The permitted uses of the Property are provided in Section 20 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The Property is subject to the Airport Impact and Steep Slopes Overlay Districts described in Section 30 of the Zoning Ordinance. The Property was built and authorized as a planned development under a special use permit (SP1972-00156) named Hollymead Planned Community. The Property is part of a development that contains 25 structures, 100 dwelling units, served by 208 parking spaces. The Hollymead Square Apartments were built in 1978. The Property is subject to the site development plan (SDP-179) for Hollymead Square Apartments was approved with conditions on November 23, 1976, by the Planning Commission. The Property appears to be developed in accord with these approved site development plans. Copies of these plans may be obtained through a request through the department's Records Manager. • The improvements, built in 1978, conform to the current density requirements of no greater than thirty-five dwelling units per acre. The density of the project is 7.2 dwelling units per acre. • The Property and "Current Use" of the Property as apartments/condominiums do not violate existing zoning ordinance regulations. • No application for rezoning of the Property, special use permit, or variance associated with the Property is now pending. • To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no violations or alleged violations or regulations applicable to the Property, whether pending, contemplated, or having already occurred, (ii) no fees due or pending with respect to any matter before the County Zoning Office; and (iii) no pending May 3, 2021 LZC2021-00016 Page 2 application for rezoning of the Property or for a special or conditional use permit or variance in connection with the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property is pending or overtly threatened to the best of my knowledge. • The adjacent properties are zoned Planned Unit Development. The Zoning Map link, attached below, can be used to view the existing zoning designations of any adjacent property. • In the event of casualty, the Property may be rebuilt substantially in its current form upon satisfaction of all required building permits and site plans, as applicable. • This department's policy to purge building permit files after three years per the Library of VA. Copies of Certificates of Occupancy are maintained electronically. • Copies of any relevant records may be obtained via the noted links or by using the Community Development Department Records Public Access link below.
