[14-403 and 14-412 ] Each lot within a subdivision shall have frontage on an existing or proposed street. With the proposed boundary line adjustment, TMP 85-18A3 appears to lose its street frontage. In this case, the 20' access easement can be upgraded to a 30' private street easement to provide frontage. This comment has been addressed see comment 3 for further information. 2. [4.6.1] For a lot located at the end of an access easement, frontage shall not be less than the full width of such easement (this would be a minimum of 30' if the above mentioned private street is provided). Comment has been addressed. 3. [14-306,14-317] If a private street is proposed, provide a maintenance agreement for review by the County Attorney. A private street maintenance agreement template is attached. This comment has not been addressed. A nrivate street maintenance agreement has not been provided. Creation of new private streets requires recordation of a private street maintenance agreement. A template of the agreement is attachedto this letter. Please complete the template and fill in specific information as necessary for his subdivision and provide a copy of the agreement with the next plat submittal. The maintenance agreement will be forwarded to the County Attorney for review once it is received. 4. [14-302(A)(10)] State the number of development rights available for each parcel within the development rights note (see checklist or this section of the ordinance for required language). This comment has been addressed. 5. [14-302(A)(9)] According to GIS TMP 85-18A2 does not appear to contain a building site that complies with section 4.2.1. If building site exists, please provide an exhibit showing the 30,000 sq. ft. rectangular building site for staff to review. Boundary line adjustments are permitted on nonconforming lots (section 6.4); however, it should be noted on the plat that TMP 85-18A2 does not currently contain a building site complying with 4.2.1 and that the BLA does not make the nonconforming lot more nonconforming. This comment has been addressed. 6. [14-302(6)(7)] Add a note to state that the parcels lie within a water supply watershed. This comment has been addressed. 7. [14-212.1] BLA plats shall not involve the relocation or alteration of any streets, alleys, or easements for public passage. If a private street is proposed this will need to be processed as an easement plat. Please fill out the easement plat application and pay an additional fee to cover the easement plat. Easement plats carry a fee of $817. This comment has not been addressed. Additional application or fee has not been received. 8. [14-302A] Please show the Right of Way width of Batesville Road on the Plat and include the recorded instrument number as a label or callout on Sheet 2. This comment has heen addressed_ 9. [14-302 (A)(4), 14-302 (A)(5), and 14-303 (L)] Please update the Plat to show all existing easements and state their recorded instrument number. This comment has heen addressed. 10. [14-302(B)] According to Albemarle County GIS TMP 85-18A2 and TMP 85-18A3 are located within the Flood Hazard Overlay District. Please update the Zoning information, Note 4, on Sheet 1 to include TMP 85-18A2 and TMP 85-18A3 are located within the Flood Hazard Overlay District. This comment has heen addressed. 11. [14-302(B)] Please update Sheet 2 to show and label the Floodplain as well as the Water Protection Ordinance Buffer. This comment has heen addressed_ 12. [General Comment] It appears there is a typo in Note 5. The word "further" is misspelled in sentence 2 of this note.
