HomeMy WebLinkAboutSUB202100023 Review Comments Final Plat 2021-04-06 (4)R' �tr��tN County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 Phone 434-296-5832 Fax 434-972-4126 Memorandum To: Greg Baldwin From: Christopher Perez, Senior Planner Division: Planning Date: April 6, 2021 Subject: SUB202100023 Old Dominion Woods Tract - Final Plat The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. 114-206, 14-404, 14-203.11 The proposal is incorrectly submitted as a 2-lot subdivision under Section 14-207, rather, the proposal is truly a 3-lot division which shall be reviewed under Section 14-206 and requires Site Review Committee (SRC) review. Additionally, the proposal is relying on a waiver to Section 14-404 to permit Lot 1 to access Irish Road instead of a private street created at the time of the subdivision. Please submit the correct applications (subdivision plat and variation application and justification required in 14-203.1) and pay the correct fees. Here is a LINK to the correct applications. Below is a summary of the fees paid and fees owed to move forward: Fee Paid: $581 (2 lot division) — this can be refunded once the correct fees are paid. Fees Owed: $1,075 + $75 (final plat sent to SRC) $215 for SRC notices $355 Tier II Groundwater assessment review fee $892 Variation fee (Section 14-404 waiver) 2. 114-404, 14-203.11 Prior to final subdivision plat approval Lot 1 will require an approved waiver to Section 14-404 of the subdivision ordinance to not access a private street created at the time of the subdivision. 3. 114-303(R), 14-4041 Remove note # 13, as Lot 2 and Lot 3 shall only access the state road through the private street created at the time of the subdivision. Unless a 14-404 waiver is granted for these lots as well, provide the following note on the plat: `All subsequent divisions of Lot 2 and 3 shall enter only onto such street(s) shown on the approved final plat and shall have no immediate access onto to any public street. ". 4. 110.4, 14-412, 14-4101 The proposed 50' easement necks down to an unknown width near L2, L3, and L5 and is labeled "proposed variable easement". What is the width of this portion of the easement? Label it on the plat. The easement shall be a minimum of 30' wide throughout in order to be utilized as frontage for Lot 2 and Lot 3. Additionally, this easement is required to be a private street to serve as frontage for Lot 2 and Lot 3. Revise the label of this easement to be "new 50' wide private street easement". 5. 117-10021 Tier 2 Assessment. Prior to fmal subdivision plat approval, a Tier II groundwater assessment study shall be conducted for the proposal. Please pay the $355 fee mentioned in comment # 1 and staff will conduct the review for the applicant. 6. [14-302(A)14, 14-428, 14-429] Note # 15 and the note above the owners signature line states that a dedication of public right of way is taking place, however, the plat does not depict this dedication. Revise the plat to depict, label, and dimension the dedication. VDOT shall review and approve the plat prior to County approval. Otherwise remove the dedication notes throughout the plat. 7. [14-303(D)] The plat lists the acreage of the lot (TMP 126-211)9) as 78 acres, however, County GIS and the LOD list the lot as 91 acres. Please confirm this is the true acreage of the lot. 8. 114-302(B)(8), 10.41 The setbacks shall be revised to add the front setback to an internal private road (25'). 9. [14-316] Approval ofentrance onto public streets. Submit evidence that the entrance of the principal means of access for each lot onto the existing public street complies with Virginia Department of Transportation standards. I recently forwarded the plat to VDOT for review. Once their review comments are received, I'll forward them to you. If you have already obtained this documentation please provide it to staff. 10. [14-302(B)10] Stream Buffers. The 100' stream buffers depicted on the plat do not match those depicted on the County's GIS map. Revise the stream buffers to match those depicted on the GIS. If you disagree with this and would like to challenge the buffer layout I can ask the Engineering department to weigh in. 11. [14-216] Revise the magisterial district listed on sheet 1 and sheet 2 to Samuel Miller. 12. [Comment] Remove the two notes that state: "access point to state -maintained roadways... " and "The signature of VDOT's representative is an acknowledge of the subdivision of land and is not an endorsement.... " 13. [14-303(0)] Revise the County's signature block to only contain the Subdivision Agent for Albemarle County. The other two reviewers listed in the signature block do not sign the plat. 14. 114-309 & 14-3101 Soil evaluations; Health Director Approval ofwells and septic systems. Each lot shall be provided a primary and reserve drainfield location approved by the Health Department. Approval by the Health Department is required before the plat can be approved. Please submit the soil work for each lot and I'll forward it to the Health Department for their review. 15. 114-235, 14-3171 Instrument evidencing maintenance of improvements. Provide a private street maintenance agreement for County Attorney review and approval prior to final plat approval. Attached is a template. 16. [14-303(S)] Control Points. Control points must be submitted. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat. 17. [14-302(B)(1)] General Information. Provide the date of the last revision. Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14, if the applicant fails to submit a revised plat to address all of the requirements within silt (6) months after the date of this letter, then the application shall be deemed voluntarily withdrawn.
