Wright, P.E., (iwrig tt&bohleren .com) and PT Hotel, LLC (neilkshaminhotels.com and michael@shaminhotels.com) From: Kevin McCollum, Planner Division: Planning Date: March 31, 2021 Subject: SLTB202000169 TMPs 78-64 & 78-65 Boundary Line Adjustment, Special Lot, and Easement Plat The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [General Comment] Any plat creating a Special Lot, such as the proposed Lot X, actually subdivide off the Special Lot as its own Tax Map Parcel (TMP). Please address the following: a. Based on the acreage of the proposed Lot 5A (4.413), it appears that Lot X (2.036 acres) is going to remain as part of the revised Lot 5A. This is not possible, since all Special Lots are new pieces of land that get subdivided off from the parent tract(s). Please confirm that the applicant is aware that Lot X will be its own separate piece of land. Rev. 1: Comment not fully addressed. On the first version of the plat, there was a note #9 that stated "Lot X is a special lot established solely for future dedication to Albemarle County upon demand." This note has been removed from the revised plat. Please add this note back to the plat. See comment #1 from Parks & Recreation below for additional information. b. 114-303 (C)] Please revise the southern boundary between Lot X and Lot 5A so that the line appears as parcel boundary line as drawn elsewhere on the plat. The dashed line implies that they are both the same parcel. This comment has been addressed. c. 114-303 (D)] Revise the acreage in the labels for Lot X and Lot 5A. This comment has been addressed. d. 114-302 (A)(14)] Revise the label for Lot X so that it states "New Lot X... " This comment has been addressed. e. [14-303 (A)] Revise the Statement of Consent to Division so that it mentions the creation of the new special lot. This comment has been addressed. 2. [14-203(A)] This application is for an easement plat with a deed. The associated fee is $817. $215 has been paid. Please complete the additional payment. This plat won't be approved until the additional payment has been received. This comment has been addressed. 3. [14-302(A)(1)] Please include the TMP numbers in the title in the bottom right comer of the plat instead of "Lot 4 and Lot 5" for clarification purposes. This comment has been addressed. 4. [14-302(A)(3)] The label under State Farm Boulevard written at the bottom of the plat should be clarified to state "variable width public right of way." This comment has been addressed. 5. [14-302 (A)(4),14-302 (A)(5)] Please revise the label for the existing drainage easement that will be vacated so that is states whether the existing easement is public or private. This comment has been addressed. 6. [14-302(B)(5)] Please add a comment to Note 5 to state that the properties are subject to the proffers approved with ZMA201800005. This comment has been addressed. 7. [14-302 (B)(5)] Per Albemarle County GIS, portions of TMP 07800-00-00-06400 lie within the Managed and Preserved Steep Slopes Overlay District. Portions of TMP 07800-00-00-06500 lie within the Managed Steep Slopes Overlay District. Please revise the zoning note (note 5) so that all applicable overlay zoning districts are stated for each TMP and state the source used to identify the districts. This comment has been addressed. 8. [14-302 (B)(1)] Please add a date of last revision. Rev. 1: Comment stands. 9. [14-303 (A)] Please revise the statement of consent to division as follows: a. Re -title the statement to "Statement of Consent to Division." b. State the owner name under the signature line for the owner. c. Revise the date for the plat in the statement of consent to division. These comments have been addressed. 10. 114-303 (D)] Please state the existing and proposed acreages of all parcels in a note on the plat. This comment has been addressed. Widen proposed 35' wide SWM facility easement to-51.7', per Easement diagram, ACDSM, p. 15. Also, please see email sent to John Wright, Bohler Eng, 10/8/2020 4:09 PM. ( —Attached ) 2. Revise easement Area (S.F.) values to reflect revised SWM facility easement width. 3. Provide public drainage easement labels for portions of easement currently labeled 30' Stormwater Management easement to delineate separate public drainage easement, as opposed to SWM facility easement, which should be restricted to (revised) area encompassing SWM facility; example/s: pipes (within public drainage easement) that convey runoff from State Farm Blvd, and pipe from ADS underground SWM facility to (pipe) outfall north of Retaining Wall 1. 4. Replace date in Note 3 (ref. to floodplain FIRM, Feb. 5, 2004) to read May 16, 2016, instead. SWM3 tie ( point tied to) appears somewhat ambiguous. Recommend clarify via notation, or label, tie point at NE end of SWM3 curve. 6. This comment is regarding an easement dedication template. There is a template. Once all review comments are addressed and final date ( date last revised) of plat is set, Engineering formats deed of dedication of SWM Facility and deed of dedication of public drainage (easement) that will accompany /be recorded with the easement plat. We'll send to Applicant for review, and Owner signature. There will be separate documents for drainage, and SWM deeds. Just waiting on a final plat date. Review Comments 3/28/2021 1. `Prior comments addressed. 2. New: Please provide public drainage easement distance and bearing for the line segment between 14.95' segment and State Farm Blvd. This segment is likely parallel with 3.69' public drainage easement line segment bearing N58039'47"W. Parks & Rec staff acknowledges "Lot X - Proposed Special Lot' (88,700 SF / 2.036 acres) and accompanying Note 9 ("Lot X is a Special Lot reserved solely for future dedication to Albemarle County, Virginia for public use upon demand.") This area and note appear to be in accordance with the approved Application Plan for ZMA-2018-00005. 2. However, please revise this plat to create Lot X as a standalone special lot (subdivided off from proposed Lot 5A); in order to dedicate Lot X to the County upon future demand, this Special Lot would need to be a standalone parcel of record and not just a designated area within a larger parcel of record. Review Comments 3/31/2021 1. ACPR acknowledges that the revised plat (dated 3/1/21) identifies "New Lot X" as a standalone parcel (2.036 acres in size) to be subdivided from the parent parcel. Thank you for addressing/resolving previous ACPR review comment. 2. Please further revise the plat to include a note identifying New Lot X as a special lot established solely for future dedication to Albemarle County, Virginia for public use upon demand. (For reference, this information was previously included as Note 9 on the original plat application dated 9/4/20). The proposed water easement may be adjusted based on conversation with the applicant. The proposed easement should match final ACSA utility location. Review Comments 3/31/2021 1. The proposed waterline easement should be called out as "Variable width ACSA easement'.
