solar -energy electrical generation facility on 80 acres of a 136 acre parcel that is
outside the District will not limit the capacity of land in the District to produce agricultural or
forestal products. Traffic for construction of the facility will not impact Tax Map 85 Parcel 3, 3A, 3A1
because they access Batesville Road and not Craigs Store Road. Traffic impact on Tax Map 85, Parcel
17 (a 5 acre parcel) would be limited to the anticipated 6 month construction window. Traffic to the
solar facility after construction is minimal and will not impede farm traffic.
B. Provide essential open spaces.
Open spaces within the district would not be reduced by the creation of a solar -energy electrical
generation facility on an adjacent parcel. The district's value for watershed -quality and wildlife -
habitat protection would not be impeded by adjacent construction.
C. Strong agricultural and forestal economy.
A solar -energy electrical generation facility on adjacent property does not impede the District's
ability to support agricultural or forestal production.
D. Protect and preserve natural resources and retain continuous and unfragmented land.
Development of the site would not create fragmentation of land ownership or of land cover within
the district. Issues associated with the change in use, and ground cover of the subject property,
will be evaluated by the Planning Commission and Board of Supervisors during the special use
permit review.
Recommendation:
Physical impacts of the proposed use will be limited to the parcel
adjacent to the District and would not impact agricultural resources
on land in the District.
Staff recommends that the Committee advise the Board and the
Planning Commission that the proposed use does not conflict with
the purposes of the Agricultural -Forestal Districts.
