In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
The Property is zoned Planned Residential Development ("PRD") per zoning map
amendment ZMA-1999-1, approved January 12, 2000 with proffers. The proffers
associated with ZMA-1999-1 and the Property have been amended by several additional
zoning map amendments, the last being ZMA-2018-8, approved January 16, 2019. The
permitted uses of the Property are provided in Section 19 of Chapter 18 of the Albemarle
County Code ("Zoning Ordinance"). The Property is subject to the Entrance Corridor
Overlay District as described in Section 30 of the zoning ordinance.
• There are two special use permits associated with the Property. Special use permit SP-
2018-17, approved January 16, 2019, permits professional office use in the existing
structure. The second special use permit was approved alongside ZMA-1999-1 and
permits assisted living in the PRD district. Special use permits allow the approved uses
to run with the land.
• The Property and "Current Use" of the Property as an assisted living facility, do not
violate any existing zoning ordinance regulations.
• The Property is subject to site development plans SDP-2001-65 "Pantops Place Final,"
approved December 14, 2001, SDP-2002-91 Pantops Place Phase I Minor, approved
October 28, 2002, and two letters of revision. The Property appears to be developed in
accord with these approved site development plans. Copies of these plans may be
obtained through a request from our office.
• No application for rezoning of the Property, special use permit, or variance associated
with the Property, is now pending.

The Property was inspected for Zoning Compliance on May 14, 2019. It appeared the
Property had been developed according to the approved Site Plans, however, staff
noted a possible violation where two dumpsters in the rear of the Property were located.
These dumpsters, if they remain in unapproved locations, would be considered a Zoning
Violation. However, at this time there are no Building or Zoning Violations on file
associated with the Property.
• This office does not keep track of fire violations, you can reach the County of Albemarle -
Fire and Rescue at (434) 296-5833 to see if they have any fire violations on file.
• The adjacent properties are zoned Planned Residential Development and R-1
Residential. The Zoning Map link, attached below, can be used to view the existing
zoning designations of any adjacent property.
• In the event of casualty, the Property may be rebuilt substantially in its current form upon
satisfaction of all required building permits and site plans, as applicable.
• It is the policy of this department to purge building permit files after three years per the
Library of VA. Copies of Certificates of Occupancy are maintained electronically.
• Copies of any applicable records may be obtained via the noted links or from this office
with a request through the department's Records Manager, Paul Bjornsen, at
pbiornsenCa)albemarle.org once they have been approved or issued.
