This land is under conservation easement held by the Virginia Outdoor Foundation. Although we do not think this BLA, that combine two lots subject to the same conservation easement (DB3122 PG525), will adversely impact the purpose of the conservation easement you and I discussed forwarding it on to the Virginia Outdoor Foundation for them to review. Please let me know if I should do anything else. The purpose of this letter is to provide a brief summary and response to your request as it relates to the specific terms of the Deed of Easement (DOE). The proposed swimming pool's approximate location is shown on the attached plat. Two existing farm buildings near the proposed site will be removed before pool construction. Plans provided by your contractor and attached here show a 1,200 sq. ft. pool, 1, 475 sq. ft. patio, and 145 sq. ft. pool house with a bathroom and summer kitchen. You have explained that the pool size has been reduced to 900 sq. ft. The proposed pool site is currently located on a different tax map parcel than the dwelling, and so the County will require a boundary line adjustment (BLA) of the internal lot lines so that the house and pool are on the same parcel. Based on the language within the DOE, the following specific language applies to your request: Article 3. Subdivision The Property may be subdivided into a maximum of three (3) lots (each referred to hereinafter as a "Lot"). Two (2) of the Lots may be subdivided from the Property and the remaining Lot shall consist of the residual Property. For purposes of this Easement, a portion of the Property will be considered "subdivided" when approval of the division of such portion into a Lot is obtained from the County of Albemarle and a plat evidencing such approval is recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia. Article 7. Buildings and Other Structures No permanent or temporary buildings or structures shall be constructed or maintained on the Property other than the following: A. Three (3) Single Family Residential Dwellings. None of the structures allowed to be constructed under this Article, except for the cabins and their associated outbuildings and appurtenances allowed under paragraph B of this Article, shall be constructed above a contour line of nine hundred (900) feet on the USGS map. After careful consideration and analysis of the details of your request and the language within your DOE, VOF approves your request as presented above. The proposed pool site is outside of the No Build Area located above the 900 ft. elevation and the 35 ft. riparian buffer protected by the DOE. The proposed BLA is allowable under the DOE because it will adjust internal lot lines and the easement does not require certain acreage or boundaries for the parcels under easement. VOF finds your request, to construct the pool, patio, and pool house as described above, consistent with the protection of the conservation values and restrictions. You may use this letter to assist with obtaining any necessary permits in Albemarle County.
