Wood hereinafter called the Landowner and THE BOARD OF SUPERVISORS OF ALBEMARLE COUNTY, VIRGINIA, hereinafter called the County, W I T N E S S E T H: That for and in consideration of $10.00 cash paid it and other valuable considerations, the Landowner hereby GRANTS and CONVEYS unto the County the perpetual right and easement to construct, install and maintain a pipe line, together with i� fire hydrants and air valves, for transmission of water in i and upon a certain non-exclusive 25' roadway right of way i; leading from the lands of the party of the first part north- westward to St. Rt. 659, as shown on a plat prepared by Aoo. The said right of way is as outlined in red on sheet No. 17-5 of plans etc. Also over a non-exclusive 40' right of way from the lands of the party of the first part southward to U. S. # 29 recorded I.A.v e; /,PzO in the aforesaid deed (Lr to Wood) in D. B. 346, Page 362 which right of way is as outlined in red an sheet No. 17-6 etc. of plans designated as "Albemarle County Water Facilities, Phase I", dated 6/24/69, prepared by John McNair and Associates, Consulting Engineers. The easement hereby conveyed is 15 feet in width. As a part of said easement the County shall also have the right to enter upon the Landowner's lands for the purpose of installing, constructing and maintaining said water line and for making connections thereto. botA 460 rani 637 Whenever it is necessary to excavate earth within said easement, the County hereby agrees to backfill such excavation in a proper and workmanlike manner so as to restore the surface condition as nearly as practicable to the same condition existing prior to such excavation.
