The County of Albemarle Planning Division will grant or recommend approval of the Plat referenced above once the
following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. 114-4031 Lot Frontage. Tract 2 is lacking frontage. The County approved private street which provided the
required frontage for TMP 106-13C was recorded in DB 904 PG 308 and is required to serve the parcel but was
abandoned without County approval with DB 3998 PG 606. The 30' access easement recorded with DB 3998 PG
606 is not a County approved private street and does not provide the required frontage to serve this parcel. The
original private street shall be re-established and depicted on this plat as this is the required frontage for the lot.
2. 114-302(A)(10), 18-10.3.11 Right offurther division ofproposed lots. The division rights history in the notes is
very helpful; however, they shall be omitted, and the division rights need to be written in standard format. Revise
the note as follows: "Tract 2 is assigned 4 development rights and may be further divided. Tract 1 is retaining 1
development right and may not be further divided. "
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept
up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be
found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14-229(B) of
Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within
six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the
